ORDINANCE NO. 851
AN ORDINANCE OF THE CITY OF BOZEMAN VACATING THE NORTrlliRLY FIFTEEN
FEET AND SOUTHERLY FIFTEEN FEET OF WEST KOCH STREET BETWEEN NINETEENTH
AVENUE SOUTH AND TWENTIETH AVENUE SOUTH IN THE CITY OF BOZEMAN, MONTANA
WHEREAS, certain property owners owning property abutting upon West Koch St-reet I
between Nineteenth Avenue South and Twentieth Avenue South have presented to the City
Conunission a petition asking the City Commission to institute the necessary proceedings to
VA.cate a portion of ~'V'est Koch Street between Nineteenth Avenue South and Twentieth Avenue
South; and
1VHEREAS, t-he City Commission on the 14th day of July, 1965, at its regular meeting,
passed and adopt-ed Commission Resolution No. 1212 declaring it to be the intention of the
City Commission of the City of Bozeman, Montana., to vacate the northerly fifteen feet and
southerly fifteen feet of West Koch Street between Nineteenth Avenue South and Twentieth
Avenue South in the City of Bozeman, Montana, and directing the City Manager to cause notice
of the adoption of the Resolution to be served in the manner that service of Sununons is
required on all persons whose property abutts on that portion of West Koch Street between
Nineteenth Avenue South and T\f.rentieth Avenue South which Hill be affected by the proposed
vacation, and by publication once in il daily newspaper in general circulation in the City
of Bozeman, Montana as provided by law; and
WHEREAS, pursuant to said Resolution, notice of the adoption of said Resolution was
published in the Bozeman Daily Chronicle at least once, to-wit, on the 22nd day of June I
1965, as appears from the Affidavit of Publication of the publisher of said Bozeman Daily
Chronicle, which is on file with the Clerk of the City Commission of the Cit~y of Bozeman;
and
WHEREAS, said notice of the adoption of the said Resolution has been served in the
manner of the service of Sununons in civil actions upon the persons whose property abutts
upon that portion of Itlest Koch Street between Nineteenth Avenue South and Twentieth Avenue
South affect,ed by the proposed vacation, which said notice designated July 14, 1965, a.t l:QO
o'clock p..m. at the Commission Room in the Cit;y Hall Building in the City of Bozeman as the
time and place for hearing objections; and
WHEIlli:AS, on the 14th day of July, 1965, at its regular meeting the City Commission
fully heard objections to and the evidence in support of said vacation; and
NOW, THEREFORE, be it ordained by the Commission of the City of Bozeman;
Section 1
That the northerly fifteen feet and Southerly fifteen feet of 'dest Koch Street between
Nineteenth Avenue SouLh and Twentieth Avenue South in the City of Bozeman, Montana, be, and
the same hereby a.re vacated and discontinued. I
Section 2
This ordinance shall be in full force and effect from and after thirty (0) days
after its adoption.
PHOVISIONALLY PASSED AND AOOPTED Rt the regular meeting of the City Commission of the
City of Bozeman held this l4th day of July, 1965.
