EXCEPTIONS
SECTION 1. This Ordinance is not designed to cover Central Stntions', Power Houses,
or Sub Stations, nor is it desi8ned to cover wiring engaged in by public
telephone or ~elegraph companies" in the exercise of its function except as noted in
the special wiring rules.
PERMI'rS, FEES AND PLANS
SECTION 2. (a) Permit Required. No alteration or addition shall be made in the ex-
isting wiring of any building, nor shall any building be wire~ for the
placing of any electrical lights, motoY's, heating devices or any apparatus requiring
the use of electrical current, nor shall any alterations be made in the wiring in any
building after :tnspection, without first notifying the elec trlcal inspector and securing
a permit therefore. However a licenced contractor or a licenced electrician working for
a licenced contractor may secure a permit number by telephone from the electrical in-
spector's office if he so desires.
Where work for which a permlt is required by this Ordinance is started or proceeded with
prior to obtaining sat d permit, the fees specified shall be doubled, but the payment of
said fee shall not relieve any persons from fully complying with the requirements of this
Ordinance in the execution of the work, noT' from the other penalties prescribed herein.

(c) plans Required. Accompanang the Bnplication for per~it there shall be filed with
the inspector plans of the work to be lmder-taken on all non-residential'l construction
and, if deemed necessary by the Electrical Inspector, plans may be required for resid-
ence type work. The above mentioned plans shall show the character end ~ecise location
of the premises, all features of the work, and the name of the owner,and shall be signed
by the c)ntractor. Such plans shall be riled at least five days in advance of commence-
, ment of the work contemplated. The permit shall not be held to allow cutting of any
structural features af any buildinc. The permit shall cover the wo:!"k set forth in the
plans only, and if' additional work or change3 in the location of fixtures is to be under-
I taken, a new permit to cover such add! tional work)r mO.difiCS tim shall be secured in the

Section 3. (a) Powers and Duties. 'fhe office of the Electrical Inspector shall be made
a part of the Department of Public Safety and the Electrical Inspector shall
be appointed by the City Manager. He shall be of good moral character and fi tted by train-
ing and experience to properly fill the Jffice of the Electrical Inspector, shall be well
versed in auproved methods of electrical construction for safety to life and property, the
statutes of the state of Mvntana relating to electrical work, the rules and regulations
issued by the Public Service Commission' of Montana lmder authority of the statutes, the
National Electrical Code, as approved by the Am8rican Standards Association, the National
Electrical Safety Code as anproved by the American Standards Association and ather in-
s tallation and safety rules and s tandarc1s approved by the AmeJ,ican Standards Assoc fa ti on.
including the "Minimum Specifications for Adequate 1}\/iring of' Lighting Circuits" as issued
by the National Electric Light Association.
(b) ..,Authority. Right of Access to Buildings. Said Electrical Inspector shall have the
I' .Lgnt during reasonable h Jurs to enter any building in the discharge of his official
duties, or for the purpose of making any inspection or test of the installation of elec-
tric wiring, electric devices, and/or electrical material contained therein, and shall
have the authority to cause the turning off of all electrical currents in cases of emer-
gency to any wire where such electrical currents al'e dangerous to life ')1' pro!B rty or may
interfere with the work of the fire department. The Electrical Inspector is hereby auth-
orized, empowered and directed to have general supervision over the placing, stringing or
attaching of electric light and power wires, telephone, telegraph, messenger CRl1. "W'
other wires in buildings, so as to prevent fire, accident or endanger life, and property,
and any or all such wires or electrical apparatus now existing, as well as those hereafter
constructed and placed, shall be subject to such supervision. Whenever any electrical
wire or other piece of electrical apparatus is or shall bec :)me defec ti ve by reasm pf im-
proper or insufficient insulation or for any other reason bec,)me dangerous, the Elec trical
I Inspe. ctpr .Shall at. once notify the owner or agent of said wire or electrical. apparatus to
- repair or remove the same, and upon the owners failure to repair or remove the wire within
forty-eight hours time, the Electrical Inspector shall cause sal. d wire or apparatus to be
removed at the e~pense of said owner or agent, and such expense shall be assessed by the
City Commission against such owner.
