'~/Io~.!!.~IO. ~.. ~ltM"" ND,...s'.(A.....,...::>..I: I BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AS FOLLOWS, TO-WIT: Section 1. That Section 5.16.010 of the Bozeman Municipal Code be and the same hereby is amended to read as follows: 5.16.010 Definitions. As used in this chapter, unless the context otherwise indicates, the following terms shall have the meaning ascribed to each: OWNER; Any person owning, keeping or harboring a dog or other animal. AT LARGE: Off the premises of the owner or keeper of said animal and not under leash control of a competent person. ANIMAL SHELTER: Any p~emises provided by the city and maintained by the Pound- master for impounding and caring for dogs and other animals. POUNDMASTER: All duly appointed and qualified deputies, as well as the duly appointed and qualified City Poundmaster. KENNEL: An establishment or place where three or more dogs are kept, whether for breeding or otherwise. (Ordinance 822 ~ 1; April 27, 1960). Section 2. That Section 5.16.050 of the Bozeman Municipal Code be and the same hereby is amended to read as follows: 5.16.050 Animals at Large. The owner or keeper of any animal within the city limits of the City of Bozeman, Montana shall at all times prohibit and prevent said animal from being at large. Section 3. That Section 5.16.100 of the Bozeman Municipal Code be and the same hereby is amended to read as follows: 5.16.100 Notice of Impounding Presumed--Redemption. It is hereby declared the duty of every owner of any dog or other animal to know its whereabouts at all times. In the event that any dog or other animal is impounded, the owner shall redeem the same within ninety-six hours, without any formal notice, or it shall be subject to disposal by the poundmaster as hereinafter provided. The owner of any impounded dog or other animal may redeem the same within such period of time by paying an impounding fee of ten dollars, plus two dollars for its keeping for ea~h twenty-four hour period, or part thereof, that it is impounded. Any unlicensed dog that is impounded may only be redeemed by the owner procuring a licens~ in addition to paying the fees herein prescribed. The Poundmaster may file a complaint in Police Court against the person redeeming any dog or other animal impounded for violation of any provision of this chapter. (Ord. 822 ~ 10; April 27, 1960). Section 4. All ordinances and parts of ordinances in conflict herewith arc hereby repealed. Section 5. This ordinance shall be and hereby is declared to be in full force and effect from and after thirty (30) days of its passage and approval.
