(,-'.....,,.r~ \''<f; '\0 ':\~,i~ <<~\\, f\) "()...-:"-: "" "\ "'" AN ORDINANCE Or' THE CITY OF BOZ1~MAN FOR THE CONTROLAND FROTECTION OF BOZEMAN CREEK WITHIN THE LIMITS OF' THE CITY AND REPEALING ORDINANCE Nl~BER 105 OF SAID CITY. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF BOZEMAN: Section 1. That the channel of Bozeman Creek throughout its course within the corporate limits of The City of Bozeman shall be preserved and kept at a minimum width of twelve (12) feet in the clear and kept free of all obstruction unless and until it shall be otherwise ordered or permitted by the City Commission by ordinance or resolution duly adopted. Section 2. Any person or persons, f:rm, corporation or association who shall directly or indirectly or by any means whatever or at all confine the said Bozeman Creek in any part of its course through the corporate 11mi ts of 'rhe C1 ty of' Bozeman to a narrower chann~l than is prescribed in Section 1 hereof; or who shall alter, change or turn the same from its natural channel, or alter its course at any point within the corpoarate limits of The City of Bozeman, except in pursuance of andin accordance witl1 an ordinance or resolution of the City Commission duly passed and adopted; or who shall buIld, throw, deposit or in any manner or at all place any obstruction in the channel of said creek within the corporate limits of said City, shall be deemed guilty of a violation of tilis ordinance. Section 3. Nor person, firm, corporation or association nor any employee or agent of any person, firm, corporation or association, shall throw, conduct, conveyor deposi t, or cause to be thrown, conducted, conveyed or de~)oslted into the channel of said Bozeman Creek in its course through the corporate limi ts 0 f The Ci ty of 130zeman or any part thereof, any paper, offal,- rubbish, rags, filth, manure, hay, straw, tin cans, hides, dead animals or anything whatever causing or tending to cause an obstruction or pollution of said Bozeman Creek within the corporate limits of The City of' Bozeman. Section 4. Any person, firm, corporation or association or employe or agent thereof Vllh 0 shall viola te any provision of this ordinan ce shall, 1J.pon convic tion thereof in the police court of The City of Bozeman be punished by a fine in a sum not less than five dollars nor more than two hundred dollars, or be imprisoned :in the city or coun ty jail not less than one day nor more th;-m slxty days, or b;;- both such f2.ne and IJ'"prisonrnent. If the punishmen t be R flne only and the same is not pa i:.'l, the person so fined shall \. serve out the same by imprisonment in the city or county jail one day for each two dollars of such fine.
