WHEREAS, The Board of Adjustment of The City of Bo.,.eman, pursua.nt to the provisions
of Ordinance No. 711 of The City of Bozeman, the short title of which is "The Zoning
Ordtnancett, has recommended to The City Commission of The City of Bozeman that certain
changes in and additions to the provi~ions of "The Zoning Ordinance" be made as are
hereinafter more particularly described; and
WHEREAS, The City Commission has duly considered such recommendation and after such
consideration has decided to adopt and give effect to the same.
NOW THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF BOZEMAN:
Section 1. That Section VI of Ordinance No. 711 be, and the same is hereby amended
so as to read as follows:
SECTION VI. -- Boundaries of Districts.
Boundaries of "An Residence District. \
The boundaries of "A" Residence District shall be as follows: Beginning at the
point of intersection of the south line of Olive street and the east line of
Fourth Avenue, thence easterly along the south line of Olive street to the west
'I line of Willson Avenue, thence southerly along the west line of Willson Avenue
100 feet, thence easterly along a line parallel to the south line of Olive Street
and distant 100 feet therefrom to a point in the west line of the alley between
Tracy Avenue and Black Avenue, thence southerly along the west line of said Alley
to the point of intersection of said west line of said alley with the south line
of _t>lckerson Street produced, thence westerly along the saidsouth line of
Dickerson Street produced, to the west line of Tracy Avenue, thence westerly along
the south line of Dickerson Street to the west line of the alley between Tracy
Avenue and Willson Avenue, thence southerly along said west line of said alley and
said line produced, to a point midway between College and Harrison Streets, thence
easterly along a line midway between said College and Harrison Streets to the east
line of Block 1 of the Butte Addition; thence south along the east line of said

Section 2. That Section VII of Ordinance No. 711, as amended by Ordinance 739 be,
and the same is hereby amended so as to read as follows:
I Section VII. -- Boundaries of "B" Residence District.

Part 1. Beginning at the point of intersection of the east line of Third Avenue
and the south line of Short Street, thence easterly along the said south line of
Short Street to its intersection with the east line of the alley between Willson
and Tracy Avenues, thence northerly along said east line of said alley to the south
line of Peach Street, thence easterly along said south line of Peach Street to the
west line of Black Avenue, thence southerly along said west line of Black Avenue
to its intersection with the north line of the alley between Lamme Street and Men-
denhall Street, thence westerly along said north line of said alley to a point 490
feet east of the east line of Seventh Avenue, north, thence north parallel with and
490 feet east of said east line of Seventh Avenue, north, to the north I im of

The Busi.ness District shall embrace two parts, described as follows:
Part I.--Main Business District No.1. Beginning at the point of intersection
of the east line of Third Avenue and the south line of the first alley north ~

56 ,feet west of the west line of Wallace Avenue, thence northerly along a line
parallel to and 56 feet distant from the west line of Wallace Avenue to the
south line of Lamme Street, thence easterly along the south line of Lamme Street
to the west line of Wallace Avenue, thence southerly along the west line of
Wallace Avenue to the north line of Babcock Street, thence westerly along the
north line of Babcock Street to the west line of Church Avenue, thence southelly
along the west line of Church Avenue to the north line of Olive Street, thence
westerly along the north line of Olive Street to the west line of Black Avenue,
thence southerly along the west line of Black Avenue to a point 100 feet south

south line of said West Alderson Street to the east line of South Eleventh Avenue;
thence south along the east line of South Eleventh Avenue to the north line of
West College Street; thence east along the north line of said West College Street
to the point of beginning.

