HomeMy WebLinkAboutOrdinance 72- 920, Vacates portion of alley in Brady's Rearrangement of Babcock and Davis Addition. 248 ORDINANCE NO. 920 AN ORDINANCE OF THE CITY OF BOZEMAN VACATING A PORTION OF THE ALLEY SITUATE IN BRADY'S REARRANGEMENT OF BABCOCK AND DAVIS ADDITION TO BOZEMAN, MONTANA. ***************** WHEREAS certain property owners owning property abutting on a portion of the alley situate in Brady's Rearrangement of Babcock and Davis Addition to the City of Bozeman, Montana, having presented to the City Commission a petition asking the City Commission to institute the necessary proceedings to vacate the above described alley; and WHEREAS, The City Commission on the 19th day of April, 1972, at its regular meeting, passed and adopted Commission Resolution No. 1509 declaring it to be the intention of the City Commission of the City of Bozeman, Montana, to vacate a portion of the alley situate in Brady's Rearrangement of Babcock and Davis Addition to the City of Bozeman, Montana, and directing the City Manager to cause notice of the adoption of the Resolution to be served in the manner that service of summons is re- quired on all persons whose property abutts on the alley above described which will be affected by the proposed vacation, and by publication once in a daily newspaper in general circulation in the City of Bozeman, as provided by law; and WHEREAS, pursuant to said Resolution, notice of the adoption of said Resolution was published in the Bozeman Daily Chronicle at least once, to-wit, on the 24th day of April, 1972, as appears from the Affidavit of Publication of the publisher of said Bozeman Daily Chronicle, which is on file with the Clerk of the City Commission of the Ci ty of Bozeman; and WHEREAS, said notice of the adoption of the said Resolution has been served in the manner of the service of summons in civil actions upon Joseph D. and Sharon E. Annold, Clarence J. and Clara Lee Vranish, Clarence J. and Marie M. Schroeder, Kenneth F. and Janie B. Betley, Evelyn J. Arnold, Donald M. and Betty R. Caine, Victor B. and Elaine A. Oma, George G. Chesnut, Herschel Jean and Joan Moore, Bozeman Montana Congregation of Jehovahs Witnesses, Vaughn and Lavina Chadourne, Mary Burright, Jerrold E. Sandeen, Peter R. and Susan C. Martin, Georgie C. Williams, Virginia E. Smith, Ira D. and Stella \Hlkie, and Lloyd Eldridge, which said notice designated May 24, 1972, at l:lS o'clock p.m., at the Commission Room in the City Hall Building in the City of Bozeman as the time and place for hearing objections; and WHEREAS, on the 24th day of May, 1972, at its regular meeting the City Commission fully heard objections to and the evidence in support of said vacation; and NOW, THEREFORE, BE IT ORDAINED BY. THE COMMISSION OF THE CITY OF BOZEMAN: Sec tion I That a portion of the alley situate in Brady's Rearrangement of Babcock and Davis Addition to the City of Bozeman, Montana, more fully described as follows, be, and the same hereby is vacated and discontinued: The north-south ten (10) foot wide alley lying adjacent and between Lots B, C, D and Lots E and F of Brady's Rearrangement of Babcock and Davis Addition to Bozeman, Montana; also that ten (10) foot wide east and west alley of said Brady's Rearrangement lying between Lots E and L and Lot 1 of said Brady's Rearrangement and Lot 2 of Babcock and Davis Addition; also that north-south alley ten (10) feet in width lying adjacent to and between Lots I, J, K, L and Tracts 1, 2, 3, 4 and 5 of Lot 1 of said Brady's Rearrangement of Babcock and Davis Addition to Bozeman, Montana. Reserving unto the City of Bozeman an easement for existing sanitary sewer mains and appurtenances and any other existing utilities, and access to the above described property to maintain said sanitary sewer services and other utili ties. Section 2 This ordinance shall be in full force and effect from and after thirty (30) days after its adop tion.
