HomeMy WebLinkAboutOrdinance 77- 995, Annexation 439 ORDINANCE NO. 995 AN ORDINANCE EXTENDING THE CORPORATE LIMITS OF THE CITY OF BOZEMAN TO INCLUDE A TRACT OF LAND, COMMONLY KNOWN AS THE McCHESNEY PARCEL, WHICH IS CONTIGUOUS TO THE CITY OF BOZEMAN, WITHIN THE CORPORATE LIMITS OF THE CITY OF BOZEMAN. WHEREAS, on the 28th day of September, 1977, at a public hearing held in the Commission Chambers in the City Hall Building in the City of Bozeman, a representative of the municipality I designated by the governing body made an explanation of a planned service report as required by Section 11-518 R.C.M., 1947, act of which residents of the territory described in the notice of public hearing and all residents of the muncipality were given an opportunity to be heard, and WHEREAS, more than seven days and less than sixty days have elapsed following such public hearing, and WHEREAS, for a period of twenty days after the public hearing no expressions of disapproval in wriring from resident freeholders of the territory proposed to be annexed were received by the City Clerk of the City Commission, or at all, and WHEREAS, the external boundaries of the area to be annexed are described in Exhibit "A" hereunto attached and by this reference incorporated herein, and WHEREAS, the City Commission does specifically find as follows: (a) The territory to be annexed is contiguous to the municipality at the time the annexation proceedings commenced; (b) No part of the area to be annexed is included within the boundary of another incorporated municipality; (c) That the territory proposed to be annexed is included within and conforms to a comprehensive plan as prescribed in Title II, Chapter 38, R.C.M., 1947; (d) That no part of the area to be annexed is included within the boundary of any fire district organized under the provisions of Title II, Chapter 20, R.C.M., 1947, which was organized at least ten years prior to the inception of such attempted annexation; (e) That in fixing the new municipal boundaries the use of natural topographic features has I been employed wherever practical; and WHEREAS, it is the intent of the City of Bozeman to provide the services to the area being annexed as set forth in the planned services report as required by Section 11-518 R.C.M., 1947. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN AS FOLLOWS: That all of the land described in Exhibit "A" hereunto attached be and the same hereby are annexed to and included within the corporate limits of the City of Bozeman, Montana. That from and after the 11th day of November, 1977, this ordinance and the annexation of said lands shall become effective, and the territory described in Exhibit "A" and its citizens and properties shall be subject to all debts, laws, ordinances and regulations in force in the City of Bozeman, Montana, and shall be entitled to the same privileges and benefits as other parts of said municipality. The aforesaid annexed territory shall be subject to municipal taxes levied for the fiscal year following the effective date of annexation. IN WITNESS WHEREOF I hereunto set my hand and affix the co!porate seal of my office this 17th day of October 1977. ~ /(~ ,/~- " Clerk of the City Co ssion ORDINANCE NO. 995 440 EXHIBIT "A" * A tract of land located in the Northeast one-quarter of Section One, Township Two South, Range Five East, M.P.M., Gallatin County, Montana, being a part of that tract recorded in Book 146, Page 37, Gallatin County Records and more precisely described as follows: Beginning at a point on the North line of said Northeast one-quarter, said point being South 37033'22" West a distance of 275.10 feet from the Northeast corner of Section I One, thence South 01011'40" East a distance of 1254.44 feet to a point on the Northerly right-of-way of Highway 1-90. Thence along said right-of-way through the following courses: North 74041'17" West a distance of 269.11 feet North 54058'09" West a distance of 850.50 feet North 74041'17" West a distance of 16.00 feet to a point on the Easterly right-of-way of u.S. 10. Thence along said Easterly right-of-way through the following courses: North 00053'40" West a distance of 61.00 feet North 10055'24" West a distance of 248.00 feet North 00053'40" West a distance of 368.74 feet to the north right-of-way of Griffin Drive. Thence along said right-of-way North 88010'23" East a distance of 998.93 feet. Thence South 01011'40" East a distance of 32.26 feet to the point of beginning.
