AN ORDINANCE ,AMENDING SECTION 21 OF ARTICLE II, SECTIONS 31 AND 36 OF ARTICLE IV, SECTION 38 (b) OF ARTICLE V, SECTION 51 OF ARTICLE VIII, SECTION 82 OF ARTICLE XI, SECTION 92 (b) OF ARTICLE XIIl SECTIONS 1~4 AND lL~9 OF ARTICLE XVII, AND SECTIONS 162, 163, 164, 16 , 167, 168 AND 170 OF ARTICLE XXI OF ORDINANCE NUMBER 768 OF THE CITY OF BOZEMAN, -I THE SHORT TITLE OF WHICH IS THE TRAFFIC ORDINANCE, AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH BE IT ORDAINED BY THE-COMMISSION OF Tfffi CITY OF BOZEMAN: , Section 1. That Section 21 of Article II of Ordinance No. 768 of the City of Bozeman, the short title of which is the Traffic Ordinance be, and the same is hereby amended to read as follows: Section 21 Emergency and Experimental Regu.lations: The Director of Public Safety is hereby empowered to make regulations necessary to make effective the provisions of the traffic ordinances of this city and to make and enforce temporary or experimental regulations to cover emergencies or special conditions. . Section 2. That Section 31 of Article IV of Ordinance No. 768 of the City of Bozeman, the short title of which is the Traffic Ordinance be, and the same is hereby amended to read as follows: Section 31 Traffic-Control Signal Legend: Whenever traffic is controlled by traffic- control signals exhibiting,the words "Go", "Caution", or "Stop", or exhibit- ing different colored lights successively one at a time, or with arrows, the following colors only shall be used and said terms and lights shall indicate and apply to drivers of vehicles and pedestrians as follows: ( a) Green alone or "Go." I (1) Vehicular traffic facing the signal may proceed straight through or turn rieht or left unless a sign at such place prohibits either such turn. But vehicular traffic, including vehlcles turn- ing right or left, shall yield the right-of-way to other vehicles and to pedestrians lawfully within the intersection or an adjacent cross walk at the time such signal is exhibited. (2) Pedestrians facing the signal may proceed across the roadway within any marked or unmarked cross- walk. (b) Yellow alone or "Caution" when shown following the green or "Go" signal. (1) Vehicular traffic facing the signal is thereby warned that the red or "Stop" signal will be exhibited immediately thereafter and such vehi- cular traffic shall not enter or be crossing the intersection when the red or "stop" signal is exhibited. (2 ) Pedestrians facing such signal are thereby advised that there is insufficient time to cross the roadway, and any pedestrian then starting to cross shall yeild the right-of-way to all vehicles. (c) Red alone or Itstop". (1) Veh:i.cular traffic facine the signal shall stop 1 before entering the crosswalk on the near side of the intersection or, if none, then bef:)re entering the intersection and shall remain standing until Breen or ItGo" is shown alone. ( d) In the event an official traffic-control signal is erected and maintained at a place other than an inter- section, the provisions of this section shall be appli- cable except as to those provisions vtlich by their nature can have no appliciation. Any stop required shall be made at a sign or marking on the pavement indicating where the stop shall be made, but in the absence of any such sign or marking the stop shall be made at the signal. 458 ORDINANCE NO. 803 Section 3. That Section 36 of Article IV of Ordinance No. 768 of the City of Bozeman, the short title of which ls the Traffic Ordinance be, and the same is hereby amended to read as follows: Section 36 Director of Public Safety to Designate Crosswalks, Establish Safety I Zones, and Mark Traffic Lanes; The Director of Public Safety is hereby al~horized -- (I) To designate and maintain, by appropriate devices, marks, or lines upon the surface of the roadway, crosswalks at intersections where, in his opinion, there is particular danger to pedestrians crossing the roadway, and at such other places as he may deem necessary. (2) To designate and maintain, by appropriate signs or other marking devices, school crossing zones. (3) To establish safety zones of such kind and character and at such places as he may deem necessary for the protection of pedestrians. (4) To mark lanes for traffic on street pavements at such places as he may deem advisable, consistent with the traffic ordinances of this city. (5) When authorized by the City Commission and pending adoption of amendments to this ordinance or new ordinance repealing this ordinance or parts thereof to issue orders to change, increase, or decrease the streets, zones, public places or other areas described in Schedule I, Section 162; Schedule II, Section 163; Schedule III, Sectlon 164; Schedule IV, Section 165; Schedule V, Section 166; Schedule