J,v AN ORDINANCE m:GULATING THE ERECTION, CONSTRUCTION, ENLARGE- MENT, ALTERATION, REPAIR, MOVING, REMOVAL, CONVERSION, DEMOLIM TION, OCCUPANCY, EQUIFMENT, USE, HEIGHT, AREA, AND ~~INTENANCE OF BUILDINGS OR STRUCTURES IN THE CITY OF BOZEMAN, MONTANA; PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREFOR, DECLARING AND ESTABLISHING FIRE DISTRICTS; PROVIDING PENALTIES FOR Th~ VIOLATION THEREOF, AND REPEALING ORDINANCE I NO. 784 AND ALL OTHER ORDINANCES AND ~ARTS OF ORDINANCES IN CONFLICT THEREWITH BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA: Section 1. Adoption of Uniform Building Code There is hereby adopted by the City Commission for the purpose of regulating the erection, construction, enlargement, alteration, repair, moving, removal, con- version, demolition, occupancy, equipment, use, height, area, and maintenance of buiLdings or structures in the City of Bozeman, Montana, that certain code known as the Uniform Duilding Code, 1958 Edition adopted and copyrighted by the Pacific Coast Building Officials Conference, save and except such portions thereof as have been deleted, modified or amended in the official copies thereof which are on rec- ord in the office of the Building Inspector of the City of Bozeman, and the same is hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this ordinance shall take effect, the provis ions thereof shall be controlling within the limits of the City of Bozeman. Sec tion 2. Enforcemen t The code hereby adopted shall be enforced by the Building Inspector of the City of Bozeman. Section 3. Definition Wherever the word ltMunicipali tylt is used in the code hereby adopted, it shall be held to mean the City of Bozeman. Sec tion 4. Amendments made in the Code hereby Adopted I The code hereby adopted is amended and changed in the following respects: Section 205 is amended as follows: Sec. 205. It shalL be unlawful for any person, firm or corporation to erec t, construct, enlarge, alter, repair, move, improve, remove,.conM vert or demolish, equip, use, occupy, or maintain any building or strucM ture in the City, or cause the same to be done, contrary to or in viol~ ation of any of the provisions of this Code. Any person, firm, association or corporation violating any provision of this Code shalL, upon conviction thereof, be fin~d in any sum not exceeding $3UO.00, or by imprisonment in the City or .ounty . Jail for a period not exceeding 90 days, or by both such fine and imprisonment, and each and every day such violation is permitt~d or committed shall be deemed a separate offense and punishable as such. As to firms, associations or corporations the person in charge and control of the work, installation or building shall be deemed the quilty party, frima facie; but otherwise proceedings against association and corporations for violation of this Code shall be as prescribed in Sec- tions 94~96Ul to 94-9610, inclusive, Revised Codes of Montana, 1947. Section 402 is amended as follows: Se c. 402. ALLEY is any public space or thoroughfare less than twenty fee t ( 20 ') bu t not 1 e s s than ten feet (lU') in width which has been dedicated or deeded to the ~lblic for public use. APART1VIENT HOUSE is any building, or portion thereof, which is designed, buil t, rented, leased, let or hired out to be occupied, I or which is occupies as the home or residence of five or more families living independently of each other and doing their own cooking in the said building, and shall include flats and apartments. Bat or blanket type of insulation, if not wholly of mineral composition, sha.ll be covered on both sides wi th a tough water proof cover. Section 3206 is amended as fo.llows: Sec. 3206. 1he water from the roof of all buildings which would flow by gravity over a public sidewalk shall be carried by means of con- ductors under the sidewalk and through the curb into the gutter, except when a storm sewer is adjacent to the property on which the bui.lding is loca ted, in which case drainage will be carried directly into the storm sewer system. Overflows shall ~e insta.lled at each .low point of the roof to which the water drains. uoncealed roof drainage pipe sha.ll be installed as required for soi.l, waste, or vent piping. EXEPTION: Buildings of lJroup I or J occupancies, the wall.s of which are ten feet ( 10' ) or more from the street property line, need not comply with the above. Section 3714 is amended as follows: Sec. 3714. In the event the provisions of this chapter shall conflict with the provisions of the City of Bozeman Ordinance No. 678-A or the ~lles and regulations of th~ Montana Power Company, the provsions of the said Ordinance No. 678-A and rules and regulations of The Montana Power Company ~hali prevail. Section 5114 is amended as follows: Sec. 5114. In the e~ent -that the provisions of this chapter shall I conflict with the provisions of the City of Bozeman Ordinance No. 678~A or the rules and regl11a tions of the Montana Power Vompany, the pro- vision of the said Ordinance No. 678-A and rules and regul.ations of The Montana Power Company shall prevail. Repeal of 60nflicting urdinances Ordinance No. 784 and all other ordinances or parts of ordinances in con- flict herewith are hereby repealed. Section 6. Date of Effect This ordinance shall be in full force and effect from and after thirty (30) days after its adoption.
