HomeMy WebLinkAboutOrdinance 79- 1025, Municipal judge qualifications .. 001 ORDINANCE NO. 1025 AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA, ESTABLISHING THE QUALI- FICATIONS FOR THE OFFICE OF MUNICIPAL JUDGE; SETTING THE REQUIREMENTS AND TERM FOR A MUNICIPAL JUDGESHIP; PROVIDING APPOINTMENT IN CASE OF VACANCY; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE I DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, as follows: Section I Residency: That all individuals filing for election, or holding the office of Municipal Judge for a portion of or the whole of any term, shall be a citizen of the United States of America, and shall have continuously and uninterruptedly maintained a domicile and residence in the State of Montana for two calendar years prior to filing for election with the Clerk of the Commission. Any applicant for the position of Municipal Judge must, at thetime of filing for election, have continuously and uninterruptedly maintained a residency and domicile within the corporate jurisdictional limits of the City of Bozeman for a period of one year. Any- one elected or holding the office of Municipal Judge must maintain a domicile and residency within the corporate jurisdiction of the City of Bozeman during the term of office of the Judgeship. Section II Admission to the Bar: An applicant for the office of Municipal Judge must be admitted I to practice law before the Montana Bar for a period of two (2) years. Section III Limitation on Consecutive Terms: The term for the office of Municipal Judge shall be limited to one elected four-year term in succession, which shall be held during the General Election, irrespective of time spent in the office by those individuals appointed by the City Commission to fill a vacancy created during the four-year term of another office holder. Section IV Vacancy: Should a vacancy occur in the office of Municipal Judge, the City Commission shall appoint a qualified individual to serve for the remainder of the term. Section V Administrative Functions -- Office Hours: The office hours of the Municipal Judge, place - and time where Court is held, and monthly report requirements shall be prescribed by the City Commission. Section VI Salary: The salary for Municipal Judge shall be set by the City Commission in accordance with the State law. I Section VII Non-partisan Election: Names of candidates for the office of Municipal Judge shall be placed on the ballot without party designation. Section VIII All other ordinances or resolutions or parts of ordinances or resolutions in conflict with this ordinance are hereby repealed. OR,DlNANCE ~Q. 1025 002 Section IX If any section, sentence, clause or phrase of this Ordinance is held to be invalid or unconstitutional by any Court of competent jurisdiction, then said holding shall in no way affect the validity of the remaining portions of this Ordinance.
