AN ORDINANCE REGULATING AND CONTROLLING THE BEING IN OR UPON THE STREETS, .....le/:k.:/-!:Y:_.... ALLEYS, PARKS AND OTHER PUBLIC PLACESOF THE CITY OF BOZEMAN AT UNSEEMLY HOURS BY UNATTENDED AND UNSUPERVISED MINORS UNDER THE AGE OF SIXTEEN YEARS.;....................- AND REPEALING OR~INANCE NUMBER 193. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF BOZEMAN: Section 1. Being in, on, or loitering upon any street, alley, park or other p1.lblic place within The City of Bozeman by or of any minor under the age of sixteen years, between the hours of 10 O'clock P.M. and 4 o'clock A.M. of any day, is hereby forbidden and pro. hibi ted; 'provided, the t this prohibi tion shall not apply to or include any such minor per,son who is accompained by his or her parent or other authorized adult person, or who has and exhibits upon demand of any police or other peace officer, the written permission of such parert or other authorized adult person. Section 2. It shall be the duty of the Chief of Police or of' any person by him all" thorized and directed, at 15 minutes before the hour of 10 o'clock P.M. of any day, to cause the fire siren of the City to be sounded as notice and a warninp to such minor persons as are designated in Section 1 of this ordinance, to p'o to their homes or other usual place of abode; and it shall be the duty of the police of the City who shall between the hours designated in Section 1 of this ordinance find or observe any such minor person as is designated in Section I of this ordinance upon any street, alley, park or other public place within The City of Bozeman and unaccompanied by parent or other authorized adult person, to take the name of such minor, inform such minor of the provisions of this or- dinance and require him or her at once to proceed to his or her home or other usual place of abode. Section 3. Any minor within the age provisions of this ordinance who shall disregard or disobey such order and direction of such police or other authori?ed peace officer, or who shall habitually offend against the prov1sions hereof, may be arrested by any police or other authorized peace officer charged as a juvenile delin~uent and proceeded against as such under the provisions of Chapter 106 of the Penal Code of the Revised Codes of Montana, 1935, and any amendments thereof or thereto. Section 4. Ordinance No. 193 of The City of' Bozeman is hereby repealed, but such repeal shall not be construed nor interpreted to effect a revival of Ordinances Nos. 136 and 152, or of either of them repealed by said Ordinance No. 193 hereby also repealed. Section 5. This ordinance shall be in full force and effect on and after thirty days after i tR adoption and publica tion.