Section 4. That Section XIII of Ordinance No. 711 be, and the same is hereby
amended so as to add Sub~ections 10 and 11 to Section XIII; Subsections 8 and 9 to sub-
section XIIIA, the present Subsection 8 thereof to become Subsection 10; Subsections
5 and 6 to Subsection XII!B, the present Subsection 5 to become Subsection 7; and so as
to add thereto a new Subsection XIII H -- Business District No. 2, the whole thereof
I to read as follows:
SECTION XIII. -- RESTRICTIONS WITHIN DISTRICTS. -- "A" RESIDENCE DIS'rRICT.
In the "A" Residence District except as herein after provided no building or struc-
ture shall be erected or materially altered nor shall any buildi.ng or premises be used,
except for one or more of the following uses:
1. Single Family Dwellings.
2. Multiple family dwellings, provided that the area for each family
shall be not less than the area required for single family residences
as hereinafter specified, but said area may be distributed between 2 floors.
3. Schools and colleges.
Lt · Boarding and Rooming Houses limited in size to five rooms in addition to
family quarters.
5. Parks, recreation bUildings, and Clubs not conducted as a business operated
for profit.
6. Private garages and other small accessory buildings for customary incidental
uses.
. 7. Vacant lots shall be used for gardening, tennis courts, playground and other
recreational facilities only and shall be kept free of all rubbish and/or
garbage at all times. Provided that other uses of vacant lots may be per-
mitted by written Buthority of the Director of Public Safety with the con-
I tinuing consent of the owners of 80% of the property within 300 feet of the
lot or lots.
8. Buildings shall be so placed that there shall be a front yard (entirely un-
occupied by any building or part thereof) having a depth of not less than
25 feet; a rear yard of not less than 20 feet, and a side yard (entirely
unoccupied by any building or part thereof) on each side of every building.
Such side yard shall have a depth of not less than 8 feet. Provided that the
side yard on the street side line of corner lots shall be not less than 15
feet in depth. (Provided further that one side yard of a one story garage
or other small accessory buildings may be reduced in depth to ~ feet.) In
no case shall such detached garage be located within the front, rear or side
yard, but on corner lots shall be not less than 25 feet from the front street
line and 15 feet from the side street line. In blocks where buildings have
already been erected having a front yard less than 25 feet the depth of the
front yard for any new building may be made equal to the depth of the front
yard of the nearest adjacent building. Provided that no front yard shall
have a depth of less than 15 feet and provided further that the front yard of
all buildings or corner lots shall be not less than 25 feet deep. The inten-
tion of these provisions as to side yards is that there shall be a distance
of not less than 16 feet separating main buildings on the lot "width dimen-
sion" as "Width Dimension" is defined in Section I of this Ordinance.
9. Each single family residence and~or other main building shall have a total
floor area, under roof', of not less than 1000 square feet, 20% of' which may
be on a second floor above ground. Each multiple family dwelling shall have
an area of not less than 1000 square feet for each family, which may be dis-
tributed on two floors above ground.
10. Each basement apartment shall have a total floor area of not less than one
thousand (1,000) square feet, and each such apartment shall have a minimum
I height from floor to ceiling of seven and one-half (7!) feet, a minimum of
three and one-half (3~) feet of which must be above ground level.
ll. No permanent dwelling shall be permitted in which the major portion of the
height from floor to ceiling is below ground level, unless there is con-
structed above the same a single family or multiple family dwelling as per-
mi tted by this section.
Subsection XIIIA. -- "B" RESIDENCE DISTRICT.
In the "Bn Residence District except as hereinafter provided no building or structure
shall be erected or materially altered, nor shall any building or premises be used except
for one or more of the following uses:

1. Any use permitted in "A" Residence District.
2. Apartment Houses, hospitals limited to three stories above ground.
3. Churches and other places used exclusively for religious worship.
4. Libraries and Museums.
5. Institutions of an Educational, Philanthropic, or Eleambsynary nature.
6. Buildings shall be placed to provide the same depths of front and side
yards as are required in "A" Residence Districts.
7. Each single family residence and/or other main building shall have an area. of
not less than seven hundred (700) square feet on the main floor. Each multi-
ple family dwelling or apartment shall have an area of not less than 700 square
feet for each family, which may be distributed on two floors above ground. I
8. Each basement apartment shall have a total floor area of not less than seven
hundred (700) square feet, and each such apartment shall have, a minimum height
from floor to ceiling of seven and one-half (7-1) feet, a minimum of three and
one-half feet (3!) of which must be above ground level. .
. ' NO permanent dwelling shall be permitted in which the major portion of the

