ORDINANCE NO. 971
AN ORDINANCE AMENDING SECTION 18.93.030 OF THE BOZEMAN
MUNICIPAL CODE AND DESIGNATING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AS
FOLLOWS, TO WIT:
Section 1
That Section 18.93.030 of the Bozeman Municipal Code be and the same is I
hereby amended to read as follows:
18.93.030 POWERS AND DUTIES - The Board shall set its operating rules
in accordance with Section 11-2707, R.C.M. 1947, and shall have the
following powers:
1. To hear and decide appeals where it is alleged there is
error in any order, requirement, decision, or determina-
tion made by an administrative official in the enforce-
ment of this act or of any ordinance adopted pursuant
thereto.
2. To authorize upon appeal in specific cases such variance
from the terms of the ordinance as will not be contrary
to the public interest, where owing to special conditions,
a literal enforcement of the provisions of the ordinance
will result in unnecessary hardship, and so that the
spirit of the ordinance shall be observed and substantial
justice done.
More specifically, the Board may, after public notice and
hearing, conditionally approve, deny, or approve any re-
quest to modify the following requirements of this ordinance.
A. Setback requirements.
B. Yard requirements.
C. Area requirements.
D. Height requirements.
E. Parking requirements. I
F. Loading requirements.
G. Expansion of non-conforming uses of land and structures.
H. Flood Hazard District requirements as per section.
3. The concurring vote of four members of the Board shall be
necessary to reverse any order, requirements, decisions,
or determination of any administrative official, or to
decide in favor of the applicant on any matter upon wh>ch -
it is required to pass under this ordinance, or to effect-
any variation of this ordinance. '~

This ordinance shall be in full force and effect 30 days from and after its
final passage and approval according to law.
PASSED by the City Commission and approved by the Mayor of the City of
Bozeman this 7th day of July, 1976.