VI, Section 167; Schedule VII, Section 108; Schedule VIII, Section 169; and Schedule IX, Section 170 I and to erect or install such signs, pavement markings or other devices as may be required by such orders. Sectior: 4". That Section 38 (b) of Article V of Ordinance No. 768 of the City of Bozeman, the short title of which is the Traffic Ordinance be, and the same is hereby amended to read as follows: Section 38 (b) Subject to the provisions of SectIon 37, and except in those instances where a lower speed is specified in this ordinance, it shall be prima facie lawful for the driver of a vehicle to drive the same at a speed not exceeding the following, but in any case which such speed would be l.illsafe it shall not be lawful: (b) Fifteen ( 15) miles an hour when mAking a right or left hand turn at any intersection of streets. Fifteen (15) miles an hour when approaching within fifty (50) feet of any inter- section of streets when the driver's view is obstructed. A drlver's view shall be deemed to be obstructed when at any tim<9 during the last fifty (50) feet of his approach to such intersection, he does not have a clear and uninterrupted view of such intersection and of the traffic upon all 01 the streets entering such intersection for a distance of two hundred (200) feet from such intersection. Section 5. That Section 51 of Article VIII of Ordinance No. 768 of the City of Bozeman, the short title of which is the Tr~f1ic Ordinance be, and the same is hereby amended to read as follows: Section 51 I Signs to bear the Word "Stop": Every siGn erected pursuant to this article, which sign required a vehicle to came to a stop, shall bear the word "stop" in letters not less than 8 inches in height and such sign shall at night- time be rendered luminus by steady or flashing internal illlunlna tion, or by a fixed floodlight projected on the face of the sign, or hy ef1icient reflecting elements on the face of the sign. Every stop sign ShRll be located as ne~r as practicable at the 'nearest line of the crosswalk on the near side of the intersection or, if none, at the nearest line of the roadway. \ 459 ORDINANCE NO. 803 Section 6. That Section 82 of Article XI of Ordinance No. 768 of the C:lty of Bozeman, the short title of which is the Traffic Ordinance be, and the same is hereby amended to read as follows: I Sectlon 82 Miscellaneous Regulations: It is a misdemeanor for any person to drive or move or for the owner to cause or knowingly permit to be driven or moved on any highway any vehicle or combination of vehicles which is in auch unsafe condition as to endanger any person, or which doesnot contain those parts or is not at all times equipped with such lamps and other equip- ment in proper conrtltion and adjustment as required in this article, or which is equipped in any manner in violation of this article, or for any person to do any act forbidden or fail to perform any act required under this article. (a) Flag or Red Light at End of Load: Whenever the load on any vehicle shall extend more than four (4) feet beyond the rear of the bed or body thereof, there shall be displayed at the end of such load in such a posttion as to be clee.rly visible at all times from the rear of such vehicle, a red flag not less than twelve ( 12) inches, both in length and width, ex- cept that between one hour after sunset and. one hour before sunrise, there shall be displayed at the end of sllch load, a red light, visible under normal atmospheric condltions at leas t two hlmdred (200) feet from t he rear of such vehicle. (b) Horns and Warning Devices: ( 1) Every motor vehicle, when operated upon a street, sllall be equipped with a horn in good working order, capable of emitting sound audible under normal con- ditions from a distance of two hundred (200) feet or more, and it shall be unlawf11l, except as otherwise provided in this section, for any vehicle to be equip- I ped with, or for any person to use on a vehicle, any siren, bell, musical horn, or any compression or spark- plug whistle, or for any person at any time to use a horn otherwise than as a reasonable warning, or to make any Wlnecessary or tmreasonably continued loud or offensive sound by means of a horn or other warning device. ( 2) Every authorized emergency vehicle shall be equipped with a bell, siren, or exhause whistle of a type approved by the Director of Public Safety, (c) Prevention of Noise, Smoke, Etc.; Muffler Cut-Outs Regulated: (1) No person shall drive a motor vehicle on a street lmless such motor vehicle is equipped with a muffler in good working order and in constant operation to prevent excessive or tmusual noise and annoyine smoke. ( 2) It shall be unlawfl.l1 to use a "muffler cut-out" on any motor vehicle on a street. (3) No