ORDINANCE NO. 812
,
AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA, VACATING A PORTION OF AYLSWORTH AVENUE
IN DRUM LUMWN ADDITION TO THE CITY OF BOZEMAN, MONTANA
WHEREAS, certain property owners owning property abutting Aylsworth Avenue in Drum Lummon Addition to
the City of Bozeman, Montana, have presented to the City Commission a petition asking the City Commis~ion
I to institute the necessary prodeedings to vacate a portion of Aylsworth Avenue in Drum Lummon Addition to
the City of Bozeman, Montana, hereinafter more particularly described; and
WHEREAS, on the 3rd day of June A. D. 1959, at its regular meeting, the said City Commission passed
and adopted Commission Resolution No. 949 declaring it to be the intention of the said City of Bozeman to
vacate a portion of Aylsworth Avenue in Drum Lummon Addition to the City of Bozeman and directing the City
Manager of the City of Bozemanto give motice thereof in the manner and for the time as provided by law; and
WHEREAS, pursuant to said Resolution, notice of the adoption of said Resolution was published in the
Bozeman Daily Chronicle at least onoe before said Resolution was acted upon, as appears by the affidavit
of the publisher of said Bozeman Daily Chronicle on file with the Clerk of the Ci~ Commission and which
said notioe describes the portion of Aylsworth Avenue to be vacated end gives notice that the hearing on
said Resolution would be held at the regular meeting of the City Commission to be held on the 17th day
of June A. D. 1959, at 1&00 p.m., at the Commdssion Roam in the City Hall Building of the City of Bozemansand
WHEREAS, on the l7t~ day of June A. D. 1959, at its regular meeting, the said City Cammiscion
fully heard objeotions to and evidenoe in support of said vaoation; and
WHEREAS, the City Manager having given notioe of the adoption of said Resolution of Intention for the
time and in the manner as by law provided, and the time for objeotions as set forth in said notioe having
I expired and the objeotions made being considered insuffioient, and it appearing that all provisions of the
law in suoh cases made and provided had been fully met and oomplied with; and
WHEREAS, on June 17th-, 1969, the City Commission in regular session assembled, did then and there
determine that suoh portion of ~lsworth Avenue in Drum Lummon Addition should be cavated and suoh determina-
tion was entered upon the minutes of said meeting, and did then and there determine and deoide that suoh
vaoa tion of the portion of Aylsworth Avenue in Drum Lummon Addition to the Ci t.v of Bozeman, Montana, could
be made without detriment to the publio interest and should be made in the publio interest.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF BOZEMAlh
Seotion 1
That the following desoribed portion of Aylsworth Avenue in Drum Lummon Addition to the City of
Bozeman, Montana, be, and the same is hereby, vaoated and discontinued.
That portion of Aylsworth Avenue extending from Fort Ellis Street to
East College Street between Blooks Fourteen (14) and Fifteen (15) of
Drum LtUIUIlon Addition to the City of Bozeman, Montana
Section 2
This Ordinance shall be in full force and effeot from and after thirty (30) days after its adoption.
I Adopted at a reg~lar meeting of the City Commission of the City of Bozeman held this 17th day of June
A. D. 1959.
