PUBLIC PARK EASEMENT
At Flanders Mill Subdivision Phase 1
CITY OF BOZEMAN, GALLATIN COUNTY, MONTANA
Flanders Mill, LLC, GRANTOR, does hereby grant to the City of Bozeman, a Municipal
Corporation of the State of Montana, with offices at 121 North Rouse Avenue, Bozeman,
Montana 59715, GRANTEE, public park easements (for passive and active recreation and
similar uses typical of a public park, but not for parking, residential or commercial use, or for
any other purpose) in, through, over and across the following described property situated in the
City of Bozeman, Gallatin County, Montana:
Tract 1, Certificate of Survey No. 2834, except Tract A, Certificate of Survey No. 2886,
located in the East 1/2 of the West 1/2 of Section 3, Township 2 South, Range 5 East of
P.M.M., City of Bozeman, Gallatin County, Montana.
The easements are more particularly shown on the attached Exhibit A and Exhibit B,
which by this reference are made a part hereof.
The GRANTOR states that it possesses the real property described above and that it has a
lawful right to grant an easement thereon.
The GRANTOR further agrees that the GRANTEES may peacefully hold and enjoy the
rights and privileges herein granted without any interruption by the GRANTOR. The terms,
covenants and provisions of this easement and agreement shall extend to and be binding upon the
heirs, executors, administrators, personal representatives, successors and assigns. of the parties
hereto.