10. The Director of Public Safety may in his discretion give written permission
to keep a family cow or poultry, for family use only, with the continuing con-
sent of the owners of 80% of the property within 300 feet of the lot or lots
upon which such cow or poultry is kept.
Subsection XIII B. -- "e" RESIDENCE DISTRICT
In the "e" Residence District, except as herein provided, no building or sturcture
shall be erected or materially altered nor shall any building or premises be used ex-
cept for one or more of the following uses:
1. Any use permitted in "An or "B" Residence Districts.
2. Apartment Houses or Hotels.
l: Club.;;, Hospitals.
Each single family dwelling or main building shall have a main floor area of
not less than 550 square feet above ground. Multiple family dwellings or
apartment houses shall ha.ve a floor area of not less than 1100 square feet,
which may be distributed between two floors above ground.
5. Each basement apartment shall have a total floor area of not le.ss than five hundred
. fifty (550) square feet, and each such apartment shall have a minimum height
from floor to ceiling of seven and one-half ni) feet, a minimum of three and
one-half (3!) feet of which must be above ground level. I
6. No permanent dwelling shall be permitted in which the major portion of the
height from floor to ceiling is below ground level, uriless there is constructed
above the same a single family or multiple family dwelling as permitted by this
section.
7. BuildinGS shall be so placed as to provide the same depths of front, s1 de and
rear yards as are required in "A" Residence District.
Subsection XIII C -- "D" RESIDENCE DISrfRICT.
In the "D" Residence District, except as hereinafter provided no building or sturc-
ture shall be erected or materially a1 tered, nor shall any auilding or permises be used
except for one or more of the following uses:
1. Any use permttted in "An, "Btt, or "C" Residence Districts.
2. Small work shops, horse barns, cow burns, dog kennels, rabbit pens, shell be
allowed in "D" Residence District only.
3. Vacant lots may be used for pasturing livestock.
4. Buildings shell be so placed that there shall be a front yard, entirely un-
occupied by a building or part thereof, having a depth of not less than 20
feet, a s ide yard on each s1 de of each buildinp; similarly unoccupied ha ving
a depth of not less than 8 feet and a rear yard of not less than 10 feet.
Provided, thBt the side yard on the street side of corner lots shall be not
less than 15 feet in depth. Provided further that one side yard of a one
story garage or other small accessory buildings may be reduced in depth to
5 feet. In any block where buildings have already been erected having a front
yard less than 20 feet, the depth of the front yard for any new building may
be made equal to the depth of the nearest adjacent building. Provtded that
no front yard shall have a depth of less than 15 feet and provided 'further
that the front yard on corner lots shall be not less than 20 feet deep. The I
intention of these provisions as to "side yards is that there shall be a dis-
tance of not less than 16 feet separating main buildings on the lot "widthtt
dimensions as "width" is defined in Section I of this Ordinance.
5. Buildings may be constructed of any size desired, provided thay are of .reason-
able design and are built in a workmanlike manner and do not create or tend to
create a hazard to life or property.
SubSection XIII D -- MAIN BUSINESS DISTRIC'f.
Except as herein provided, no building or structure shall be erected or materially
altered nor shall any building or premises be used except for one or more of the follow-
ing uses.

4. Bakeries, employing not more than 8 persons.
5. Banks.
6. Barber Shops.
7. Battery Service Stations.

II. Comfort Stations.
12 Conservatories.
13. Creameries, employing not more than 8 persons.
14. Dancing Academies.

52. Any business use similar to or connected with any use above particularly specified.
Any building primarily used for any of the above enumerated uses may have not more
than forty per cent of the floor area devoted to industry or storage purposes incidental
to such primary uses; provided that not more than five employees shall be engaged at any
ti~e on the premises in any such incidental use.
In the Main Business District buildings on Main Street, Mendenhall Street, the north
side of Babcock Street and on all avenues north of the north line of Babcock Street may
be built to the street line. On any other streets and avenues in the MaIn Business Dis-
trict buildings shall be so placed that there shall be a front yard of full lot width,
entirely unoccupied by any building or structure or part thereof, and having a depth of
not 1 ess than fifteen (15) feet from the front lot line.
In the construction of any building- in the Main Business District satisfactory
facilities must be provided for loading and unloading stocks of merchandise, etc. , at
the rear entrance.
Subsection XIII E. -- BUSINESS - RESIDENCE DISTRICT NO. 1.
In the Business-Residence District No. 1, no building or structure shall be erected
I or materially altered, nor shall any building or premlses be used except for one or more
of the following uses:
1. Any use permitted in the Main Business District except that no liquor, beer nor
intoxicating beverage of any kind shall be sold or served in any business place
nor shall any public dance hall be allowed.
2. All buildings shall be so placed that there shall be a front yard having a
depth of not less than ten (10) feet and side yard of a depth of not less than
ten (10) feet on the street side of corner lots; a side yard of not less than
(8) eight feet on the inside side of corner lots and both sides of inside lots;
the side yard of a one-story detached garage shall be not less than five ( 5)
feet on inside lots and the inside side of corner lots: on the street side of
corner lots the side yard width shall be not less than ten (10) feet as to all
structures, including garages. Such yards, front and side, shall be entirely

