I I I 203 ORDINANCE NO. 904 AN ORDINANCE AMENDING SECTION 1304.0l0 OF THE BOZEMAN MUNICIPAL CODE AND ADOPTING THE 1970 EDITION OF THE FIRE PREVENTION CODE RECOMMENDED BY THE AMERICAN INSURANCE ASSOCIATION; AMENDING SUBSECTION (f) OF SECTION 16.75 OF SAID CODE, MAKING THIS ORD- INANCE EFFECTIVE WITHIN THREE (3) MILES OF THE CITY LIMITS OF THE CITY OF BOZEMAN AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH. BE IT ORDAINED BY TIlE CITY COMMISSION OF TIlE CITY OF BOZEMAN, MONTANA, AS FOLLOWS, TO-WIT: Section 1. That Section l304.010 of the Bozeman Municipal Code, be, and the same is hereby amended to read as follows: l304.010 Adoption of fire prevention code. There is hereby adopted by the City Commission of the City of Bozeman for the purpose of prescribing regulations govern- ing conditions hazardous to life and property from fire or explosion, that certain code known as the Fire Prevention Code, recommended by the American Insurance Assoc- iation, being particularly the 1970 edition thereof and the whole thereof, of which code not less than three copies have been and now are filed in the office of the Clerk of the City Commission, and the same are hereby adopted and incorporated as fully as if set out at length herein, except as herein amended, and from the date of which this ordinance shall take effect, the provisions thereof shall be controll- ing within the limits of the City of Bozeman and within three miles of the City limits of the City of Bozeman, Montana. Section 2. That subsection (f) of Section 16.75 of said Fire Prevention Code shall be amended to read as follows: f. Special Type Dispensers. (1) Approved special dispensing deviees such as but not limited to, coin operat- ed, card operated, remote preset types or self-service pumps are permitted at service , stations whose only functions is the delivery of automotive products, provided there is at least one qualified attendant on duty while the station is open to the public. The attendant's primary function shall be to supervise, observe and control the dispensing of class I liquids while said liquids are being dispensed or by operating the "Dead Man" switch provided for in subsection 5, Section 16.75 (f), to prevent the dispensing of class I liquids into portable containers not in compliance with section 16.73 (e), control sources of ignition and to immediately handle accidental spills and fire extin- guishers as needed. (2) The attendant or supervisor on duty shall be capable of performing the funct- ions and assuming the responsibilities covered in section l6.75f (1). (3) Emergency controls shall be installed at a location acceptable to the Chief of the Bureau of Fire Prevention, but controls shall not be more than 100 feet from dis- pensers. (4) Instructions for the operation of dispensers shall be conspicuously posted. (5) Any approved special dispensing devise outlined in subparagraph (1) above, shall be equipped with a "Dead Man" type switch. Said switch shall be installed in the electrical power line between the dispensing unit and the main power source. Switches shall be of the button type, mounted in a vertical position, in a location as pre- scribed by the Fire Chief, and so designed that the attendant on duty shall have to apply constant manual pressure to said button to allow any dispensing unit to operate or be operated by the customer. Section 3. This Ordinance shall be effective and in force within the city limits of the City of Bozeman, Montana, and within three miles of the City limits of the City of Bozeman, Montana. Section 4. That all ordinances and parts of ordinances in conflict herewith are hereby repealed. Section 5. This ordinance shall be in full force and effect from and after ORDINANCE NO. 904 204 thirty (30) days from its final adoption.
