ORDINANCE NO. 986
AN ORDINANCE OF THE CITY OF BOZEMAN VACATING A PORTION OF THE ALLEY IN BLOCK C
OF THE ORIGINAL TOWNSITE OF BOZEMAN, MONTANA.
WHEREAS, certain property owners owning property abutting on said portion of Block C of the
Original Townsite of Bozeman, Montana, having presented to the City Commission a petition asking
the City Commission to institute the necessary proceedings to vacate the above described alley; and,
WHEREAS, the City Commission on the 9th day of March, 1977, at its regular meeting, passed and I
adopted Commission Resolution No. 1868, declaring it to be the intention of the City Commission of
the City of Bozeman, Montana, to vacate a portion of the alley in Block C of the Original Townsite
of Bozeman, Montana, and directing the City Manager to cause notice of the adoption of the Resolution
to be served in the manner that service of summons is required on all persons whose property abuts
on the alley above described which will be affected by the proposed vacation, and by publication
once in a daily newspaper in general circulation in the City of Bozeman, as provided by law; and
~IEREAS, pursuant to said Resolution, notice of the adoption of said Resolution was published
in the Bozeman Daily Chronicle at least once, to wit, on the 14th day of March, 1977, as appears
from the Affidavit of Publication of the publisher of said Bozeman Daily Chronicle, which is on
file with the Clerk of the City Commission of the City of Bozeman; and,
WHEREAS, said Notice of the adoption of said Resolution has been served in the manner of the
service of summons in civil actions upon all persons whose property abuts upon the alley in Block C
of the Original Townsite to Bozeman, Montana, which will be affected by the proposed vacation, which
said notice designated Wednesday, the 6th day of April, 1977, at 1:15 o'clock p.m. at the Commission
Room in the City Hall Building, Bozeman, Montana, as the time and place for hearing objections; and,
WHEREAS, on the 6th day of April, 1977, at its regular meeting, the City Commission fully
heard objections to and the evidence in support of said vacation; and,
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF BOZEMAN:
Section 1
That the following described alley be, and the same hereby is vacated and discontinued:
All that part of Lots 4, 5, 32 and 33 of Block C of the Original Townsite, City I
of Bozeman, Montana, and being more particuarly described as follows:
Beginning at a point in the south line of said Lot 4, said point being 6.5 feet
east of the southwest corner of said Lot 4; thence North parallel to the west
lot line of said Lot 4, a distance of 10.0 feet; thence East parallel to the
south lines of said Lots 4 and 5, a distance of 28.5 feet to a point 5.0 feet
east of the west lot line of Lot 5; thence South parallel to the west lot lines
of Lots 5 and 32, a distance of 28.5 feet to a point 6.5 feet east of the west
lot of Lot 33; thence North parallel to the west lot line of Lot 33, a distance
of 22.0 feet to the point of beginning and containing 0.0196 acres.
Section 2
This ordinance shall be in full force and effect from and after thirty (30) days after its
adoption.
PASSED AND ADOPTED at the regular meeting of the City Commission of the City of Bozeman, held
this 6th day of April, 1977 .
