HomeMy WebLinkAboutOrdinance 72- 916, Uniform Building Code, repeals Ord. 868. 228 ORDINANCE NO. 916 AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA, REGULATING THE ERECTION, CONSTRUCTION, ENLARGEMENT, ALTERATION, REPAIR, MOVING, REMOVAL, DE- MOLITION, CONVERSION, OCCUPANCY, EQUIPMENT, USE, HEIGHT, AREA, AND MAINTENANCE OF ALL BUILDINGS AND/OR STRUCTURES IN THE CITY OF BOZEMAN, MONTANA: PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREFORE; PROVIDING PENALTIES FOR THE VIOLATION THEREOF; RE- PEALING ORDINANCE NO. 868 OF THE CITY OF BOZEMAN AND ALL OTHER ORDI- NANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH. OOOOOOOOOOOOOOOOQOOOOO I BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AS FOLLOWS, TO-WIT: Section 1. That a certain document, three (3) copies of which are on file in the office of the Building Inspector of the City of Bozeman, being marked and designated as "Uniform Building Code, 1970 Edition, including Chapters 23, 38 & 49 in the appendix, published by the International Conference of Building Officials, "be and the same is hereby adopted as the build ing code of the City of Bozeman for regulating the erection, construction, enlargement, equipment, use, height, area and maintenance of all buildings and/or structures in the City of Bozeman; providing for issuance of permits and collection of fees therefore; providing penalties for violation of such code; and each and all of the regulations, provisions, penalties, conditions and terms of such "Uniform Building Code, 1970 Edition, including Chapters 23, 38 & 49 in the Appendix, published by the International Conference of Building Officials," on file in the office of the Building In- spector are hereby referred to, adopted, and made a part hereof as if fully set out in this Ordinance; save and except such portions thereof as have been deleted, modified or amended in the aforementioned official copies. Section 2. That Ordinance No. 868 of the City of Bozeman, Montana, and all other Ordinances or parts of Ordinances in conflict herewith are hereby repealed. Section 3. That wherever the words "Municipality" or "City" is used in the code hereby adopted, it shall be held to mean the City of Bozeman. Section 4. That the code hereby adopted is amended and changed in the following respects. Section 402 is amended as follows: Alley is any public space or thoroughfare less than twenty (20) feet but not less than ten (10) feet in width which has been dedicated or deeded to the public for public use. Apartment House is any building, or portion thereof, which is designed, built, rented, leased let or hired out to be occupied, or which is occupied as the home or residence of five or more fam- ilies living independently of each other and doing their own cooking in the said building, and shall include flats and apartments. Section 5. That this ordinance shall be in full force and effect from and after thirty (30) days after its adoption.
