HomeMy WebLinkAboutOrdinance 77- 987, Amends §§ 18.09.020 and 18.09.030, zoning 423 ORDINANCE NO. 987 AN ORDINANCE AMENDING SECTIONS 18.09.020 AND 18.09.030 OF THE BOZEMAN MUNICIPAL CODE DELETING PREFERENCE TO LAND USE PERMITS FROM THE ADMIN~ ISTRATION AND ENFORCEMENT CHAPTER OF THE ZONING TITLE AND PROVIDING FOR AN EFFECTIVE DATE. Be it ordained by the City Commission of the City of Bozeman, Montana, as follow& I to wit: ~ectiori 1 That Section 18.09.020 of the Bozeman Municipal Code be and the same is hereby amended to read as follows: 18.09.020 PERMITS No building or other structure shall be erected, moved, added to, or structurally altered and no land use shall be changed without valid permits as prescribed herein. Building Permit - Within the limits of the City of Bozeman and its extraterritorial zoning limits, building permits shall be obtained by following the Uniform Building Code (International Conference of Building Officials, 5360 South Workman Mill Road, Whittier, California) most recent edition, Chapter 3. Exception: for purpose~ of this section all structures used for agricultural pur- poses snaIl not be required to obtain a building permit. However, all such struc- tures shall be reviewed by the Building Official, as to their compliance to all other requirements of the Bozeman Area Zoning Code such as lot area, lot coverage, yard spaces, etc. Said building permit shall be obtained by application to the City Building Official. Applications shall be accompanied by plans in duplicate, drawn to scale showing the actual dimensions and shape of the lot to be built upon, the legal description of the parcel; the exact sizes and location on the lot(s) of buildings already existing, if any; and the location and dimensions of the proposed buildings or alternatives. The application shall include such other information as lawfully may be required I and by the Building Official, including existing or proposed building and land; the number of families, housing units, or rental units the building is designed to accomodate; conditions existing on the lot; and such other matters as may be neces- sary to determine conformance with, and provide for the enforcement of this ordinance. One copy of the plans shall be returned to the applicant by the Building Official, after he shall have marked each copy either as approved or disapproved and attested to same by his signature. The second copy similarly marked shall be retained by the Building Official. Section 2 That Section 18.09.030 of the Bozeman Municipal Code be and the same is hereby amended to read as follows: 18.09.030 CONFORMANCE No permit of any type shall be issued unless in conformance with the regulations contained within this ordinance. Permits issued on the basis of plans and applica- tions approved by the Building Official authorize 'only the use, arrangement or construction. Use, arrangement or construction at variance with that authorized shall be deemed a violation of this ordinance punishable as provided in Title 18, Chapter 18.99 of the Bozeman Municipal Code. Conditional use permits approved by the City Co~ission and variances granted by the Board of Adjustment shall be deemed in conformance with the terms of this ordi~ nance. However, building permits shall be issued only in accordance with the terms set forth in the conditional use permit and variance sections of this ordinance. Section 3 I This ordinance shall be in full force and effect 30 days from and after its final passage and approval according to law.
