. .f AN ORDINANCE OF ffHE CITY OF BOZq:MAN, MONTANA, VACATING THE ALLEY IN BLOCK
SEVEN (7) OF FAIRVIEW ADDITION TO THE Crpy OF BOZEMAN, MOllfTANA
WHEREAS, certain persons claiming to be the owners of property in Block Seven \7} of
Fairview Addition to the City of Bozeman, Montana, have filed a petition with the City
Commission of the City of Bozeman asking for the vacation of the alley in Block Seven I
\7} of Fairview Addition to the City of Bozeman, Montana; and
WHEREAS, on the17th day of August, 1955, at its regular meeting the City Commission
of the City of Bozeman passed and adopted Commission Resolution No. 792, declaring it to
be the intention of the said City of Bozeman to vacate the alley in Block Seven (7) of
Fairview Addition to the City of Bozeman, Montana, which said alley is more particularly
described as a strip of ground of the width of twen~y (20) feet off of the entire North
side of Lot Fifteen (15) in Block Seven (7) of Fairview Addition to the City of Bozeman,
as the said Lot and Block are numbered and designated and described upon the official
plat and survey of said Addition now on file and of record in the office of the ~ounty
Recorder in and for Gallatin County, Montana; pursuant to said petition, and directing the
City Manager of the City of Bozeman to give notice thereof in the manner and for the time
as provided, by law; and
WHEREAS, pursuant to said petition notice of the filing thereof and of the adoption
of said Resolution was published in the Bozeman Daily Chronicle on filo with the Clerk
of the City Commission and which said notice described the alley in Block Seven \7} of
Fairvlew Adittion to the City of Bozeman asked to be vacated by said petition, and giving I
notice that the hearing on said petition would be held at the regular meeting of the City
Commission to be held on the 31st day of August, 1955, at one o'clock P.M. at the Commis~
sian Room in the City Hall Building of the City of Bozeman; and
WHEREAS, the City Manager having given notice of the filing of said petition and
the adoption of said Resolution of Intention for the time and in the manner as by law
provided, and the time for objections as set forth in said notice having expired and no
objections having been made, and it appearing that all p'ovisions of' the law in such cases
made and provided had been fully met and complied with; and
WHEREAS, at the time and place so designated the City Commismon in regular session
assembled, did then and there fully consider said petition and after such,consideration
did decidelthat such petition should be granted and such determination was entered upon
the minutes of said meeting, and did then and there determine and decide that such vaca~
tion of the alley in Block Seven (7) of Fairview Addition to the City of Bozeman, M)ntana,
could be made without detriment to the public interests and should bemade in the public
interest;
NOW THEHEFORF.r,-.>>-E IT ORDAINED BY THE COMMISSION OF THE CITY OF BOZEMAN: I
Section 1. That th~ alley in Block Seven (7) of Fairview Addition to the C'1ty of
Bozeman, Montana, which said alley is more particularly described as a strip of ground
of the width-of twenty (20) feet off of the entire North side of Lot Fifteen (15) in
Block Seven (7) of Fairview Addition to the City of Bozeman, as the said Lot and Block
are numbered and designated and described upon the official plat and survey of said Ad-
di.dtion now on file and of record in the office of the County Recorder in and for

Gallatin County, Montana, be and the same is, hereby vacated and discontinued.
Section 2. This Ordinance shall be in full llirce and effect from and after thirty
(30) days after its adoption.
Adopted at a regular meeting of the City Commission of the City of Bozeman held
this 3lst day of August, 1955. ~fL
