HomeMy WebLinkAboutOrdinance 51- 766, Amends Section 8 of Ordinance 641 315' ORDINANCE NO. 766 AN ORDINANCE AMENDING SECTION 8 OF ORDINANCE NUMBER 641 OF THE CITY OF BOZEMAN (SECTION 319 REVISED ORDINANCES OF THE CI'ry OF BOZEMAN, 1941), THE SHORT TITLE OF WHICH ORDINANCE NUMBER 641 IS "AN ORDINANCE REGULA- TING 'rHE MANUFACTURE AND SALE OF BEER WITHIN THE Crry OF BOZEMAN", SO AS TO INCREASE 'rHE ANNUAL LICENSE FEES TO BE CHARGED LICENSED RETAILERS AND CLUBS SELLING BEER PURSUANT TO THE PROVISIONS OF SAID ORDINANCE AND THE MONTANA BEER ACT. -I BE IT ORDAINED BY THE COMMISSION OF THE CITY OF BOZEMAN, STATE OF MONTANA: li~:'r..:,,, Section l. That Section 8 of Ordinance Number 641 (Section 319 Revised Ordinances of the City of Bozeman, 1941) be, and the same is hereby amended to read as follows: Section 8 LICENSE FEES The license fees under this ordinance shall be as follows: Brewers, one hundred dollars ($100.00), annUl lly, Wholesalers, seventy-five dollars ($75.00), annually, Retailers, two hundred dollars ($200.00), annually, Clubs, thirty-five dollars ($35.00) , annually, payable with the application and subject to the half yearly rate as hereinbefore provided. Fees and fines collected under this ordinance shall be allocated to the Protection of Life and Property Fund" of the City of Bozeman, it being hereby recited that licenses imposed under the provisions of this ordinance are exclusively for the purpose of defray- ing the cost of necessary police regulation, inspection and control under the police power of the City of Bozeman, and not for revenue, and that any business licensed under I this ordinance requires and is subject to the general police regulations of the City of Bozeman for the safety, health, peace, quietness and good order of said city and the inhabitants thereof. All fees provided for in this ordinance are in addition to any and all other license fees required to be paid under any other ordinance of the City of Bozeman. Section 2. All ordinances and parts of ordinances in conflict herewith are hereby repealed. Section 3. rrhis ordinance shall be in full force and effect on Juanuary 1, 1952. Adopted at a regular meeting of the City Commission of The City of Bozeman held this 7th day of November, 1951.
