ORDINANCE NO. 885
I
AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA, PROVIDING FOR THE
PROTECTION OF THE PUBLIC HEALTH AND SAFETY: REQUIRING A PERMIT
AND INSPECTION FOR THE INSTALLATION OR ALTERATION OF PLUMBING AND
DRAINAGE SYSTEMS: CREATING AN ADMINISTRATIVE OFFICE AND A BOARD
OF APPEALS: DEFINING CERTAIN TERMS: ESTABLISHING MINIMUM REGULA-
TIONS FOR THE INSTALLATION, ALTERATION OR REPAIR OF PLUMBING AND
DRAINAGE SYSTEMS AND THE INSPECTION THEREOF: PROVIDING PENALTIES
FOR ITS VIOLATION AND REPEALING ORDINANCES 678A AND 679 AND ALL
OTHER ORDINANCES OR PARTS THEREOF OF THE CITY OF BOZEMAN IN CON-
FLICT HEREWITH:
BE IT ORDAINED BY THE CITY OF BOZEMAN, MONTANA, AS FOLLOWS TO-WIT:
Section 1. ADOPTION. A certain document, three copies of which are on file in the
office of the building inspector of the City of Bozeman, Montana, being marked and design-
ated as "Uniform Plumbing Code, 1967 Edition, published by the International Association
of Plumbing and Mechanical Officials," is hereby adopted as the Plumbing Code of the City
of Bozeman for the regulation of plumbing and drainage systems in the City of Bozeman;
providing for issuance of permits and collection of fees therefor; providing penalties for
violation of such code; and each and all of the regulations, provisions, penalties, con-
ditions and terms of the "Uniform Plumbing Code, 1967 Edition, published by the Internat-
ional Association of Plumbing and Mechanical Officials," on file in the office of the
building inspector are hereby referred to, adopted, and made a part hereof as if fully
set out in this chapter; save and except such portions thereof as have been deleted,
modified or amended in the aforementioned official copies.
Section 2. MONTANA STATE PLUMBING CODE. Should any Chapter, section, or paragraph
of the Code hereby adopted be in conflict with the Montana State Plumbing Code, the rules,
regulations and requirements of the Montana State Plumbing Code shall prevail.
Section 3. MUNICIPALITY AND CITY DEFINED. Whenever the words "Municipality" or
"City" are used in the code hereby adopted, they shall mean the City of Bozeman.
Section 4. REPAIR DEFINED. Repair is the reconstruction or renewal of any part
of a n existing plumbing system for the purpose of its maintenance. The word "Repair"
or"Repairs" shall not apply to any change of construction

Section 5. SECTIONS O~ UNIFORM PLUMBING CODE DELETED. The following section of
the "Uniform Plumbing Code,"1967 Edition, published by the International Association of
Plumbing and Mechanical Officials, shall be deemed to be deleted and omitted from such
Code as adopted by this ordinance and such sections shall not constitute a part of the
official Plumbing Code of the City of Bozeman: Section 2.3 to 2.11 inclusive 1111 through
1118, and tables 11-1 through 11-3, all tables and examples in iliapter 12, Chapter 13,
and appendix F & G.
Where any of the above-numbered sections are carried by identical numbers in both
the body of said Uniform Plumbing Code and in the appendixes thereto, both such ident-
ically numbered section shall be deleted and omitted and neither shall constitute a part
of this code.
Section 6. SECTIONS OF UNIFORM PLUMBING CODE AMENDED. The following numbered
sections of the Uniform Plumbing Code, in this Chapter by reference adopted, are amend-
ed to read as hereinafter set forth and as so amended shall supersede that section so
numbered in the said Uniform Plumbing Code, and shall be a part of the official Plumbing
Code of the City of Bozeman.
Section 7. RIGHT OF ENTRY - AMENDMENT OF SECTION 1.5. The Administrative Authority
and assistants shall carry proper credentials of their respective office, upon exhibit-
ion of which they shall have the right of entry, during usual business hours, to inspect
any and all buildings or premises in the performance of their duties. However, should
the owner or occupant disapprove entry the inspector shall, before entry, produce a
search warrant signed by the proper authority.
Section 8. ALL WORK TO BE INSPECTED. All plumbing and drainage systems shall be
inspected by the Administrative Authority to insure compliance with all the require-
ments of this code.