(c) stoppage of Work. Power to order service stopped. The electrical inspector shall
have supervision over all wires, materials, apparatus and fittings used for the trans-
mittion, translation or consumption of electrical current for light, heat, or power, or
for any other purpose, whether new or old; and, whenever any such wires, :naterial, appar-
atus or appurtenances is, or may become dangerous to life of pro~rty, or liable to cause
fire, accident or injlITY, he is empowered to order the owner, agent, or user to remove or
repair such within forty-eight hOl~S after receipt of the notice. In case the order is
not complied with, the electrical inspector shall order the current to be disc~nnected,
from the installation on the part of it which is considered hazardous, and all owners,
'agents, users, light and power companies and others, shall not have the current ccmnected
again until the Electrical Inspector has given a written permit to do so. All firms corp-
orations, or indJviduals, whether operating under a regular franchise granted by the City
of not, shall, upon written notice from the Electrical Inspector, disc)nnect from any
buil(ling the serviee on any circuit as designated by the notice, and shall not reconnect
the building service or cirGuit, except upon writt.en notice from the Electrical Inspector.
(d) Inspection. Upon the completion/of the wiring or alterations or additions to the
wiring of any building, it shall be the duty of the person, fir~, or corporation install-
ing the same to notify the Electrical Inspector, who shall inspect the installation within
forty-eight hours of the time :.ouch notice is given, Sunlays, and holidays excepted, and
if it is found to be fully in compliance with this Ordainance anti does not constitute a
hazard to life and property, he shall sign the inspection card posted for that job which
signing will authorize connection to the electricals ervlce and the turning on of the
current. Pr.)vided, however, that the Inspector may give temporary permission to furnish
electric current to or the use of the electric c1ITrent, through any wires, or other
equipment for a length of time not exceedine; thirty days, if it appears that such wires,
let. c. · may be used safely, anc1 that there exist:] an urgent necesslty for such use and .
. special permission. All wires which are to be hidden from ,dew shall be inspected before
concealment and any person, firm or corporation insta] ling such wires shall notify the
Electrical Inspector, giving him twenty-f,)ur hJurs in which to make the required inspect-ton
bef)re such wires are concealed. Providing that on large installationSwhere concealment
of parts of the wiring proceeds continuously, the prnson, firm, or corporation installing
the wir:Lng shall give the Electrical Inspector due notice and inspection shall be made
periodically durinr.; the pP':Jp'ress of the w,)rk. "A notice in the f )rm of a taS. or label shall
be attached to the service switch, clearly stating that the work has been passed by the
. Electrical Inspector and is approved for covering.
(e) Re-inspection. When considered advisable by the Electrical Inspector or upon request
by the fire chief, light and power company or the owner or tenant of any building the
Electrical Inspector shall make a thorough re-inspectlon of' the installation in any build-

ings of all electric wiring, electrical devices and electrical material now installed or
that may hereafter be installed within the City of Bozeman. When the installation of
any such wiring, devices anel/or materials is f')lmd to be in a danger H1S 'J!~ unsafe c::>ndi ton
the ;-:e rson, firm or corporation owning, using '11'" operating the same shall be notified and
and shall make the necessary repairs, or changes recuir~d to place such wiring, devices and
ma terial in a safe c ondl tion and ha VB such work completed wi thin fou.r days, or any longer
period specified by the Electrical Inspector in said notice. The Electrical Inspector is
hereby empowered to order the discontinuance of electrical service to such ~ring, devices
and/or material so found to be defectively installed lmtil the installation of such wiring,
devices and material has been made safe as directed by the Electrical Inspector. I,
(f) C)ustruction Requirements. No inspection shall be appr,)ved lmless the electrical
light, power and heating installations are in strict conformity with the IT c)visi:ms of
this Ordinance, the statutes of the State of MJn~ana, the rules and regulations issued by
the Public Service Commission of Montana under the a.uthority of the State statutes, and
1m 1 e 3 s they are in conformity ~ th the approved methods of construction for safety to life
and property. 'rhe regulati::ms as laid down in the latest issue of the National Electrical
Code, as approved by the American Standards Association, shall be prima facie evidence of
such approved methods.
