PREAMBLE
WHEREAS, it is necessar':'J, for the safety, peace and quiet of The City of Bozeman and
the inhabi tants thereof, tha t the discharge or firing of fireworks, firecrackers and 0 ther
p:rrotechnic and explosive material, d1sp18Y or demonstration, and the sale of such explo-
sives, within said City, be regulated and controlled, therefore,

Section I
Sale, Discharge and Use Prohibited
The sale at retail, discharge, firing or use of firecrackerA, rockets, torpedoes,
Roman candles, or other fireworks or substances desiRned or intended for pyrotechnic dis-
play or demonstration, and of toy pistols, toy guns, canes, toy cannons, or other appli-
ances using ~ln powder, blank cartridges, and caps containing chlorate of potash mixture,
within The City of Bozeman, is hereby prohibited. Provided: That the Director of Public
Safety of The City may, at any time, in writing, permit a public display of fireworks under
such condi tions, supervis ion, 1 imi ta tions and prAcau tions as he may prescribe and by prop-
erly qualified persons, with due regard to the safet;,T of persons and property.
SECTION II. REMOVAL OF STOCK: The Director of Public Safety may, at his discretion,
remove or have removed, a t the owner's expense, all stock of fireworks and articles speci-
fied in Section I of this Ordinance, and any similar article or combustibl , exposed for
sale or held in stock in violation of this Ordinance.
SECTION III. PENALTY. Any person, firm, corporation or association vio10ting the
provisions of this Ordinance shall be punished by a fine of not less than One .Dollar
(~~l.OO), nor more than Three Hundred Dollars ($300.00), or by imprisonment in the county
or city jail for not less than one day nor more than thirty days, or by both such fine
and imprisonment; and in case of viola tion by any firm, corpora tion or associa tion, the
manaRer or other person in charge shall, prima facie, be held responsible and be punished
as herein provided.
SECTION IV. RF.PEAL: Ordinance No. 625 of The City of Bozeman, entitled:

AND all other ordinances and parts of ordinances in conflict herewith, are hsreby repealed.
SECTION V. EPFECTIVE DATE: This Ordinance shall be in full force and effect from and
after thirty (30) days after its adoption.
Passed by the Commission of The Cit;r of Bozeman, at a r'Eular ,'Bession thereof held on
the 13th day of r,.1arch, 1942.