(a) It shall be unlawful for any person to conduct. carryon or engage in the
business of plumbi.ng or act in the capacity of a plumbing contractor, without first having had
issued to him a valid Master Plumbers License by the Montana State Plumbing Board.
(b) It shall be unlawful for any person to labor at the trade of plumbing in the
capacity of a journeyman plumber without first having had issued to him a valid Journeyman
Plumber's License by the Montana State Plumbing Board.
Section 10. GENERAL REGULATIONS - AMENDMENT OF SECTION 323.
In order to review the decisions of the Administrative Authority, in cases of
disagreement, and to provide for reasonable interpretations of the provisions of this Code.
there shall be and is hereby created a Board of Appeals. consisting of five members. The
Board of , Appeals shall be appointed by the Mayor and subject to confirmation of the City
Commission.
The Board of Appeals shall be appointed to hold office for a period of three (3)
years and until his successor is appointed and qualified. Any vacancy shall be filled by
appointment by the Mayor subject to confirmation by the City Commission, and shall be for
the unexpired term of the retired member. All of the members of said board shall serve
without compensation. and they shall not be subject to removal by either the Mayor or the
City Commission without cause. The members of said board may be removed for cause by the
Mayor upon written charges and after public hearing.
The Board shall adopt reasonable rule and regulations for conducting its in-
vestigations and shall render all decisions and findings in writing to the administrative
Authority with a duplicate copy to the appellant and may recommend to the City Commission
such new legislation as is consistent therewith.

Section 11. MATERIAL FOR GAS PIPING - AMENDMENT OF SECTION 1212
(a) All pipe used for the installation, extension. alteration, or repair of any
gas piping shall be standard weight wrought iron or steel (galvanized or black) pipe.
Exception: Approved flexible or semi-rigid tubing may be used to connect
recessed or built-in type vented appliances. Moveable appliances such as
unvented ranges. and refrigerators and vented dryers may be connected with
approved flexible connectors. An approved accessable appliance gas cock
shall be installed ahead of the flexible connector or tubing. Where flex-
ible or semi-rigid tubing is used to connect an appliance. it shall be of
minimum practical length but not to exceed three (3) feet. and shall not pass
through any floor. wall, partition or ceiling. Approved flexible connector
shall mean: listed appliance connectors complying with U.S.A.S.l. specifi-
cations. Approved semi-rigid tubing shall mean: aluminum or tin-lined copper
tubing.
(b) All such pipe shall be either new, or shall previously have been used for no
other purpose than conveying gas; it shall be in good condition and free from internal
obstruction. Barred ends shall be reamed to the full bore of the pipe.
(c) All fittings shall conform to the piping used, and in no case shall copper
or brass be used except as listed above.
(d) All valves and appurtenances used in connection with the above piping shall
be of a type designed and approved for use with fuel gas.
Gas piping shall be of such size and so installed as to provide a supply of gas
sufficient to meet the maximum demand without undue loss of pressure between the meter and
the appliance or appliances.
All gas piping shall be sized in accordance with the latest recommendations of
the Montana Power Company including the tables for house piping, flexible connectors,
mobile home piping systems. Said recommendations shall apply as though set forth herein
in its entirety.
Section 13. ADDITION TO THE UNIFORM PLUMBING CODE.
The following numbered sections shall be added to the Uniform Plumbing Code
in this chapter by reference adopted and shall be a part of the official
plumbing Code of the City of Bozeman.
Section 14. ADD SECTION 2.3 MASTER PLUMBER BOND.

Every Master Plumber doing plumbing work in the City of Bozeman shall give bond to said
City in the penal sum of Five Thousand ($5,000.00), with a surety company as surety thereon,
acceptable to and approved by the City Commission of the City of Bozeman, conditioned to the
effect that such Master Plumber shall perform all work in connection with the installation,
extension, additions, alterations and/or repairs of any plumbing work done by such Master
Plumber in a skillful and workmanlike manner and in compliance with the provisions of this
chapter and shall use in such work only suitable and approved materials and shall comply with
all of the provisions of this chapter and any other code of the City of Bozeman now in effect
or hereafter adopted; and providing, further, that any person. firm, corporation, or assoc-
iation injured or damaged by reason of any plumbing work done, or being done. by such Master
plumber within the City of Bozeman shall have a right of action in his or its own name upon such
bond.
Any person, firm, corporation, or association doing business as a Master Plumber as
herein defined without first having given the board as herein required shall be deemed guilty
of a violation as described elsewhere in this code.
Any person, firm. corporation, or association doing business as a Master Plumber whose
bond is not adequate, as herein, required shall comply with this chapter within three (3)
months of date of this code.
Section 15. ADD SECTION 324 CONNECTIONS TO SEWER AND WATER MAINS.
The City of Bozeman shall make all service connections (doing all necessary work a~d
furnishing necessary material) from the sewer and water mains to the property line; charges for
such work shall be paid by the property owner or his agent and accompany the application
for service connection. The charges for such connections shall be fixed by the City Comm-
ission from time to time.
Water services, from property line to and including the water meter. shall be installed
by the City Water Department upon proper application by the owner or his agent and receipt of
a deposit based upon the estimated cost; provided, that any excess over the actual cost shall
be refunded to the applicant upon completion of the work.

Section 16. This ordinance shall become effective thirty (30) days after its passage
and approval.
