AN ORDINANCE ADOPTING THE CODIFICATION OF ALL ORDINANCES
OF A GENEf:AL OR PUBLIC NATURE OR IMPOSING A FIN}.:, PENALTY
OR FORIj'EITURE, AS THE OFFICIAL CODE OF THE CITY OF BOZE-
MAN; PROVIDING FOR THE TITLE AND CITATION OF THE CODE;
AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES
IN CONFLICT

WHEREAS the City Comission has authorized the codification of all ordinances
of a general or public nature or imposing a fine, penalty or forfeiture, and
WHEREAS such codification nas now been completed;
NOW, TlrEPEFORE, BE IT ORDAINED by the Ci ty Commission of the Ci ty of Bozeman:
Section 1
Adoption of Code
The codification of all ordinances of a general or plblic nature or imposing
a fine, penalty or forfeiture, entitled the "Bozeman Municipal Code" and consist-
ing of seventeen (17) titles, with chapters and sections thereunder, be, and it
hereby is, adopted as the official code of the City of Bozeman.
Section 2
Title and Citation of Code
The codification hereby adopted shall be known as the "Bozeman Municipal Code"
and may be cited as such. The titles, chapters and sections as set forth in the
codification hereby adopted shall be, and they hereby are, declared to be the ti tIe s,
chapters and sections by which the provisions of the Bozeman Municipal Code may be
designated and cited.
I Section 3
Purpose of Catch Lines
The catch lines appearing in connection with the ti tIes, chapters and sections
of the Bozeman Municipal Code are inserted as a matter of convenience, and they
shall be wholly disregarded by any person, officer, court or other tribunal in con-
struing the terms and provisions of the Bozeman Municipal Code.
Section 4
Continuation of Ordinances
The provisions of the Bozeman Municipal Code, insofar as they are substantially
the same as ordinances heretofore adopted by the City of Bozeman, shall be construed
as continuations thereof and not as new enactments.
Section 5
Reference Applies to Amendments
Whenever a reference is made to any portion of the Bozeman Ffunicipal Code,
or to any ordinances of the City of Bozeman, such reference shall apply to all
amendments and additions now or hereafter made.
Section 6
General Penalty
Unless otherwise specifically provided in the Bozeman Municipal Code, any per-
son, form or corporation, their agents or servants, who shall violate any of the
provisions of the Bozeman Municipal Code shall be deemed guilty of a misdemeanor,
and, upon conviction thereof, shall be puni.shed by a fine in any sum not exceeding
I Three Hundred Dollars ($30U.00) or by imprisonment for a period not exceeding nine-
ty (9 u ) da Y8 , or by both such fine and imprisOnment.

Savings Clause
Nothing contained in this ordinance or in the Bozeman Municipal Code adopted
herein shall be construed as abating any action now pending under or by virtue of
any general ordinance of the City of Bozeman herein repealed; or as discontinuing,
abating, modifying or altering any penalty accrued or to accrue, or as affecting the

liability of any person, firm or corporation, or as waiving any right of the city
under any ordinance or provision thereof in force at the time of passage of this
ordinance.
Section 8
Severability
Each ti tIe, chapter, section, and subdivision of a section of the Bozeman
Municipal Code hereby adopted, is declared to be independent of every other title,
chapter, section or subdivision of a section, and the invalidity of any title, I
chapter, section or subdivision of a section of the Bozeman Municipal Code, herein
adopted, shall not invalidate any other title, chapter, section or subdivision of
a section thereof.
Section 9
Repeal
All ordinances or parts of ordinances in conflict with the Bozeman Municipal
Code including, but not limited to, Ordinances 144, 153, Sections 1 through 7 of
182, 186 as amended by 392, l8?, 192, Sections 4 through 7 of 229, 285, 289, 308,
Section 1 of 391 A, 396, 414, 422, 433, 453, 482, 523, 533, 544, 609, 634, Section
6 of 635, and 717, are hereby repealed.
Passed and adopted by the Commission of the City of Bozeman this 7th day of
December A. D. 196U.
