ORDINANCE NO. 999
AN ORDINANCE OF THE CITY OF BOZEMAN VACATING A PORTION OF THE ALLEYS IN
BLOCK 53 OF THE NORTHERN PACIFIC ADDITION OF BOZEMAN, MONTANA, AND A
PORTION OF ORANGE STREET OF BOZEMAN, MONTANA.
I WHEREAS, certain property owners on property abutting the hereinafter described portions
of Orange Street and portions of an alley located in Block 53 of the Northern Pacific Addition
have presented to the City Commission a petition requesting vacation of said portions of Orange
Street and portions of said alley; and
WHEREAS, the City Commission of the City of Bozeman, Montana, on the 16th day of November,
1977, at its regular meeting passed and adopted Commission Resolution No. 1929 declaring it to
be the intention of the City Commission of the City of Bozeman, to vacate the following portions
of Orange Street and the alley in Block 53 of the Northern Pacific Addition, described as follows:
That portion of Orange Street located between the West half of Block
50, Northern Pacific Addition, and the West half of Block 53, North-
ern Pacific Addition, that also lies South and West of a straight line
from the Northeast corner of Block 52, Northern Pacific Addition, to
the Northeast corner of Block 50 of said Addition.
That portion of the alley, located in Block 53 of Northern Pacific
Add it ion, that has not been vacated, extending from the West line
of North Broadway Avenue, in a Northwesterly, Southeasterly direc-
tion, to the East line of Plum Avenue. And
The alley located in Block 53, Northern Pacific Addition, extending
from the East line of Plum Avenue, East, to the intersection of an
alley located between Plum Avenue and North Broadway Avenue. And
That portion of the alley located in Block 53, Northern Pacific
Addition, between Plum Avenue and North Broadway Avenue extending
South from the intersection with an alley extending in a Northwest-
I erly, Southeasterly direction, to a point of intersection with the
Northerly line of Avacado Street.
WHEREAS, Notice of the adoption of said resolution was published in the Bozeman Daily
Chronicle at least once, towit on the 25th day of November, 1977, as appears from the affi-
davit of publication of the publisher of said Bozeman Daily Chronicle, which is on file with
the Clerk of the City Commission of the City of Bozeman; and
WHEREAS, said notice of the adoption of said resolution has been served in the manner of
the service of Summons in Civil Actions upon all persons whose property abutts upon the por-
tion of Orange Street and the above-described alley proposed to be vacated and which will be
effected by the proposed vacation, which said notice designated Wednesday, the 21st day of
December, 1977, at 1:15 o'clock p.m., at the Commission Room in the City Hall Building,
Bozeman, Montana, as the time and place for hearing objections; and
WHEREAS, on the 21st day of December, 1977, at its regular meeting, the City Commission
fully heard objections to and evidence in support of said vacation;
WHEREAS, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN:
Section I
That subject to delivery and receipt of a warranty deed from Chicago, Milwaukee, St.
Paul and Pacific Ry. Co. to the City of Bozeman, conveying all of Avacado Street through
Block 53 of the Northern Pacific Addition to the City of Bozeman, it is ordained by the City
Commission that the following streets and alleys be vacated, to-wit:
I That portion of Orange Street located between the West half of Block 50,
Northern Pacific Addition, and the West half of Block 53, Northern Pacific
Add it ion, that also lies South and West of a straight line drawn from the
Northeast corner of Block 52, Northern Pacific Addition, to the Northeast
corner of Block 50, of said Addition.
That portion of an alley, located in Block 53, of the Northern Pacific
Addition, that has not been vacated, extending from the West line of the
North Broadway Avenue in a Northwesterly, Southeasterly direction, to the
East line of Plum Avenue.
The alley located in Block 53, Northern Pacific Addition, extending from
the East line of Plum Avenue, East, to the intersection of an alley lo-
cated between Plum Avenue and North Broadway Avenue.

That portion of the alley located in Block 53, Northern Pacific Addition,
between Plum Avenue and North Broadway Avenue extending South from the
intersection with an alley extending in a Northwesterly, Southeasterly
direction, to a point of intersection with the Northerly line of Avacado
Street.
Section II
This ordinance shall be in full force and effect from and after thirty (30) days after I
its adoption and upon receipt and delivery to the City of Bozeman of a warranty deed ex-
ecuted by the Chicago, Milwaukee, St. Paul and Pacific Ry. Co. conveying all of Avacado
Street through Block 53 of Northern Pacific Addition to the City of Bozeman.
PASSED AND ADOPTED at the regular meeting of the City Commission of the City of Bozeman,
held on this 11th day of January, 1978.