vehicle shall be driven or moved on any stre~t unless such vehicle is so constructed or loaded as to prevent its contents from dropping, sifting, leaking or otherwise escapting therefrom. ( d) Red or Green Lights in Front of Vehicle Prohibited: It shall be tmlawful for any person to drive or move any vehicle upon a highway with any red or green light thereon visible from directly in front thereof. This section shall not apply to police or fire department, I or fire patrol vehicles, nor to any vehicles required or permitted by state law or regulation to display small red or green clearance - lamps on the front. (e) Motor Vehicles Left Unattended, Brakes to Be Set, and Engine Stopped: No person having control or charge of a motor vehicle shall allow such vehicle to stand on ony street lmattended with- out first setting the brakes thereon and stopping the motor of said vehicle, and, when standing upon a perceptible grade, with- out turning the wheels of sl1ch vehicle to the curb or the side of the street or htghwe.y. 460 ORDINANCE NO. 803 ( f) Brake Equipment and Lighting Equipment Required on Vehicles: It shall be unlawful for any person, firm, or corporation to operate, or cause to be operated, upon any of the streets, avenues or alleys of the City of Bozeman, any motor vehicle, trailer, or towed vehicle not complying with the laws of the state of Montana and the rules and regulations of the Montana state Highway Patrol as to brake equipment and lighting equipment on such vehicles. I Section 7. That Section 92 (b) of Article XII of Ordinance No. 768 of the City of Bozeman, the short title of which is the Traffic Ordinance be, and the same is hereby amended to read as follows: Section 92 ( b) Prohibited Crossing: (b) No pedestrians shall cross a roadway other than in a cross- walk in Parts I and II of the Business District or on any throl~h or arterial street or avenue. Section 8. That Section l1.\-4 of Article XVII of Ordinance No. 768 of the City of Bozeman, the short title of which is the Traffic Ordinance be, and the same is hereby amended to read as follows: Sec t ion 11-14 Parking Prohibited During Certain Hours On Certain Streets and city- operated Parking Lots; In the parking meter zones of this City, which are the streets and avenues and city-ope1"'ated parking lots upon which parking meters are now or may be hereafter installed and operated, park- ing is restricted from the hours of 9:00 A.M. to 6:00 P.M. of any day except Sundays and holidays, to a maximum of Twelve (12) minutes in twelve-minute meter zoneB, to a maximum of one (1) hour in one-hour meter zones, to a maximum of two ( 2) hours in two-hour meter zones, and to a maximum of four (4) hours in four-hour meter zones. Section 9. That Section 149 of Article XVII of Ordinance No. 768 of the City of Bozeman, the short title of which is the Traffic Ordinance be, and the same is hereby amended to read as follows: I Section 149 Parking Time Limited on City-Operated Parking Lots: When signs are erected in city-operated parking lots giving notice thereof, no person shall park I. vehicle for longer than forty-eight (48) consec1.l.tive hours at any time in the city-operated parking lots designated in Schedule IX attached to and made a part of this Ordinance, provided thAt when park- ing meters shall be installed on said city-operated parking lots, park- ing is restricted from the hours of 9:00 A.M. to 6:00 P.M. of any day except Sundays and holidays to a maximum of the maxim1~ time allowed by the meters installed on said city-operated parking lots. Section 10. That Section 162 of Article XXI of Ordinance No. 768 of the City of Bozeman, the short title of which is the Traffic Ordinance be, and the same is hereby amended to read as follows: Schedule I Section 162 Boundaries of Districts Within The City of Bozeman: The provisions of Ordinance No. 776 of the City of Bozeman, as amended, the short title of which is "The Zoning Ordin8nce" are, by this reference, incorporAted herein and made a part hereof, the same as if fully set forth herein, for the purpose of designating and specifying the boundaries of the various districts within the City of Bozeman. Section 11.. That Section 163 of Article XXI of Ordinance No. 768 of the City of Bozeman, the short title of which is the Traffic Ordinance be, Hnd the same is hereby aMended to read as follows: Schedule II I Section 163 Boundaries of School Speed Zones: In accordance with the provisions of S'3ction 38 (e), it shall be unlawful for any operator of any vehicle to drive at a speed greater than fifteen (15) miles per hour between the hours of 8:00 A.M. and 4:30 P.M. on days, or parts of days when school is in session, om the streets or parts of streets specified in the following School Speed Zones: '. 