AN ORDINANCE OF THE CITY OF BOZEMAN AMENDING SUBSECTIONS (9) AND 10,
DIVISION "G" OF SECTION 1 OF OR'JINANCE NO. 637 OF THE CITY 01,1 BOZEMAN,
KNOWN AS THE GENERAL LICENSE ORDINANCE, SO AS TO EXTEND THE EFFECT OF
THE PROVISIONS OF SAID SUBSECTIONS TO THREE MILES BEYOND THE CITY LIMITS
AS AUTHORIZED BY SECTION 5039.15 REVISED CODES OF MONTANA, 1935; AND
DECLARING AN EMERGENCY.
PREAMBLE
VrF-ffiRTi;AS, Section 5039.15 R. C. Montana 1935 gives cities and towns the power and aJthor-
ity "to license, tax and ret:'r,lllate circuses and shows of like characterlf within the Cit;r or
town and three mile s beyond the corpora te limtt:s thereof; and
WFlEREAS, Sections 9 and 10 of Divisbn tlG" of Section 1 of Ordinnnce No. 637 of The
City of Bozeman, imposinf a license on carnivals, street fairs, tent shows, do? and pony
shows, circuses, rodeos and shows of like character, does not expressly extend the author-
ity of the city to so license, tax and regulate beyond the corporate limits of the Cit-:r;
and
vVHEREAS, the cit;! authorities have information of a reliable chAracter that a carnival
or cirC1Js is about to pitch its tents and carryon a circus or carnival or show of like
charac "h'er .ius t beyond the corporate limits of the Ci ty for the purpose of evading the
rep;ulation, supervision, and control thereof by the city under its police power, and to
require a license from the city for shows and exhibitions of the character described in
said subsections 9 and 10 of Division tlG" of Section 1 of said Ordinance No. 637, and by
reason thereof an emergency exists. Now, therefore,
BE IT ORDAH:ED BY THE COMMIS SION OF THE CITY OF BOZEMAN:
Section 1. That Subsection 9, Subdivision "G" of Section 1 of Ordinance No. 637 of
The Ci ty of Bozeman, being the General LicenseOrdinance, be and the S8me is hereby amended
to read as follows:
(9). Carnivals, Street Fairs, Tent shows and the like within corporate limits of the
C:tty and wi thin three miles beyond said corporn te lim:!. ts, not otherwise herein classified:
Sin~le tent shows $20.00 per day. Each additional show, ga~B, concession, device and the
like, $10.00 per day. Parades $10.00 per day in addition. Separate license required for
bill posting.
Section 2. That Subsection 10, Division "G" of Section 1 of Ordinance No. 637 of The
City of Bozeman, being the General License Ordinance, be and tLe same is hereby amended to
read as follows:
(10). Circuses, Menageries, Wild Animal Shows and the like, Do?; and l'ony Shows,
Rodeos, Roundups 8nd all exhibitions and entertainment of a simllar character whether in
the open or lmder canvas within the corporate limits of the City and within three miles
beyond said corporate limits: First rinp, $100.00 a day; each additional ring $60.00 a day;
Parades ~25. 00 a da y in aclC i tion. Separa te license required for bill pas tin!!. Tbe mJ.n inmm
license for any S11Ch show or exhibition shall be $100.00 a day.

Passed and adopted by the unanimous vote of the City Commission at a regular session
of said Commission held on the 17th day of July, 1942.
