HomeMy WebLinkAboutOrdinance 61- 831, Ratifying resolution of Sunset Hills Cemetery Board 39 ORDINANCE NO. ~ AN ORDINANCE RATIFYING, CONFIRMING, A~PROVING AND ADOPTING A RESOLUTION OF SUNSET HILLS (BOZEMAN) CEMETERY BOARD DESIGNATING A CERTAIN AREA FOR THE HOLDING OF PUBLIC MEMORIAL SERVICES WITHIN THE CEMETERY AND ALSO FOR SETTING ASIDE CERTAIN LOTS I AND BLOCKS FOR THE BURIAL OF VETERANS OF WARS OF THE UNITED STATES AND MEMBERS OF THEIR IMMEDIATE FAMILY, AT THE REQUEST OF GALLATIN POST NO. 14, AMERICAN LEGION, VETERANS OF FOREIGN WARS AND DIS- ABLED AMERICAN VETERANS BE IT ORDAINED BY THE COMMISSION OF THE CITY OF BOZEMAN: Section 1 WHEREAS, the Board of Trustees of Sunset Hills Cemetery of the City of Bozeman has adopted and submitted for the approval and ratification of the City Commission of the City of Bozeman, the following Resolution, to-wi t: "WHEREAS: The Sunset Hilla (Bozeman) Cemetery is owned and controlled by the City of Bozeman, and operated and managed by a Board of Trustees, subject to the authority of the Commission of the City of Bozeman, Montana; And Gallatin Post No. 14 of the American Legion, The Veterans of Foreign Wars, and Disabled American Veterans desire and have requested the Board of Trustees to designate a certain area for the holding of public memorial services within the ceme tery; And the area convenient and suitable for that purpose is the smail park within Sunset Hills Cemetery bounded on the North by Prospect Road, on the South by Fair- view Road, on the East by Blocks numbered 15 and 22, and on' the West by Blocks I numbered 16 and 21; And the veterans organizations desire and request that the Board of Trustees set aside a certain portion of the cemetery for the buriai of veterans of all wars of the United States and of veterans of ailied nations in times of war and members of the immediate family of such veterans; And heretofore there have been set aside for such burial purposes Lots 1 to 190 of Block 35, Lots 1 to 180 of Block 138 and Lots 1 to 180 of Block 147 in Sunset Hiils (Bozeman) Cemetery, which is designated and known as the "Veterans Memorial"; The Board of Trustees of Sunset Hills (Bozeman) Cemetery, is ready and willing to accord to the American ~egion, Veterans of Foreign Wars and Disabled American Veterans, the rights and privileges requested; "BE IS RESOLVED: That the Board of Trustees of Sunset Hills (Bozeman) Cemetery does hereby designate that certain park area for the holding of public memorial services within the cemetery which is bounded on the North by Prospect Road, on the South by Fair- view Road, on the East by Blocks numbered 15 and 22, and on the West by Blocks mlmbered 16 and 21; And that the Board of Trustees does hereby identify and set aside the Lots 1 to 190 in Block 35, the Lots 1 to 18U in Block 138 and the Lots 1 to 180 6f Block 147 of Sunset Hills (Bozeman) Cemetery, in Bozeman, Gallatin County, Montana, for the exclusive interment of veterans of all wars of the United States and of veterans of nations ailied with the United States in times of war and of members of the immediate family of such veterans, the same to be known and designated as the "Ve terans Memoria 1" ; Upon the condition however, that the said park area and the buriai lots shall I be subject to the rules, regulations, conditions and restrictions in force at this time, or which may be made by the Cemetery Board hereafter; It is required the t perpetual care shail be provided for all graves of persons buried therein, the lots and perpetual care to cost that amount which may be in effect at the time such lots are applied for; the remains of persons eligible to be buried in the Veterans Memo_rial section may be moved thereto, prOVided there be no expense to the cemetery board; Applications for buriai and removal permits shall be made to the proper officer of the cemetery board direct; 40 The persons intended to be buried in the "Veterans Memorial" are veterans of all wars of the United states, veterans of nations allied with the United States in times of war, his wife or her husband, and children including step-Children and children by adoption, and in the determination of eligibility for burial therein the cemetery board shall exercise good judgment, and a sound discretion, and the decision of the board shall be final; and the American Legion, Veterans of Foreign Wars and Disabled American Veterans, represented by its commanding officer, or I some person desigsated by him, shall assume the responsibility of assisting the cemeterj1 board in determining what persons may be entitled to burial therein; and there shall be no residence requirements; The above named veterans organizations shall be permitted to move and erect a flag pole, place cannon, or other suitable monuments of a military character with- in the "Park Area"', prOVided the same shall not be in conflict with the general plan of the ceme tery; The rules and regulations as regards headstones, markers and monuments shall be as adopted by the cemetery board; AND BE IT FURTHER RESOLVED: That this resolution be submitted to the Commission of the City of Bozeman, Montana, for their approval and ratification.