( g) Records of Permits and Inspec ti'Jns. The Electrical Inspector shall keep complete re-
cords of all permits issued and- inspections made and other official work perfc:>rmed under
the provis;.)ns or this Ordinance. He shall be provided with the necessary clerical help to
carry out the provisions of this section. He shall pay all fees collected by him to the
Director of Finance m the last day of each m:mth and tak e his rece ipt therefore. He shall,
upon the first of each mJnth, make a written report to the Mayor, and City Commission show-
ing all permits issued, inspections made and fees collected by him 1mder the provisons of
this Ordinance for the preceding month.
(h) Review. When the Electrical Inspector condems all or part of any electrical instal 1-
at'lon, the~owner may within five days after receiving written notice from the Electrical
Inspector, file a petition in writing for review of said action, of the Electrical Inspector
with the City Clerk who shall refer the petition to the District Inspector for the National
~OE rd of Fire Underwri tars, or to a board of three competant parties to be appointed by the
Mayor, with the approval of the City Commission, upon receipt of which the said inspector or
Board shall at once "Y')cede to determine whether said electrical installation co~plies wi. th
this Ordinance, and within three days shall make a dec isi:m in accordance with its findint:s,
which shall be returned to the City Clerk for action.
APPROVED MATERI~S
SEc'r-r:ON h. No electrical materials, devices, or appliances shall be sold, offered for I
sale, installed or used unless they are in conformity with the provisions of
this Ordinance, the Statutes of the State of Montana, the rules and regulations issued by
the Public Service Commission, of the State of Montana, lmder authority of the state stat-
utes, and unless they are in conforr.dty with approved methods of construction for safety
to life and property, conformity of electrical materials, devices and appliances with the
standards of Undel'wri tel'" s I LaborHtories, Incorporated, or other approved labora t 01"'1 es,
shall be prima :~acie evidence that such elec ~pical materials, devices and appliances c;Jmply
wi th the requirements of this OrdLuP1ce. 'rhe maker I s name, trademark or other identifica-
tion symbol shall be placed on all el.ectrical material, devices or appliance sold, installed
or used under this Ordinance. The Electrical Inspector may grant provisional approval of
any electrical materials, devices or appliances as in conformity with the provisions of this
Ordinance under any of the follOWing conditions:
(a) Where no standard has been prepared by the Underwriters' Laboratories, Incorporated, to
which the material, device or appliance shall conform.
(b) Where no other material, device or appliance of similar type is available which is in
conformity with the standards of Underwriters' Laboratories.
(c) In emergenc y, temporary approval may be given to materials, devices or appliances which
have not been passed on by Underwriters' Laboratories, Incorporated, provided such materials
devices or appliances have been submitted to Underwriters' Laboratories, Incorporated, for
test and approval. Such temporary approval shall not be granted for a longer period than
ninety days.
CONNECTIONS
SECTION 5. It shall be unlawful for any electric light or power company or electric util-
ity, to make any electrical connections to any building or premises until the
wiring has been approved by the Electrical Inspector, pro vid ed, however, special permission
may be given by him to make a temporary connection and use pr)rtions of the wiring in a I
building during construction, if it appears that this can be safely done, and there exists
an urgent necessity for such use and for such special permission.
UNLAWFUL WIRING
SECTION 6. It shall be unlawful for property owner or contractors not holding permits for
doing electric wiring, to interfere in any manner with any electric wiring in, or on, any
building. If, in any case the wiring is in such position as to.interfere with the com-
pletion o"f the building as called for by the plans, the wiring contractor shall be notified
to have it changed.

