HALF OF EAST CURTISS STREET FROM THE EAST LINE OF SOUTH McADOW AVENUE TO
THE CENTER ~INE OF SOUTH SWITZLER STREET; ALLEYS AS THE SAME EXIST IN
BLOCKS THIRTEEN (13), FOURTEEN (14), FIFTEEN (15) EIGHTEEN (18), NINETEEN
(19), AND TWENTY (20) OF NORTHERN PACIFIC ADDrrION TO BOZEMP,N, MONTANA.
WHEREAS, R. A. Williams has filed a petition with the City Commission of the City
of Bozeman asking for the vacation of the portions of streets and the alleys more par-
ticularly described in the title hereof; and
WHEREAS, on the 9th day of May, 1951, at its regular meeting the City Commission of
the City of Bozeman passed and adopted Commission Resolution No. 709, declaring it to be
the intention of the said City of Bozeman to vacate the portions of streets and the alleys
more particularly described in the title hereof, pursuant to said petition, and directing
the City Manager of the City of Bozeman to give notice thereof in the manner and for the
time as provided by law; and
WHEREAS, pursuant to sald petition notice of the filing thereof and of the adoption
of said Resolution was published in the Bozeman Daily Chronicle at least once before said
petition was acted upon, as appears by the affidavit of the publisher of said Bozeman
I Daily Chronicle on file with the Clerk of the City Commission and which said notice des-
ignated and described the portions of streets and the alleys asked to be vacated by said
petition, and giving notice that the hearing on said petition would be held at the regular
meeting of the City Commission to be held on the 2Jrd day of May, 1951, at 1:00 o'clock
P.M. at the Commission Room, in the City Hall Building of The City of Bozeman; and
WHEREAS, the City Manager having given notice of the filing of said petition and the
adoptionof said Resolution of intention for the time and in the manner as by law provided,
and the time for objections as set forth in said notice having expired and no objections
having been made, and it appearing that all provisions of the law in such cases made and
provided had been fully met and complied with; and
WHEREAS, at the time and place so designated by the City Commission in regular ses-
sion assembled, did then and there fully consider said petition and after such consideration
did decide that such petition should be granted and such determination was entered upon
the minutes of said meeting, and,did then and there determine and decide that such vaca-
tionof the portions of streets and the alleys more particularly described in the title
hereof could be made without detriment to the public interests and should be made in
I the pUblic interest;
NOW THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF BOZEMAN:
Section 1. That the following described portions of streets and the following des-
cribed alleys: South McAdow Avenue from the South line of Babcock Street to the NOrth
line of Curtiss Street; South Aylesworth Avenue from the South line of Bcbcock Street to
the North line of Curtiss Street; East Olive Street from the east line of Cypress Avenue
to the West line of Switzler Street; the West one-half of South Switzler Street from the
South line ~f Babcock Street to the North line of Curtiss Street; the South one-half of

East Babcock Street as it extends from an extension to the East line of Block Nineteen
(19) of Northern Pacific Addition to Bozeman, Montana, to the center of the intersection
of East Babcock street and South Switzler Street; the North one-half of East Curtiss
Street from the East line of South McAdow Avenue to the center line of South Switzler
Street; alleys as the same exist in Blocks Thirteen (13), Fourteen (14) Fifteen (15),
Eighteen (18), Nimteen (19), and Twenty (20) of Northern Pacific Addition to Bozeman, 1
Montana, be, and the same are hereby vacated and discontinued.
Section 2. This Ordinance shall be in full force and effect from and after thirty
days after its adoption.
Adopted at a regular meeting of the City Commiss ion ofTf-le City of Boz emen held this
