AN ORDINANCE CflEATING AND ESTABLISHING FIRE ZONES AND REPEALING ORDIN-
ANCE mJMBER 779 OF THE CITY OF BOZEMAN AND ALL ORDINANCES AND PARTS OF
ORDINANCES OF SAID CITY IN CONFLICT HEREWITH
BE IR ORDAINED BY THE COMMISSION OF THE CITY OF BOZEMAN:
Section 1 I'
For the purpose of controlling and regulating the erection of buildings and other
structures within the corporate limits of The City of Bozeman and promoting and protect-
ing the safety of persons and property within said City from the hazard of fire, the
entire City of Bozeman within its corporate limits is hereby created and established
as a fire district divided into three zones to be known and designated as Fire Zone No.
1, Fire Zone No.2 and Fire Zone No.3 which are likewise hereby created and established
and bounded and described as follows, to-wit:
The boundaries of Fire Zone No. 1 under the Ordinance are as follows:
Beginning at the intersection of the center lines of Mendenhall Street
and ~~llace Avenue, thence Southerly along the c~nter line of Wallace
Avenue to a point on the center line of Babcock ~treet; thence Westerly
along the center line of Babcock Street to a point located 131 feet
East of the East Line of Rouse Avenue; thence Southerly 131 feet East
of and parallel to the East Line of Rouse Avenue to a point 150 feet
North of the North Line of Olive Street; thence Westerly 150 feet North
of and parallel to the North Line of Olive Street to a point 95 feet
West of the West Line of Bozeman Avenue; thence Southerly 95 feet West
of and parallel to the West Line of Bozeman Avenue to a point on the
center line of Olive Street; thence Westerly along the center line of
Olive Street to a point on the center line of Fourth ~venue; thence
Northerly along the center line of Fourth Avenue to a point on the
center line of Babcock Street; thence Westerly along the center line of
Babcock Street to a point on the center line of Fifth Avenue; thence -I
Northerly along the center line of Fifth Avenue to a point on the center
line produced of, Block E of Story's Addition to the City of Bozeman;
thence Westerly along said center line produced and the center line of
said Block E to a point on the center line of Seventh Avenue; thence
Southerly along the center line of Seventh Avenue to a point on the
center line of Babcock;:)treet; thence Westerly along the center line of
Babcock Street to a point on the center line of Eighth Avenue; thence
Northerly along the center line of Ei~hth Avenue to a point on the East
and West center line produced of Block F of said Story's Addition; thence
Westerly along the center lines of Blocks F and G of said Story's Addition
to a point on the center line of South Ninth Avenue; thence Northerly along
the center line of South Ninth Avenue to a point on the center line of West
Main Street; thence Easterly along the center line of West Main Street to
a point on the cen ter line of North Ninth Avenue; -thence Northerly along
the center line of North Ninth Avenue to a point on the center line of the
East and West Alley between Main and Mendenhall Streets; thence Easterly
along said center line of alley to a point on the center line of Eighth
Avenue; thence Northerly along the center line of Eighth Avenue to a point
on the center line of Villard Street; thence Easterly along the center
line of Villard Street to a point on the West Line produced of Tract Eight
(8) of the Durston Subdivision; thence Northerly along said West Line pro-
duced, the West Lines of Tracts Eight (8), Nine (9), Ten (10), Eleven (11),
and Twelve (12 ) , of said Durston Subdivision, and the West Line produced
of said Tract Twelve ( 12 ) , to a point on the center line of Durston Road;
thence Easterly along the center line of Durston Road to a point on the
center line produced of the alley between Eighth and Seventh Avenues; thence
Northerly along said center line of alley produced and the center line of
alley between Eighth and Seventh Avenues to a point on the City Limits;
thence Easterly along the City Limits to a point 197 feet East of the
East Line of Seventh Avenue; thence Southerly 197 feet East of and parallel
to the East Line of Seventh Avenue to a point on the center line of Durston I
Roa d ; thence Wes terly a long the cen ter line of Durs ton Road to a point
120 feet East of the East Line of Seventh Avenue; thence Southerly 120 feet
East of and parallel to the East Line of Seventh Avenue to a point 140 feet -
South of the South Line of Mendenhall Street; thence Easterly 140 feet South
of and parallel to the South Line of Mendenhall Street to a point on the cent-
er line of Third Avenue; thence Northerly along the center line of Third
Avenue to a point on the center line produced of the alley between Mendenhall
and Lamme Streets; thence Easterly along said center line produced and the
center line of alley between Mendenhall and Lamme Streets to a point on the
center line of Church Avenue; thence Southerly along the center line of
Church Avenue to a point on the center line of Mendenhall Street; thence

