ORDINANCE NO. 1043
AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA AMENDING CHAPTER 14.08 OF THE
BOZEMAN MUNICIPAL CODE, AND REGULATING THE ERECTION, CONSTRUCTION, ENLARGE-
MENT, ALTERATION, REPAIR, MOVING, REMOVAL, DEMOLITION, CONVERSION, OCCUPANCY,
EQUIPMENT, USE, HEIGHT, AREA AND MAINTENANCE OF ALL BUILDINGS AND/OR STRUCTURES
IN THE CITY OF BOZEMAN, MONTANA; PROVIDING FOR THE ISSUANCE OF PERMITS AND COL-
I LECTION OF FEES THEREFORE; PROVIDING PENALTIES FOR THE VIOLATION THEREOF; RE-
PEALING ORDINANCE NO. 978 OF THE CITY OF BOZEMAN AND ALL OTHER ORDINANCES AND
PARTS OF ORDINANCES IN CONFLICT THEREWITH.
THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA DOES ORDAIN AS FOLLOWS:
Section 1
14.08.010 - That certain documents, three (3) copies of which are on file in the office
of the Building Official of the City of Bozeman, Montana, being marked and designated as
"Uniform Building Code Standards", 1979 Edition, published by the International Conference
of Building Officials, be and the same is hereby adopted as the code of the City of Bozeman
for regulating the erection, construction, enlargement, alteration, repair, moving, removal,
demolition, conversion, occupancy, eq~ipment, use, height, area and maintenance of all build-
ings and/or structures in the City of Bozeman, Montana providing for issuance of permits
and collection of fees therefore; providing penalties for violation of such code; and each
and all of the regulations, provisions, penalties, conditions and terms of such "Uniform
Building Code", 1979 Edition, and the "Uniform Building Code Standards", 1979 Edition, pub-
lished by the International Conference of Building Officials, on file in the office of
the Building Official are hereby referred to, adopted and made a part hereof as if fully
set out in this ordinance; save and except such portions thereof as have been deleted,
modified, or amended in the aforementioned official copies.
I Section 2
That Ordinance No. 978 of the City of Bozeman, Montana, and all other ordinances or
parts of ordinances in conflict herewith are hereby repealed.
Section 3
14.08.030 - Section 402 of said building code is amended as follows:
ALLEY is any public space or thoroughfare less then twenty (20) feet but not less
than ten (10) feet in width which has been dedicated or deeded to the public for the
public use.
APARTMENT HOUSE is any building or portion thereof, which is designated, built, rent-
ed, leased, let, or hired out to be occupied, or which is occupied as the home or res-
idence of five (5) or more families living independently of each other and doing
their own cooking in the said building, and shall include flats and apartments.
Section 4
That if any section, subsection, sentence, clause or phrase of this ordinance is, for
any reason, held to be unconstitutional, such decision shall not affect the validity
of the remaining portions of the ordinance. The City Commission hereby declares
that it would have passed this ordinance, and each section, subsection, clause or
phrase thereof, irrespective of the fact that anyone or more sections, subsections,
I sentences, clauses and phrases be declared unconstitutional.
Section 5
That this ordinance shall be in full force and effect from and after thirty (30)
days after its adoption.
PASSED, ADOPTED AND APPROVED by the City Commission of the City of Bozeman, this 28th
day of November , 1979.
