HomeMy WebLinkAboutOrdinance 72- 923, Vacates portion of alley in Block "C" of Original Townsite deeded to city by Security Building Inc. 250 ORDINANCE NO. 921 AN ORDINANCE OF THE CITY OF BOZEMAN VACATING THAT PORTION OF AN ALLEY IN BLOCK "c" OF THE ORIGINAL TOWNSITE OF BOZEMAN, MONTANA, RUNNING NORTH AND SOUTH, BEING A PORTION OF AN ALLEY DEEDED TO THE CITY OF BOZEMAN BY THE SECURITY BUILDING, INC. AS FILED AND RECORDED IN BOOK 129, PAGE 350, COUNTY CLERK AND RECORDER'S OFFICE, GALLATIN COUNTY, MONTANA. WHEREAS, certain property owners owning property abutting on that portion of an alley in Block "c" of the Original Townsite of Bozeman, Montana, running North and South, being a portion of an alley deeded to the City of Bozeman by the Security Building Inc., having presented to the City Commission a petition asking the City Commission to institute the necessary proceedings to vacate the above described alley; and WHEREAS, the City Commission on the 26th day of April, 1972, at its regular meeting, passed and adopted Commission Resolution No. 1510 declaring it to be the intention of the City Commission of the City of Bozeman, Montana, to vacate a portion of the alley situate in Block "c" of the original townsite of Bozeman,Montana, running north and south, and directing the City Manager to cause notice of the adoption of the Resolution to be served in the manner that service of summons is required on all persons whose property abutts on the alley above described which will be affected by the proposed vacation, and by publication once in a daily newspaper in general circulation in the City of Bozeman, as provided by law; and WHEREAS, pursuant to said Resolution, Notice of the adoption of said Resolution was published in the Bozeman Daily Chronicle at least once, to wit, on the 5th day of May, 1972, as appears from the Affidavit of Publication of the publisher of said Bozeman Daily Chronicle, which is on file with the Clerk of the City Commission of the City of Bozeman; and WHEREAS, said notice of the adoption of the said Resolution has been served in the manner of the service of summons in civil actions upon the Security Building Inc., which said notice designated June 7, 1972, at 1:15 o'clock p.m. at the Commission Room in the City Hall Building in the City of Bozeman as the time and place for hearing objec tions; and, WHEREAS, on the 7th day of June, 1972, at its regular meeting the City Commission fully heard objections to and the evidence in support of said vacation; and NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF BOZEMAN: Section 1 That a portion of an alley in Block "c" of the Original Townsite of Bozeman, Montana, running north and south, and more fully described as follows, be, and the same hereby is vacated and discontinued: Beginning at a point on the south line of said Block C of Original Townsite of Bozeman, Montana, said point being twenty-one and five-tenths (21.5) feet wes terly of the southeas t- corner of Lot 30 of said Block C; thence northerly parallel to and twenty-one and five-tenths (21.5) feet distant westerly from the east line of said Lot 30, a distance of one hundred forty-one and five- tenths (141.5) feet to a point on the southerly line of the present east- west alley, thence westerly along said southerly alley line a distance of twenty (20) feet; thence southerly parallel to and eighteen and five-tenths (18.5) feet distant easterly from the westerly line of Lot 31 of said Block C a distance of 141.5 feet to the southerly line of said Block C; thence easterly along said south line of Block C a distance of 20 feet to the point of beginnings. Reserving unto the City of Bozeman an easement for existing sanitary sewer mains and appurtenances and any other existing utilities, and access to the above described property to maintain said sanitary sewer service and other uti li t ie s . Sec tion 2 This ordinance shall be in full force and affect from and after thirty (30) days after its adoption.
