Willson 10 ORDINANCE NO. 820 - AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA, VACATING A FORTION OF SOUTH WILLSON AVENUE IN THE CITY OF BOZEMAN. ~, oertain property owners owing lands abutting South Willson Avenue in the City of I Bozeman, Montana, have presented to the City Commission a petition asking the City Commission to institute the neoessary proceedings to vacate portions of South Wilson Avenue in the City of Bozeman, Montana. hereinafter more particularly described. and WHEREAS, on the 18th day of November, A.D. 1959, at its regular meeting, the said City Commis- sion passed and adopted Commission Resolution No. 966 declaring it to be the intention of the said City of Boz~man to vacate portions of South Willson Avenue in the City of Bozeman, Montana, and directing the City Manager of the City of Bozeman to give notioe thereof in the manner and for the time as provided by law. and WHEREAS, pursuant to said Resolution, notice of the adoption of said Resolution was given by personal service upon all persons who could be personally served in the State of Montana and upon all other persons by publication of a notice of the adoption of said Resolution in the Bozeman Daily Chronicle at least once before said Resolution was acted u~on, as appears by the Affidavit of the publisher of said Bozeman Daily Chronicle on file with the Clerk of the City Commission. and which said notices describe the portion of said South Willson Avenue to be vacated and give notioe that the hearing on said Resolution would be held at the regular meeting of the City Commission to be held on the 23rd day of December A.D. 1959, at laOO o'clock P.M. at the Commission Room in the City Hall Building of the City of Bozeman; and WHEJlF:AS , on the 23rd day of December A.D. 1959, at its regular meeting, the said City Commis- sion fully heard objections to and evidence in support of said vacaUon; and WEEREAS , the City Manager having given notice of the adoption of said Resolution of Intention for the time and in the manner as by law provided, and the time for objections as set forth in said notioe havine; expired and the objections made being considered insufficient, and it appearing that all provisions of the law in suoh cases made and provided had been fully met and oomplied with; and WHEREAS, on the 23rd day of December A. D. 1959, the City Commission in regular session assembled, did then and there determine that a portion of South Willson Avenue in the City of Bozeman, Montana. I should be vaoated, and such determination was entered upon the minutes of said meeting, and did then and there determine and decide that suoh vacation could be made with detriment to the public inter- est and should be made in the public interest. NOW, THEREFORE. BE IT ORDATI\ED BY THE COMMISSION OF THE CITY OF BOZEMANa Section 1 That the following described portion of South Willson Avenue in the City of Bozeman, Montana, be, and the same is hereby, vacated and discontinuedl A portion of South Willson Avp,nue lying between West Main Street and West Babcock Street, all being within the City of Bozeman, Montana, said portion being more particularly described as follows a Bp.ginning at the northwest corner of Block A, Story's Addition to the City of Bozemar, thence in a southerly direction along the west line of said Block A, a distanoe of 276.0 feet, more or less, to the southwest corner of said Blook A, Story's Addi-' tion; thence cont5nuing in a southerly direction along the west line of Lot II, Block AE, Alderson's Addition to Bozeman, Montana, a distance of 23 feet, more or less, to the southwest corner of said Lot II; thence in a westerly direction along the north line of West Baboock Street produced, a distance of 1.6 feet; thence in a northerly direction 1.6 feet west of and parallel to the west line of Lot II, Block AE, Alderson's Addition and Blook A, Story's Addition a distance of 161.0 feet, thence in a northeasterly direotion a distance of 142.0 feet, more or less, to the point of beginning, save and except a strip of land 1.6 feet in width and 16.0 feet in length lying west of and adjacent to that portion of Lot 12, Block A, Story's Addition, as deeded to the City of Bozeman for alley purposes. Section 2 This ordinance shall be in full force and effect from and after thirty (30) days after its I adopt:.on.
