ORDINANCE NO. 750 AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA, RELATING TO AND REGULA'rI'IJG THE LICENSI~G OF SLOT MACHINES POSSESS~:D, USED, OPERATED, KEPT OR MAIN- IrAI~ED FOR USE OR OPERA'rION BY RELIGIOUS, FRA'rERNAL, CHARI'rABLE OR NON- PROFI'r ORGANIZATIONS WI'rHIN THE CORPORATE LIMITS OF THE CITY OF BOZEMAN, MONTANA; PROHIBITING MINORS FROM PLAYING SLO'l' MACHINES OR LOITERING ABOUTI' THE PREMISES W:mRE A SLOT MAC~INE IS KEPT OR OPERATED, AND PROVIDING PEN- ALTIES FOR THE VIOLATION OF THIS ORDINANCE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, MowI'ANA AS FOLLOWS: I Section 1. No slot machine shall be used, operated, kept or maintained for use or operation withi_~ the City of Bozeman, Montana, by any person or persons whomsoever .-' save and except as in this Ordinance provided. The words "person" and "Persons" shall include both natural and artificial perso;1s, including ell partnerships, corporations, associations, societies, and all other persons of every kind. Section 2. "Slot machine" as used in this Ordinance shall mean any machine op- erated by inserting a coin, token, or trade check therein by the player and from the play of which he obtains, or may obtain, money, checks, chips, or tokens redeemable in money. Section 3. Religious, fraternal, charitable, or nonprofit organizations may use, operate, keep or maintain for use, slot machines in the City of Bozeman, Montana, only in accordance with the provisions of this Ordinance. Section 4. No religious, fraternal, charitable, or nonprofit organization shall use, operate, keep or maintain for use, any slot machine in the City of Bozeman, Montana, without first having secured a license from the Director of Finance of the City of Bozeman, Montana, so to do and paying the license fee therefor. The license fee for such purpose shall be thet allowed to be charged by the City of Boze:nan by the applicable law of the State of Montana at the time such license is issued. A I separate license shall be issued for each slot machine and for each sepsrate slot in any slot machine, an additional license fee equivalent to the fee hereinbefore provided for shall be paid. All licenses issued under this Ordinance shall expire on the first day of January following the issuance of said license, and a full year's license fee shall be charged regardless of when such license is issued. Section 5. Applications for slot machine licenses shall be directed in writing to the City Commission of the City of Bozeman, shall be filed with the Clerk of the City Commission of the City of Bozeman, signed by the applicant, or its duly author- ized officers, and shal~ set forth the following information: a) The full name and address of the applicant; b) The firm name, nature of business organization and duly aut~?Tized officers thereof, if any; __ c) 'Nhether the applicant is a religious, fraternal, chari taol'e or nj5n- profi t organization; _,...,.n_,..., _ -'__ d) Location by street and number of the premises wherein said slot--ma,chine or slot machines is or are to be used, operated or kept and maintained for use or operation; e) A description of any other business to be conducted on the premises referred to in d, supra; f) 'rhe number of s lot machines for which licenses ere applied for with the serial, manufacturer's number or other number o~ such other description or designation of each machine as will properly identify tt, including the number of slots upon such machine and the denomination of the coin or coins required to operate each such machine. I The application must contain a statement that the applicant has a license from the the State of State Board of Equalization df/Montana for each slot machine for which a license is applied for hereunder, such statement to set forth the date and number of such license. I I I ?~9 f.I, Section 6. Upon the filing of t.ne application prescribed in the preceding sec- tion and upon payment of thelicense fee prescribed herein, the City Clerk shall submit such application to the City Commission for consideration at its next regular or special meeting. Upon approval of such application by the City Commission of The City of BJzeman, the City Clerk shall thereupon issue and deliver to the applicant a license for each and every slot machine for which application has been made and approved by the Commission. Should the Commission refuse a license for any slot machine, the license fee paid by the applicant shall be returned to the applicant. Section 7. Each machine licensed under this Ordinance shall at all times have attached to it an official stamp or marker prescribed by the State Board of Equalization of the State of Montana and an official stamp or marker issued by the Director of Finance of the City of Bozeman, Montana. Section 8. No licensee shall permit any person under the age of majority to play any slot machine used, operated, or maintained by said licensee, or to loiter about any permises where such slot machine is kept oroperated. Any violation of the provi- sions of this section shall constitute a nuisance and be punishable as provided in this Ordinance. Section 9. Any person, partners:1ip , club , society, fre. ternal, religious, chari- table, or nonprofit organzi etion, which has not been issued a license under this Ordl- nance and which maintains for use or permits the use of any slot machine as herein de- fined on any premises owned, occupied, or controlled by him or it, or violates any of the proviSions of this Ordinance, shall be guilty of malntalning a nuisance and upon conviction shall be punished by a fine of not less than Fifty Dollars ($50.00) and not more than Three Hundred Dollars ($300.00), or by imprisonment in the City Jeil for not less than ten(lO) days nor more than ninety (90) days, or by both such fine and imprisonment. Any violation of the provisions of this Ordinance by any licensee shall subject said licensee, upon conviction, to a revocation of his or its license, and such licensee shall be ineligible to apply for or receive a slot machine license for a period of one (1) year after such revocation. Passed and adopted by the City Commission of Bozeman, Montana, and approved by the Mayor this 13th day of April, 1949.
