" AN ORDINANCE OF THE CITY OF BOZEM~~ VACATING, WITH CERTAIN RESERVATIONS, THE ALLEY IN BLOCK 29, THE ALLEY IH BLOCK 30 AND THAT PORTION OF MONTANA STREErr (NOW KNOWN AS MONTANA AVENUE, NORTH,) LYING BETWEEN SAID BLOCKS 29 AND 30 OF IMES' ADDITION TO BOZEMAN, MONTANA, ACCORDING 1'0 THE OFFICIAL PLAT THEREOF. WHEREAS, on the 27th day of December, 1935, at a regular session of the City Com- mlssion of the City of Bozeman, Montana, Commission Resolution No. 325 entitled: "A RESOLUTION OF THE COMHISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTEN'fION OF 'rRE CITY OF BOZll;:.1AN TO VACATE THE ALLEY IN BLOCK 29; THE ALLEY IN BLOCK 30 AND THAT PORTION OF MONTANA STREET (NOW KNOWN AS MONTANA AVENUE, NORTH,) LYIN'"} BETWEEN SAID BLOCKS 29 AND 30 DilES' ADDITION TO BOZEMAN, MONTANA, ACCORDING TO THE OFFICIAL PLAT THEREOF: WITH CERTAIN RESERVATIONS. was duly passed and adopted by the City Commission, and due and legal notice of hearing thereon was given, as appears of record in the office of theClerk of the City Commission; and WHEREAS, IN and by said Resolution, Friday, the 31st day of January, 1936, at 7:30 o'clock P.M. of said day, at the regular meeting place of the City Commission in the City Hall of the City of Boaeman, Montana, was the time and place designated for hearing objections to the action proposed to be taken pursuant to said Resolution No. 325 by the adoption of an Ordinance Giving effect to the lntention in said Resolution declared, and where and when any and all persons owning property abutting said alleys and that portion of Montana Avenue, North, proposed to be vacated and discontinued pur- suant to the aforesaid Resolution of Intention might appenr and show cause, if any they y had, against said proposed vacation; and 'mmREAS, ON SAID hearing on the 31st day of January, 1936, no objections were made or filed against the action proposed to be taken by said Corrunission Resolution No. 325, and said hearing was continued until the regular meeting of said City Commission on the 7th day of February, 1936, and was again on said date continued until the 14th day of February, 1936; and no objections to the action proposed to be taken by said Commlssion Resolution No. 385, orally or in writing, were at any time made or flled; and the City Commission finding as a fact that the action proposed to be taken by said Commission Resolution No. 325 can be taken without detriment to the publiC interest; therefore BE IT ORDAINED BY THE COMMISSION OF TIm CITY OF BOZEMAN: Section 1 That the alley in Block 29, the alley in Blocl{ 30, and that portion of Montana Street (now known as Montana Avenue, North,) lying between said Blocks 29 and 30, of Imes' Addi tion to Bozemar., Montana, according to the official plat thereof,. subject to the right of the City of Bozeman at any time hereafter when the public interest may so require, to install and maintain such water mains, and either storm or sanitary sewers as in the opinion of the City of Bozeman may be convenient or required for the benefit of the property located either north or south of said Blocks 29 and 30, together with all usual and customary rights su~h as ingress to and egress from, and right of way over, across, and unon said alleys and street necessarily incidental and collateral to 43 44 installation and maintenance of such water mains and sewers, or either, be, and the same is hereby, vacated and discontinued for street and alley purposed and use. Section II Thls Ordinance shall be in full force and effect from and after thirty (30) days after its passage and adoption. Passed and adopted by the City Commission of Bozeman at a regular session thereof held on the 21st day of February, 1936. ~;:~-~ ~ . Shadoan, Clerk of the Commission of the City of Bozeman, hereby certify that the foregoing Ordinance No. 670 was publlshed by title in the Bozeman Daily Chronicle, a daily newspaper of general circulation, printed and pu.blished in said Clty of Bozeman, in the issue of February 25th, 1936 and that due proof of said pub- lication was made and filed 'in my office.
