ORDINANCE NO. 878
AN ORDINANCE ESTABLISHING THE RATE OF INTEREST TO BE PAID ON
REGISTERED HARRANTS OF THE CITY OF BOZEMAN, MONTANA AND DE-
CLARING THE EFFECTIVE DATE OF ENACTMENT.

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA:
Section l. That warrants issued by the City of Bozeman, Montana, and not paid for
want of funds shall bear interest at the rate of 4 1/4% from the time of registration
until such warrant is called for payment.
Section 2. This ordinance shall be in full force and effect from and after thirty
(30) days after its adoption.
Passed and adopted at a regular session of the Commission of the City of Bozeman held
on the 5th day of March, 1969.

AN ORDINANCE AMENDING SECTIONS 9.12.040 AND 9.12.050 OF
THE BOZEMAN MUNICIPAL CODE RELATING TO THE ENCUMBRANCE OR
OBSTRUCTION OF STREETS AND THE REMOVAL OF OBSTRUCTIONS AND
LITTER, INCLUDING ACCUMULATED ICE AND SNOW, FROM THE CITY
STREETS OF THE CITY OF BOZEMAN AND REPEALING ALL ORDINAN-
CES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH.

ORDINANCE NO. 879
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA:
Section 1. That Section 9.12.040 of the Bozeman Municipal Code be, and the same
hereby is, amended to read as follows:
No person, association, company or corporation shall encumber or obstruct,
or cause to be encumbered 9rObstructed any street, avenue, alley or other public
place in said city by placing therein or thereon any building materials, trash,
garbage, rubbish, debris, accumulated snow and ice removed from an adjoining
private premises, or any article or thing whatsoever, without first having ob-
tained permission in writing from the Director of Public Service of the City
of Bozeman.
Section 2. That Section 9.12.050 of the Bozeman Municipal Code be, and the same
hereby is amended to read as follows:
The Director of Public Service of the City of Bozeman is hereby author-
ized to order any article or thing whatsoever, including but not limited to

accumulated snow and ice removed from an adjoining private premises, which
encumbers, litters or obstructs any street, avenue, alley or other public
place within said city, to be removed. If such removal shall not be made
within six hours after notice to the owner or person in charge thereof to
remove the same, or if the owner can not be readily found for the purpose
of such notice, said Director of Public Service shall cause the same to be
removed to some suitable place to be designated by said Director, at the
expense of the person, corporation or association responsible therefor, and
under the pains and penalties as hereinafter provided for violations of this
chapter.
Section 3. All ordinances and parts of ordinances in conflict herewith are hereby
expressly repealed.
This ordinance shall be in full force and effect from and after thirty days after
its adoption.

AN ORDINANCE AUTHORIZING TIlE TAKING OF THE REAL PROPERTY OF ROY T.
WALTON AND JESSIE A WALTON, HUSBAND AND WIFE, AND KEITH R. BEYL AND
DOROTHY BEYL, HUSBAND AND WIFE, FOR THE PURPOSE OF ESTABLISHING,
CONSTRUCTING AND MAINTAINING A SEWER DITCH OVER AND ACROSS THE REAL
PROPERTIES OWNED BY SAID PERSONS AND HEREINAFTER DESCRIBED.

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA:

Section 1. That it is hereby determi.ned and declared that the taking of the hereinafter
described real property is necessary for the purpose of establishing. constructing and maintaining
a sewer line over and across and along the centerline of the property hereinafter described.
Section 2. That the City of Bozeman be, and hereby is, authorized to commence and prosecute
proceedings to condemn a right-of-way for sewer line over and across and along the centerline of
the hereinafter described real property owned respectively by Roy T. Walton and Jessie A. Walton,
husband and wife, and Keith R. Beyl and Dorothy Beyl, husband and wife, to-wit:
Roy T. Walton and Jessie A. Walton
A sanitary sewer easement lying within a tract of land located in the
Southwest one-quar~er of Section 1, Township 2 South, Range 5 East,
M.P.M., and more particularly described as an easement thirty (30) feet
in width, fifteen (15) feet on either side of the following described
centerline:
Beginning at the West one-quarter corner of said Section 1; thence
South 89011' East along the north line of the Southwest Quarter of
said Section 1 a distance of 1229.23 feet to the north-east corner
of the Stevens Subdivision and also the northwest corner of the Walton
property; thence South 1058' East along the easterly line of the
Stevens Subdivision being the westerly line of the Walton property
a distance of fifteen (15) feet to the true point of beginning; thence
South 89011' East, parallel to and fifteen (15) feet distant southerly
from the north line of the said southwest quarter. a distance of 655.5
feet more or less to a point on the east line of the Walton property
being the West line of the Gallatin County Rest Home Addition, to-
gether with a temporary right to enter and occupy during construction
and installation of the sanitary sewer an additional thirty (30) feet
of wid th southerly of an'~ adjacent to the above described easement.

A sanitary sewer easement lying within a tract of land located in the
Southwest Quarter of Section 31, Township 1 South, Range FJ East, M.P.M.
and more particularly described as a thirty (30) foot wi.de easement
fifteen (15) feet on either side of the following described centerline:
Beginning at a point on the Northeasterly right of Way line of the
Northern Pacific Railway Company's right-of-way, 285.3 feet more or
less East of the West line of said Section 31, and 850 feet north of
the sou th line of said Sec tion 31; thence Eas terly 850 feet North of
and parallel to the south line of said Section 31 a distance of 1194
feet more or less to a point of terminus on the East line of Beyl Tract
as recorded in Book 142 of Deeds of Gallatin County, page 39; to-
gether with a temporary right to enter and occupy during construction
and installation of a sanitary sewer, an additional 30 feet of width,
fifteen feet on either side of and adjacent to the above describe
easemen t.
This ordinance shall become effective from and after thirty (30) days after its adoption.
PASSED AND ADOPTED at a regular session of the Commission of the City of Bozeman held on the
21st day of May, 1909.