unoccupied by,any structure or building, the intention being that there shall be an un-
occupied space of not less than sixteen (16) feet separating main buildings on the
"width" dimension of the lot as "Width" is deinfed in Section 1 of this Ordinance.
All lots sha,ll have a rear, or "backfl yard the full width of the lot and of a depth
not less than ten (10) feet from the nearest outside well of any building or stnuc-
ture to the rear lot line.
Subsection XIIIF -- BUSINESS - RESIDENCE NO. 2.
In Business-Residence District No. 2, no building or structure shall be erected or I
materially altered, nor shall any building or premises be used, except for one or more
of the following uses:
1. Any use permitted in Bl~iness-Residence District No. 1.
2. Tourist Camps and Auto Courts; provided, that before per~ may be issued for
a Tourist, Auto Camp or Cottage Court, plans and specifications showing the
extent and proposed general arrangement of such Camp or Court, or either,
with special reference to provision for maintaining such Camp or Court, or
either, in a clean and sanitary condition and for the prevention of congestion
or over-crowding, shall be submitted to the City Commission and by such Com-
mission approved.
3. Front and side yard requirements same as in Business-Residence District No~ 1;
but this requirement shall not apply to buildings in TJurist Camps and Auto
Courts where plans and specifications for such Camp or Courts have been sub-
mitted to the City Commission and by it approved, as required by sub-division
( 2) above.
Subseotion XIII G -- INDUSTRIAL DISTRICT
The Industrial District is created to provide a District for use for any manufacture,
process, business or treatment whatsoever and no such use shall be excluded therefrom
which does not create or tend to create a public nuisance and/or an undue hazard to life
and/or property. It shall be the duty of the Director of Public Safety to determine if
any use or proposed use does or will tend to create such a public nuisance and/or hazard.
Any applicant or any other interested person may appeal to the Commission of The City of
Bozeman from the decision of the Director of Public Safety as to any use or proposed use,
and the Commission shall finally decide the appeal after Public Hearing thereon. Pro-
vi~ed reasonable notice of such hearing has been given by suitable publication.
No use permitted in any residence district or business district shall be excluded
from the Industrial District. No building or premises shall be used and no building or
structure shall be erected, enlarged or altered in any manner whatsoever for any trade, I
industry, or use not approved as herein provided.
Subsection XIII H -- BUSINESS DIS'fRIC'r NO. 2.
In the Business District No. 2 no building or structure shall be erected or materi-
ally altered, nor shall any building or premises be used except for one or more of the
following uses:
1. Any use permitted in "A" or fiB" Residence Districts.
2. The establishment and operation of small retail businesses only.
3. The establ1shmen t and operation of' the following businesses is pro'hibi ted in
and shall not be permitted in this District:
a. Billboards and outdoor display signs
b. Coal, lumber, wood and building material yards.
c. Dance Halls.
d. Used Car lots.
e. Any business where beer or liquor is sold.
t. Any business where slot machine s are operated.
g. Machinery Sales Yards.
h. Pool Halls.
1- Tourist or auto camps or C01Z'ts.
4. The City Commission of the City of Bozeman hereby reserves and retains the
right and privilege of denying a permit or city license to build, establish
or operate any further types of classifications of businesses in this Dis-
trict which are not suitable, in its discretion, for a small retail shopping District.
Within the limits of this District buildings may be erected and built to the prop-
erty lines, provided thft the construction of such buildings is of a four hour fire re-
sistant rating. All buildings of less than a four hour fire resistant rating construc-
tion shall be so pIeced that there shall be a side yard of a depth of not less then ten I

Section 5. That that portion of Ordinance Number 739 of the City of Bozeman which
amends Part II of Section VII of Ordinance No. 711, the short title of which 1s "The
~onlng Ordinance" and all Ordinances and parts of Ordinances in conflict with this Or-
dinance be and the same are hereby repealed.

Section b. This Ordinance was presented for consideration at a regular meeting
of the City Commission held on the 7th day of June, 1950, and after such consideration
and in compliance with the provisions of Section' XVII of said Ordinance No. 711, "The
Zoning Ordinance" relating to changes and amendments thereof, ordered to layover for
further consideration and final action until the regular meeting of the City Commission
I to be held on the 14th day of June, 1950.
Section 7. This Ordinance having been further considered by the City Commissi~n
at its regular meeting on the 14th day of June, 1950, it was after such further consider-
ation, duly passed and adopted by the unanimous vote of the City Commission on the said
14th day of June, 1950.
