ORDINANCE NO. 1040
AN ORDINANCE ANNEXING CERTAIN DESCRIBED LANDS SITUATE SOUTH OF THE CITY
OF BOZEMAN, TO THE CITY OF BOZEMAN, MONTANA.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AS FOLLOWS:
Section 1 I
That the external boundaries of the area to be annexed to the City of Bozeman is
described as follows: !~~._,-~~:/\
A tract of land located in Section 24, Township 2 South, Range 5
East, Montana Principal Meridian, Gallatin County, Montana, and
being more particularly described as follows:
Beginning at the North 1/4 Corner (a brass cap) of said Section 24,
thence South 000 30' 23" West along the North-South Quarter Line,
a distance of 416.11 feet to the true point of beginning; thence
North 890 04' 51" East, along the Southerly boundary of the Summit.
Engineering Tract, a distance of 1448.80 feet to a point on the
Westerly right of way of the Milwaukee, St. Paul & Pacific Rail-
road; thence South 300 25' 00" West, along the said Westerly right
of way a distance of 51.10 feet to a point of tangency at a curve
beginning along said Westerly right of way; thence along a curve
to the left having a central angle of 80 58' 23" a radius of 1482.5
feet, an arc distance of 232.18 feet; thence South 000 25' 22" West,
along said Westerly right of way common with the Sixteenth Line,
a distance of 74.30 feet; thence along a curve to the left along
said westerly right of way having a central angle of 180 36' 11" and
a radius of 1457.50 feet; and arc distance of 473.22 feet to a point
of tangency; then South 000 06' 47" West, along the said westerly
right of way, a distance of 1688.25 feet; thence South 890 48' 25"
West a distance of 1261.15 feet; thence South 890 09' 00" West a
distance of 1346.12 feet; thence North 00009' 30" West, along the
Sixteenth Line a distance of 247.50 feet to the Southwest Corner
of the Southeast 1/4 Northwest 1/4 of said Section 24; thence North I
000 02' 47" West, along the Sixteenth Line a distance of 1322.42
feet to the Northwest Corner of the Southeast 1/4, Northwest 1/4
of said Section 24; thence North 890 28' 46" East, along the Six-
teenth Line, a distance of 1360.59 feet, to the Northeast Corner
of the Southeast 1/4, Northwest 1/4 of said Section 24; thence
000 30' 23" East, along the Quarter Line, a distance of 898.75
feet, to the true point of beginning, and containing 120.870 acres.
Section 2
That pursuant to the provisions of Section 7-2-4701, M.C.A., as amended, it is the
intent of the City of Bozeman to provide services to the area being annexed as set forth
in the report of the City-County Planning Board under date of April 1, 1980.
Section 3
That the area to be annexed to the City of Bozeman is contiguous to the municipal
boundaries at the time the annexing proceedings began.
Section 4
That no part of the area to be annexed is included within the boundaries of another
incorporated municipality.
Section 5
That the area being annexed will conform to the comprehensive plan of the City of I
Bozeman as prescribed in Section 7-2-4701, M.C.A., as amended.
Section 6
That no part of the area is included within the boundaries of any fire district or-
ganized under the provisions of Chapter 20, Title II, R.C.M., 1947, which has been organied
at least ten (10) years prior to fue commencement of annexation proceedings.

That the effective date of annexation is April 1, 1980.
PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana and approved
by the Mayor of said City this 21st day of November, 1979.
