HomeMy WebLinkAboutOrdinance 78- 1017, Vacates portions of streets in Northern Pacific Addition 480 ORDINANCE NO. 1017 AN ORDINANCE OF THE CITY OF BOZEMAN VACATING PORTIONS OF FRIDLEY STREET AND MACADOW STREET IN THE NORTHERN PACIFIC ADDITION TO THE CITY OF BOZEMAN, MONTANA. WHEREAS, certain property owners on property abutting the hereinafter described streets I in the Northern Pacific Addition to Bozeman, Montana, have presented to the City Commission a petition requesting vacation of said streets; and WHEREAS, the City Commission of the City of Bozeman, Montana, on the 11th day of October, 1978, at its regular meeting passed and adopted Commission Resolution No. 2005 de- claring it to be the intention of the City Commission of the City of Bozeman to vacate por- tions of Fridley and Macadow Streets described as follows: Beginning at the Southwest corner of Lot 27, Block 49, Northern Pacific Addition to the City of Bozeman; thence Southeasterly along the South line of said Lot 27 to the Southeast corner of said Block 49, a distance of 152 feet; thence Northeasterly a distance of 259.7 feet to the Northeast corner of Lot 17, said Block 49, thence Easterly a distance of 60 feet to the West line of Block 47, Northern Pacific Addition; thence Southwesterly approximately 320 feet more or less to the Northeast corner of Lot 46, Northern Pacific Addition; thence Westerly along the North boundary of said Block 46 a distance of 217 feet to the East line of the alley in said Block 46; thence Northerly a distance of 60 feet to the point of beginning. The area enclosed is approximately 28,800 square feet or two-thirds (2/3) of an acre. WHEREAS, notice of the adoption of said resolution was published in the Bozeman Daily Chronicle at least once, to wit, on the 17th day of October, 1978, as appears from the af- fidavit of publication of the publisher of said Bozeman Daily Chronicle, which is on file with the Clerk of the City Commission of the City of Bozeman; and WHEREAS, said notice of the adoption of said resolution has been served in the manner of the service of summons in civil actions upon all persons whose property abutts upon the I above described streets proposed to be vacated and which will be affected by the proposed vacation, which said notice designated Wednesday, the 8th of November, 1978, at 1:15 o'clock p.m., at the Commission Room in the City Hall Building, Bozeman, Montana, as the time and place for hearing objections; and WHEREAS, on the 8th day of November, at its regular meeting the City Commission fully heard objections to and evidence in support of said vacation. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 That the hereinbefore described portions of Fridley and Macadow Streets be vacated. Section 2 This ordinance shall be in full force and effect from and after thirty (30) days after its adoption.