LICENSE, BOND AND OWNER'S RIGHTS
SECTION 7. No person, firm or corporation shall engage in installing, repairing or
altering electrical wiring or conductors within the corporate limits of the
City of Bozeman, Montana, for the purpose of transmitting electrical energy for light,
heat, or power, without first obtaining a license therefore from the Electrical Inspector
and furnishing a liability bond as hereinafter required. The Electrical Inspector, before
issuing a license, shall determine that the applicant is familiar with the Ordinances of
the City of Bozeman regulating the installations, repair, and maintenance of electrical
I wiring and that such applicant is qualified to engage in such work, for the protection of
life and property. ~his section is not designed to cover persons, firms or corporations
whose or'ly electrical work is the sale or repair' of electrical appliances.
There shall be two classes of licenses:
(a) Contractors' licenses for any person, firm, or corporations doing electrical con-
tracting.
(b) Individual electricians' licenses.
The fee for a Contractor's license shall be $10.00 annually. ~he bond for a Contractors'
license shall be $5,000.00 and no license shall be issued until a bond has been filed as
herein required. The bond herein required shall be approved as to form and sufficiency
the City Commission and conditioned that he or they will in good faith perform all of the
things required by the Ordinances of the City of Bozeman, and that, if any injury to any
person or damage to any property results by reason of his or their failure to neglect to
conform with any ordinance relating to the installation of electric wiring and equipment,
he or they shall save harmless and indemnify such person injured or the owner of such
property damaged.
The fee for an individual electricians' license shall be $10.00 the first time the license
is issued and $5.00 for each consecutive year thereafter. All licenses shall be issued
for one year and obtained on or before January 30th. of each year and will e~pire on the
31st day of December of the current year. Any individual electricians' license not re-
newed on or before January 3uth shall revert to $10.00.
A license of any person, firm or corporation engaged in doing electrical work may by the
City Commission be revoked if it is proven to the satisfaction of said City Commission
that such person, firm, or corporation wilfully or through carelessness or ignorance,
violates or permits its employees to violate any of the provisions of this Ordinance.
I If an owner wished to do wiring in his own home, he may do so without a license, but he
must first obtain a permit required by this Ordinance, provided, however, the Electrical
Inspector may refuse to issue a permit to any person who, in his estimation, is not com-
petent to install the electrical work in accordance with the regulations of this Ordinance.
Sign companies shall be permitted to do wiring in signs and outline lighting on the
secondary side of the transformers only.
WIRING RULES
SECTION 8. 1. Service wires and feeders to branch panels in family dwelling shall be a
three wire-service not less than 100 amp. in size. Wherever in this Ordinance
the term dwelling occupancy is used, it shall be held to mean a building having not more
than four families or a building containing not more than ten rooms for the use of guests.
No building shall be classed as a dwelling if any part of the building is used for any
other purpose than a dwelling.
2. Where additions are made to existing circuits~which circuits contain old style plugged
fuses,shall be changed to type "s" of the proper size for wires to which they are attached.
3. All service entrance conductors shall be provided with overload protection and dis-
connect at their outer' end, and be in conduit not smaller than 1 1/4 inch or be approved
entrance cable.
4. All branch circ'uits shall be of the enclosed automatic, therm-ma~etic fusless type or
enclosed fused cabinet equipped wi th the type "s" fuses, designed to ip or open on a pre-
detormined overload of current.
5. Spare circuit breaker spaces or approved fuse spaces shall be prOVided in residential
and apartment penels, in the ratio of one space for each five breakers used in the panel.
I 6. Joists may be notched 1/5 of the depth of the joist but no further than one foot from
its bearing and may be notched 1/8 of the depth of the joist but not further than two feet
from their bearing.
7. All mast type services shall be continuous, rigid conduit of sufficient size to support
the service drop, but not less than one and one-half inch. The service head shall be not
less than three and one-half feet above the roof. A walkable roof is defined by this
Ordinance as a roof accessible by a fixed, permanent stairway, or a door. This roof being
designed or used for some purpose other than normal service or maintenance work. In such
case the clearance of service wires shall be not less than 8 feet.

