MOU Eckroth1 Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: David Fine, Economic Development Specialist SUBJECT: Authorize the City Manager to sign Memorandum of Understanding (MOU) between and among Eckroth Plaza Montana, LLC and the City of Bozeman for the Bozeman Midtown Urban Renewal District’s Street Lighting and Sidewalk Project MEETING DATE: April 11, 2016 AGENDA ITEM TYPE: Consent RECOMMENDATION: Authorize the City Manager to sign Memorandum of Understanding (MOU) between and among Eckroth Plaza Montana, LLC and the City of Bozeman. BACKGROUND: The Bozeman Midtown Urban Renewal District (Midtown District) (formerly the North Seventh Urban Renewal District) is working on a project to enhance the safety and aesthetics of the North 7th Avenue corridor by installing setback sidewalks buffered by boulevard, and decorative luminaries. The existing right-of-way along the corridor will not accommodate a sidewalk setback, so the district has been acquiring public access and lighting easements from property owners on a voluntary basis for one dollar ($1.00) and for other valuable consideration. The district is obtaining easements for the 3rd and 4th phases of the project between Peach St. / Durston Rd. and Main St. The Midtown Board will seek additional funding for design and construction of these phases in its Fiscal Year 2017 work plan and budget. The property owner wanted written clarification of the project scope and responsibilities of the property owner and the City of Bozeman, respectively, related to the project. The MOU simply describes the project as it will proceed for the majority of property owners and does not offer any special consideration to this particular property owner. UNRESOLVED ISSUES: None at this time. ALTERNATIVES: As determined by the Commission. 135 2 FISCAL EFFECTS: The MOU does not create any unique fiscal effects beyond the cost of the project and the one dollar cost of the easement.