461 ,. ORDINANCE NO. 803 Bozeman High School Speed Zone All that pa.rt of North Eleventh Avenue between West Main street and West Beall Street. Willson Junior High School, Rosary I and Emerson School Speed Zones All that part of Main street between a line 150 feet west of the west line of Fifth Avenue and a line 150 feet east of the east line of Third Avenue; all that part of Third Avenue between the south line of Main street and the north line of Babcock Street; all that part of Babcock Street between a line 150 feet west of the west line of Fifth Avenue and a line 150 feet east of the east line of Grand Avenue; all that part of Grand Avenue between a line 150 feet north of the north line of Babcock street and a line 150 feet south of the south line of Olive Street; all that part of Olive Street be- tween a line 150 feet west of the west line of Fourth Avenue to a line 150 feet east of the east line of Grand Avenue; all that part of Fourth Avenue between the south line of Babcock Street and a line 150 feet south of the south line of Olive Street; all that part of Third. Avenue between the south line of Olive Street and a line 150 feet south of the south line of Olive Street; all that part of Fifth Avenue between Main Street and Babcock Street. Hawthorne School Speed Zone All that part of Rouse Avenue between a line 150 feet south of the south line of Mendenhall and a line 150 feet north of the north line of Lamme Street; all that part of Lamme Street between a line 150 feet east of the east line of Chlwch Avenue and a line 150 feet west of the west line of Rouse Avenue; all that part of Mendenhall Street between a line 150 feet east of the east line of Church Avenue and a line 150 feet west of the west line of RO'lse Avenue; all that part of Church A\renue between a line 150 feet south of the south line of Mendenhall street and a line 150 feet north of the north line of Lamme street. Longfellow School Speed Zone I All that part of Tracy Avenue between the north line (projected) of East story Street and a line 270 feet north of the north line of College Street; all that part of Dickerson Street between the west line of Trncy Avenue and a line 150 feet west of the west line of Tracy Avenue. Section 12. That Section 164 of Article XXI of Ordinance No. 768 of the City I of Bozeman, the short title of whlch is the Traffic Ordinance be, and the same is hereby amended to read as follows: Schedule III Section 164 Boundaries of School Crossing Zones: In accordance with the provisions of Section 38 (f), it shall be lmlawful for any operator of any vehicle between the h01WS of 8:00 A.M. and 4:30 P.M. on days, or parts of days, when school is in session to drive at a speed greater than fifteen 915) miles per hour when approach- ing within fifty (50) feet and in traversing the streets, or parts of streets, specified in the following School Crossing Zones: ~' The intersection of Mendenhall Street and Third Avenue; The intersection of Dickerson Street and Willson Avenue; 462 ORDINANCE NO. 803 The intersection of College Street and Tenth Avenue; The intersection of College Street and Willson Avenue; The intersection of Alderson street and Willson Avenue; The intersection of Dickerson Street and Willson Avenue; The intersection of Main street and Grand Avenue; The intersection of Beall Street and North Seventh Avenue; The intersection of Villard street and North Seventh Avenue; I The intersection of Durston Road and North Seventh Avenue; The intersection of Mendenhall Street and North Third AVenue. That Section 166 of Article XXI of Ordinance No. 768 of the City of Bozeman, the short title of which is the Traffic Ordinance be, and the same is hereby amended to read as follows: Schedule V Section 166 One-Way Streets and Alleys: In accordance with Section 47 and when properly signposted, traffic shall move only in the direction indicated upon the following streets and alleys: Name of streets and Alleys Direction of Traffic Movement Alley in Block A, story's Addition to the City of Bozeman East Section 14. That Section 167 of Article XXI of Ordinance No. 768 of the Clty of Bozeman, the short title of which is the Traffic Ordinance be, and the same is hereby amended to read as follows: Schedule VI Section 167 Through or Arterial Streets: In accordance with the provisions of Section 48 and when signs are erected giving notice thereof, drivers of vehicles shall stop at every intersection before entering any of the following streets or parts of streets: I' Main Street All that part of Main Street between the west line of the city limits of Bozeman. Section 17. That all ordinances and parts of ordinances in conflict with this Ordinance be, and the same are hereby repealed.
