ORDINANCE :NO. 821

AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANa,
VACATING A PORTION OF .AN ALLEY IN BLOCK "C"
AND REPEAI.ING ORDINANCE NO. 808 OF SAID CITY
OF BOZEMAN
WHEREAS, all property owners owning property ahutting an alley in Block "C.', Original Town- I
site of the City of Bozeman, have presented to the City Commission a petition asking the City
Commission to institute the neoessary prooeedings to vacate a portion of an ex is till[; alley in
Block "C". Original Townsite of the City of Bozeman, hereinafter more particularly described;
WHEREAS, on the 16th day of March A. D. 1960, at its regular meeting, the said City Com~is-
sion passed and adopted Commission Resolution No. 971 declaring it to be the intention of the said
City of Bozeman to vacate a portion of an alley in Block "C" in said Original Townsite of the City
of Bozeman to give notice thereof in the manner and for the time as provided by law; and
vv.HEREAS, pursuant to said Resolution, notice of the adoption of said Resolution was published
in the Bozeman Dai ly Chronicle a,t least once before said Resolution was aoted upon, as appears by
the affidavit of the publisher of said Bozeman Daily Chronicle on file with the Clerk of the City
Commission and which said notice describes the portion of the alley in Block "C", Original Town-
site of the City of Bozeman. to be bacated and giving notice that the hearing on said Resolution
would be held at the regular meetint; of the City Commission to be held on the 30th day of March
A. D. 1960, at ItOO o'clock p.m. at the Commission Room in the City Hall Building of the City of
Bozeman; and
WHEREAS, on the 30th day of March A. D. 1960, at its regular meeting, the said City Commis-
sion fully heard objections to and evidenoe in support of said vacation; and
~A$,the City Manager having given notice of the adoption of said Resolution of-Intention
for the time and in the manner as by law provided, and the time for objections as set forth in said
notioe ha,ving expired andthe objections made being oonsidered insufficient~ and it appearing that
all provisions of the law in such cases made and provided had been fully met and complied with; and
WFEREAS, on March 30, 1960, the City Commission in reiular session assembled. did then and
there determine that such portion of the alley in Block"C should be vacated and sur;h determination
was entered upon the minutes of said meeting, and did then and there determine and decide that such
vacation of the portion of the alley in Block "C", Original Townsite of the City of Bozeman. Montana,
could be made without detriment to the public interest and should be made in the public interest. I
NOW, THEREFORE, BE IT ORDAINED BY TEE COMMISSION OF THE CITY OF BOZEMAN a
Section 1
That the followi.ng described portion of the alley in Block "C", Original 'l'ownsite of the City
of Bozeman, be, and the same is hereby, vaoated and discontinueda
That portion of the existing alley in Block "C", Original Townsite of
the City of Bozeman. more partioularly described as follows, to-wit:
Beginning at the Northwest corner of Lot 36 in Block "C" of the Original
Townsite of Boteman; thence East along the North Lot Lines of Lqts 36,
35. 34 and 33 a distance of 96.5 feet, to a point in the North Lot Line
of Lot 33, which point is 6.6 feet East of the Northwest Corner of said
Lot 33; thence South parallel to the West Lot Line of said Lot 33 a dis-
tance of 20 feet; thence West parallel to the North Lot Lines of Lots 33,
34. 35 and 36 a distance of 96.5 feet to the West l,ot Line of Lot 36; thence
North a distance of 20 feet to the point of beginning.
Seotion 2
This Ordinance shall be in full force and effect from and after thirty (30) days after its
adoption.
Section 3
Ordinance No. 808 and all other ordinances or parts of ordinances in conflict herewith are
hereby repealed.
Adopted at e. regular meeting of the City Commission of the City of Bozeman held this 30th day
of March A. D. 1960.