8. In every building designed for occupancy as a residence by two or more families, the
branch circuit protection for each apartment shall be installed in the apartment served,
or such branch circuit protection shall be grouped in one or more cabinets opening into a
public hWlway so as to be readily accessible to the occupants of the building.
9. No wire smaller than # 12 B & S guage may be used for light, heat and power wiring ex-
cept that # 14 may be used onl! for switchlegs.
10. All furnace and air-conditioning rooms or areas, must have a light, with a switch at
the entrance. I
11. Where installation of stationary motors 1/6 h.p. and over are made, the so called
ndn tamperable fuse, or other approved device shall b e used where builtin protection is
no t pro vided . 'llhis protection and disconnect shall be wi thin sight of themotor.
CLASSIFICA TIONS
SECTION 9. All buildings coming under the following classifications must be wired in
approved metallic conduit and be so installed throughout and in accordance with the re-
quirements .of conduit construction provided, however, that service metal raceways, elec-
trical metalic tubing and under floor raceways may be used under conditions designed in
the latest issue of the National Electrical Code.
1. All buildings within fi~ district one,except private dewellings and their accessory
building used for non-commercial uses.
2. All commercial and/or industrial buildings.
3. All apartment houses, tenement houses, and flats.
4. All alterations or additions to any buildin?os coming under the above classificatiqn
where the alteration or addition is equal to 500 of the installation, the whole building
must be brought up to the requirements of this code. The inspector may allow al tera ti ons
or smaller additions to be made with metal molding to the electrical installation in mlild-
ings coming under the above classification that have been wired previous to the passage
of this code, contrary to the above requirements, but if he deems it necessary, the entire
building must conform with the present requirements.

. Where a service run of conduit or electrical metallic tubing does not exceed
50 feet in length and does not contain more than the equivalent of two quarter bends
from end to end two No.4 insulated and one No.4 bare conductors may be installed
in I-inch conduit or tubing. See note 4 to tables 1, la, 2 and 2a.
5. All public buildings such as hotels, churches, theatres, moving picture houses, public
hails, meeting places, and gasoline service stations, stores, and basements of stores,
warehouses, mills, schools, manufacturing plants.

6. All power wiring except in private dwellings.
7. All hazardous locations as set forth in the National Electric Code.
RESPONSIBILITY
I SECTION lU. This Ordinance shal~ not be construed to relieve from or lesson the respon-
sibilityor liability of any party owning, operating, controlling, or in-
stalling any electric wiring, electric devices and/or electric material for damages to
person or property caused by any defect therein nor shall the City or the Inspector be
held as assuming any such liability by reason of the inspection authorized herein, or
certificate of inspection issued as herein provided.
SECT:r:ON 11. In phases of electrical work not covered by this Ordinance the latest issue
of the National Electrical Code shall apply.

SECTION 12. Ana person, firm or corporation violating any of the provisions of this
Or inance shall be deemed guilty of a misdemeanor, and each such person shall
be deemed ~)ilty of a separate offense for each and everyday or portion thereof, during
which any violation of any provision of this Ordinance is committed, continued or permitted,
and upon conviction of any such violation, such person shall be punished by a fine of not
more than Three Hundred Dollars, or by imprisionment in the city jail for not more than
twenty-five days or by both such fine and imprisionment.
VALIDITY OF REGULATIONS
SECTION 13. If any section, paragraph, subdivision, clause, phrase or provisJon of this I
Ordinance shall be adjudged invalid or held unconstitutional, the same shall
not affect the validty of this Ordinance as a whole, or any part, or provision thereof,
other than the part so decided to be invalid or unconstitutional.
SECTION 14. All Ordinances and parts of Ordinances in conflict herewith are hereby re-
pealed.
SECTION 15. This Ordinance shall be in full force and effect from and after thirty (3U)
days from its final adoption.
Finally adopted and approved a t a regular session of the Commission of the City of
Bozeman held on the 23rd day of July, 1958 .
