ORDINANCE NO. 930
AN ORDINANCE OF THE CITY OF BOZEMAN VACATING THAT PORTION OF
BABCOCK STREET LYING IN ROUSE ADDITION TO BOZEMAN, MONTANA,
LYING BETWEEN BLOCK C OF ROUSE ADDITION AND BLOCK B OF ROUSE'S
SECOND ADDITION TO BOZEMAN, MONTANA; ALSO THE 20 FOOT WIDE
ALLEY OF BLOCK B OF ROUSE'S SECOND ADDITION; THAT PORTION
OF OLIVE STREET LYING IN ROUSE'S SECOND ADDITION TO BOZEMAN,
MONTANA, BETWEEN AND ABUTTING ON BLOCK B AND BLOCK C OF SAID
ROUSE'S SECOND ADDITION; THE EAST-WEST 20 FOOT WIDE ALLEY
OF BLOCK C ABUTTING ON LOTS 1 THROUGH 13 OF BLOCK C ON THE
NORTH AND LOTS 14 THROUGH 26 OF BLOCK C ON THE SOUTH, BOUNDED
ON THE WEST BY THE EAST LINE OF SOUTH WALLACE AVENUE AND
BOUNDED ON THE EAST BY THE WEST LINE OF IDA STREET; AND THAT
PORTION OF EAST CURTISS STREET LYING IN SAID ROUSE'S SECOND
ADDITION, BOUNDED ON THE SOUTH BY BLOCK F OF SAID ROUSE'S
SECOND ADDITION AND A PORTION OF THE CITY OF BOZEMAN CEMETERY
LAND, BOUNDED ON THE WEST BY THE EAST LINE OF SOUTH WALLACE
AVENUE AND ON THE EAST BY THE WEST LINE OF IDA STREET.

WHEREAS, certain property owners owning property abutting on the above described streets and
alleys in Rouse Addition and Rouse's Second Addition to Bozeman, Montana, having presented to the
City Commission a petition asking the City Commission to institute the necessary proceedings to
vacate the above described alley and street; and
WHEREAS, the City Commission of the 23rd day of May, 1973, at its regular meeting, passed and
adopted Commission Resolution No. 1577 declaring it to be the intention of the City Commission of
the City of Bozeman, Montana, to vacate the following described streets and alleys in Rouse
Addition and Rouse's Second Addition to Bozeman, Montana, and directing the City Manager to cause
notice of the adoption of the Resolution to be served in the manner that service of summons is
WHEREAS, pursuant to said Resolution , notice of the adoption of said Resolution was published

required on all persons whose property abutts on the streets and alleys above described which will
be affected by the proposed vacation, and by publication once in a daily newspaper in general cir-
culation in the City of Bozeman, as provided by law; and
in the Bozeman Daily Chronicle at least one, to wit, on the 30th day of May, 1973, as appears from
the Affidavit of Publication of the publisher of said Bozeman Daily Chronicle, which is on file
with the Clerk of the City Commission of the City of Bozeman; and
WHEREAS, said notice of the adoption of said Resolution has been served in the manner of the
service of summons in civil actions upon Milwaukee Road, 606 East Main Street, Bozeman, Montana;
Kenyon-Noble Lumber Company, 25 East Mendenhall Street, Bozeman, Montana; and Empire Building
Materials, 608 East Main Street, Bozeman, Montana; which said notice designated June 20, 1973, at
1:15 o'clock p.m. at the Commission Room in the City Hall Building in the City of Bozeman, Montana,
as the time and place for hearing objections; and
WHEREAS, on the 20th day of June, 1973, at its regular meeting the City Commission fully heard
objections to and the evidence in support of said vacation; and
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF BOZEMAN;
Section 1
That portion of Babcock Street originally platted as Montana Street lying
in Rouse Addition to Bozeman, Montana, and lying between Block C of said
Rouse Addition and Block B of Rouse's Second Addition and bounded by the
east line of South Wallace Avenue on the West and the west line of Ida
Street on the east.
and discontinued: III
That the following described street and alley be, and the same hereby are vacated
Also the twenty (20) foot wide alley of Block B of Rouse's Second Addition
as originally platted, lying between the east line of South Wallace Avenue
and the west line of Ida Street on the east.

That portion of Olive Street lying in Rouse's Second Addition to Bozeman,
Montana, between and abutting on Block B and Block C of said Rouse's Second
Addition and bounded on the west by the east line of South Wallace Avenue
and on the east by the west line of Ida Street.
Also the east-west twenty (20) foot wide alley of Block C as platted abutting
on Lots 1 through 13 of Block C on the north and Lots 14 through 26 of Block
C on the south, bounded on the west by the east line of South Wallace Avenue
and bounded on the east by the west line of Ida Street.
Also that portion of East Curtiss Street lying in said Rouse's Second Addition,
bounded on the north by Block C of said Rouse's Second Addition, bounded on the
south by Block F of said Rouse's Second Addition and a portion of the City of
Bozeman Cemetery land, bounded on the west by the east line of South Wallace
Avenue and on the east by the west line of Ida Street.
Section 2
This ordinance shall be in full force and effect from and after thirty (30) days after its
adoption.
PASSED AND ADOPTED at the regular meeting of the City Commission of the City of Bozeman held
this 20th day of June, 1973.
