HomeMy WebLinkAboutOrdinance 76- 962, Formula for assessment of property affected by special improvement district No. 565 I I I ORDINANCE NO. 962 AN ORDINANCE ESTABLISHING A FORMULA FOR THE METHOD OF ASSESS- MENT OF PROPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 565 IN THE CITY OF BOZEMAN, MONTANA, FOR ESTABLISHING OFF-STREET PARKING FACILITIES IN THE CITY OF BOZEMAN AND SETTING A TIME AND PLACE FOR PUBLIC HEARING ON SAID FORMULA AND DIRECTING THE PUBLICATION AND MAILING OF NOTICE THEREOF. * * * * * * * * * * * * BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA: Section 1 That the formula to be used in determining the assessment of each lot and parcel within special improvement district No. 565 for the purpose of establishing off-street parking facilities in the city of Bozeman is set forth in-Exhibit "A" hereto attached and.by this reference incorporated in and_b~de a part of this ordinance as fully as if set forth herein. Section 2 That in considering the benefit to be received by each parcel of land and in determining the formula to be used in the method of assessment of each lot or parcel of land within said district, the City Commission will consider the fo11ow- ing factors: a. the relative distance of the parking facility from each parcel of land within the area of the special improvement district; b. the relative needs of parking spaces for each parcel of land located within the boundaries of said district, either as established by the city zoning ordinance, if any, or otherwise, with relation to the use of said parcel; c. the assessed value of each parcel within said district; d. the square footage of each parcel within said district as it relates to the whole; e. the square footage of floor space in any improvements on the parcel and the various uses of such floor space; and f. the availability of existing on-site parking space on any parcel of land within the district. Section 3 That on Wednesday, the 7th day of July, 1976, at the hour of 1:30 o'clock p.m. in the city commission room of the City Hall Building of the city of Bozeman, Montana, the City Commission of the city of Bozeman will hold a public hearing when and where all persons concerned may present their objections to said formula, or any part of it and point out errors and inequities and submit reasons for amendments and corrections. Section 4 That the Clerk of the City Commission of the city of Bozeman is hereby directed to'cause notice of said public hearing to be published for five (5) days in advance of said hearing in the Bozeman Daily Chronicle, a daily newspaper of the city of Bozeman, Montana, and shall ORDINANCE NO. 962 373 374 Where: And cause a copy of said notice to be mailed to every person, firm or corporation having real property within the proposed special improvement district No. 565, listed in his name upon the last completed assessment roll for the state, county and school district taxes at his last known address upon the same day such notice is first published. Such notice shall state the proposed formula and the factors to be considered by the City Commission and designate the time when and the place where the commission will hear objections thereto. The proposed formula is set forth in Exhibit "A" hereunto attached and by this reference incorporated in and made a part of this ordinance as fully as if set forth herein.