Part I. Beginning at the intersection of the center lines of Lamme Street and
Wallace Avenue" thence Southerly along the center line of Wallace Avenue to a
point on the center line of Mendenhall Street; thence Westerly along the center
line of Mendenhall Street to a point on the center line of Church Avenue; thence
Northerly along the center of Church Avenue to a point on the center line produced
of the alley between Mendenhall and Lamme Streets; thence Easterly along said
'. center line produced and said center line of alley to a point 56 feet West of
the West Line of Wallace Avenue; thence Northerly 56 feet West of and parallel to
the West Line of Wallace Avenue to a point on the center line of Lamme Street;
thence Easterly along the center line of Lamme Street to the point of beginning.
Part II. Beginning at the intersection of the center lines of Babcock Street
and Church Avenue; thence Southerly along the center line of Church ~venue to a
point on the center line of Olive Street; thence Westerly along the center line
of Olive Street to a point 95 feet West of the West Line of Bozeman Avenue; thence
Northerly 95 feet West of and parallel to the West Line of Bozeman Avenue to a
point 150 feet North of the North Line of Olive Street; thence Easterly 150 feet
North of and parallel to the North Line of Olive Street to a point 131 feet East
of the East Line of Rouse Avenue; thence Northerly 131 feet East of and parallel
to the East Line of Rouse Avenue to a point on the center line of Babcock Street;
thence Easterly along the center line of Babcock Street to the point of beginning.
Part III. Beginning at the intersection of the center lines of Olive Street and
Black Avenue, thence Southerly along the center line of Black Avenue to a point
100 feet South of the South Line of Olive Street; thence Westerly 100 feet South
of and parallel to the South Line of Olive Street to a point on the center line
of Willson Avenue; thence Northerly along the center line of Willson Avenue to a
point on the center line of Olive Street; thence Easterly along the center line
of Olive Street to the point of beginning.
Part IV. Beginning at the intersection of the center lin~ of Eighth Avenue with
the center line produced of the alley between Main and Mendenhall streets, thence
Northerly along the center line of Eighth Avenue to Q point on the center line
produced,of the East and West alley in Block E of Tracy's Second Addition to the
City of Bozeman; thence Westerly along said center line produced of said alley
to a point of intersection with a line 490 feet West of and parallel to the West
Line of North Seventh Avenue; thence Southerly 400 feet West of and parallel to
the West line of North Seventh Avenue to a point on the center line of Mendenhall
I. Street; thence Westerly along the center line of Mendenhall Street to a point on
the center line of Ninth Avenue; thence Southerly along the center line of Ninth
Avenue to a point on the center line produced of the East and West alley between
Main and Mendenhall Streets; thence Easterly along the s aid center line produced

Part V. Beginning at the intersection of the center line of Third Avenue with the
center line produced of the East and West alley between Lamme and Mendenhall Streets,
thence Southerly along the center line of Third Avenue to a point 140 feet South
of the South Line of Mendenhall Street; thence Westerly 140 feet South of and
parallel to the South Line of Mendenhall Street to a point 120 feet East of the
East Line of Seventh Avenue; thence Northerly 120 feet East of and parallel to the
East Line of Seventh Avenue to a point on the center line of the East and West alley
between Mendenhall and, Lamme Streets; thence Easterly along the center line of said
alley between Mendenhall and Lamme Streets and said center line of alley produced,
to the point of beginning. .
Part VI. Beginning at the intersection of the center lines of Seventh Avenue and
College Street; thence Northerly along the center line of Seventh Avenue to a point
105 feet North of the North Line of College Street; thence Westerly 105 feet North
of and parallel to the North Line of College Street to a point on the cen ter line
of alley between Seventh and Eighth Avenues; thence Northerly along the center line
of alley between Seventh and Eighth Avenues to a point on the center line of Alder-
son Street; thence Westerly along the center line of Alderson Street to a point on
the cen ter line of Eighth Avenue; thence Sou therly along the center line of Eigh th
Avenue to a point 175 "feet South of the South Line of Alderson Street; thence West-
erly 175 feet South of and parallel to the South Line of Alderson Street to a point
on the center line of alley between Tenth and Eleventh Avenues; thence Northerly
along the center line of alley between 'l'enth and Eleventh Avenues to a point on the
center line of Alderson Street; thence Westerly along the center line of Alderson
Street to a point on the center line of Eleventh Avenue; thence Southerly along the

Part VII. Beginning at the intersection of the center line of u.s. Highway #10
and the East boundary of line produced of Block 5, Granite Addition; thence North
along this boundary line extended to its point of intersection with the Southerly
boundar~ line of a tract owned b~ Stephen F. and Mable Sande as recorded in Gallatin
County ecord of Deeds, Volume 1 2, Page 343; thence in a Northwesterly direction
and along said boundary line to a point of intersection with the center line of the
C.M.St.P. & P. RR; thence Westerly and Southerly along the center line of the C.M.
St.P. & P. RR to a point on the Northwesterly bank of Mill Canal; thence Southerly
along the Northwesterly bank of Mill Canal to a point on the center line of East
Main Street; thence Easterly along the center line of East Main Street to the center

line of Cypress Avenue; thence Southerly alQng the centerline of Cypress Avenue to
a point on the centerline of Alley between East Main Street and East Babcock Street;
thence Easterly along the centerline of said alley and vacated alley to the in ter-
section of said alley with the centerline of U.S. Highway 10; thence Southeasterly
along the centerline of U.S. Highway 10 to the point of beginning.
The boundaries of Fire Zone No.3 under this Ordinance are as follows:
All of the land within the City Limits of the City of Bozeman which is not
included within the boundaries of Fire Zones Nos. 1 and 2. I
Section 2
The regulation and control over the erection of buildings and other structures
within said Fire Zone Limits Nos. 1, 2 and 3 is fixed and established by Ordinance
No. 784 of The City of Bozeman, known as the "Building Code" reference to which is
hereby made.
Section 3
I
Ordinance No. 779 and all ordinances and parts of ordinances of The City of
Bozeman in conflict herewith are hereby repealed, but this shall not have the effect
of reviving any ordinance repealed by said Ordinance No. 779.
Section 4
This Ordinance shall be in full force and effect from and after thirty (30) days
from its final adoption.
Finally adopted and approved at a regular session of the Commission of The City
of Bozeman held on the 23rd day of January, 1957. 44t;~,-
