ORDINANCE NO. 984
AN ORDINANCE OF THE CITY OF BOZEMAN VACATING THE REMAINING PORTION OF STREET
BETWEEN BLOCKS 41 AND 46, NORTHERN PACIFIC ADDITION TO THE CITY OF BOZEMAN,
MONTANA.
WHEREAS, certain property owners owning property abutting the hereinafter described portion
of street between Blocks 41 and 46 in the Northern Pacific Addition to the City of Bozeman, Montana,
having presented to the City Commission a petition asking the City Commission to institute the I
necessary proceedings to vacate the same; and,
WHEREAS, the City Commission on the 16th day of February, 1977, at its regular meeting,
passed and adopted Commission Resolution No. 1861, delcaring it to be the intention of the City
Commission of the City of Bozeman to vacate the portion of street between Blocks 41 and 46 in the
Northern Pacific Addition to the City of Bozeman, Montana, and directing the City Manager to cause
notice of the adoption of the resolution to be served in the manner that service of summons is
required on all persons whose property abuts on that said portion of the street between Blocks 41
and 46 in the Northern Pacific Addition which will be affected by the proposed vacation, and by
publication once in a daily newspaper in general circulation in the City of Bozeman, as provided
by law; and,
WHEREAS, pursuant to said resolution, notice of the adoption of said resolution was published
in the Bozeman Daily Chronicle at least once to wit, on the 28th day of February, 1977, as appears
from the Affidavit of Publication of the publisher of said Bozeman Daily Chronicle, which is on
file with the Clerk of the City Commission of the City of Bozeman; and,
WHEREAS, said Notice of the adoption of said resolution has been served in the manner of the
service of summons in civil actions upon all persons whose property abuts upon the said portion
of the street in the Northern Pacific Addition to the City of Bozeman, Montana, which will be
affected by the proposed vacation, which said notice designated Wednesday, the 23rd day of March
1977 , at 1:15 o'clock p.m. of said day at the Commission Room in the City Hall Building, Bozeman,
Montana, as the time and place for hearing objections; and,
WHEREAS, on the 23rd day of March, 1977, at its regular meeting, the City Commission fully I
heard objections to and the evidence in support of said vacation and the Commission finds that
less than 51% of the affected property owners object to the proposed vacation; and,
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF BOZEMAN:
Section 1
That the following described portion of street in the Northern Pacific Addition to the
City of Bozeman be, and the same is hereby vacated and discontinued:
That remaining portion of Mulberry (Davis) Street between Block 41 and 46
of the Northern Pacific Addition to the City of Bozeman lying between
Broadway Avenue and that portion of Mulberry Street vacated by Ordinance
148 on February 18, 1897, a parcel of land approximately sixty (60) feet by
one hundred (100) feet.
Section 2
This ordinance sh~ll be in full force and effect from and after 30 days after its adoption.
PASSED AND ADOPTED at the regular meeting of the City Commission of the City of Bozeman, held
this 23rd day of March, 1977 .
