'0.- ~ AN ORDINANCE OF Tfffi CITY COMMISSION OF BOZEMAN, MONTANA PROYIDING FOR THE COC.~:'~<Sc LECTION OF ASSESSMENTS FOR UNIFORM CARE OF LOTS IN SUNSET HILLS CEMETERY, IN '~~~<..... CASES WHERE NO CONTRACT OR AGREEMENT HAS BEEN ENTERED INTO WITH CEMETERY " AUTHORITIES FOR THE PERPETUAL OR PERMANENT CARE OF SUCH LOTS, AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HHREWITH. 'J"" ORDINANCE NO. 725 BE IT ORDAINED BY THE CITY COMMISSION OF BOZEMAN, MONTANA: Section 1. That the City Commission may annually, at such time as they deem advisable for carrying on t the provisions and purposes of this ordinanoe, levy an assessment upon any lot or lots in the Sunset Hills Oemetery, exoepting such lot or lots as shall have a perpetual or p8rmanen t care agreement, in an amount not to exoeed two oents per square foot of area of the same, excluding the area of drives and walks, to prOVide funds for the uniform care of the said lot or lots; provided tha t notice of the proposed assessment shall be .mai1ed forthwith to each lot owner or person having oharge of eaoh lot at the last known postoffioe address of suoh owner or person, direoting payment within thirty days from the date of such notice; and provided further th'a t the assessment so noticed shall be a personal liability. Section 2. When uniform care of any lot or lots in Sunset Hills Cemetery has been given for two years or more for which assessments are un(pid after notice as provided in Section one of this ordinanoe, right to interment is forfeited and no burial permit will be issued therefor until such assessments shall have been paid in full. When uniform oare shall have been given to any suoh lot or lots in the said oemetery for five years or more and the assessments therefor remain unpaid, upon like notice, title or right of burial to and in all unoooupied parts of the said lot or lots shall revert to the Oi ty and the un- occupied parts of such lot or lots may be resold or reconveyed in the same manner and subject to the same rules and regulations as other lots in the cemetery are transferred. Section 3. When the title to any lot or lots in Sunset Hills Cemetery shall ha ve been transferred by deed or other written instrument and the same shall have been filed for record in the office of the county clerk and reoorder, and subsequently, under the provi- sions of this ordinance, title to such lot or lots shall have passed to the city, a certif- cate showing such transfer shall be filed by the Clerk of the said City in the offioe of the said County Clerk and Recorder in the County whe rein such Ceme tery is 10ca ted and the County Clerk shall the reupon nske a notation of such transfer agains t the record in his office, of the title conveyed by au ch deed or ins trument. Seotion 4. All ordinances or parts of ordinanoes in oonflict hereWith are herebyrepeelei. Section 5. This ordinanoe shall be in full force and effect thirty days from and after its passage and approval.
