Home My WebLink AboutOrdinance 59- 817, Vacating portions of East College Street, East Cleveland Street, East Arthur Street, 49fi ORDINANCE NO. 817 AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA, VACATING PORTIONS OF EAST COLLEGE STREET, EAST CLEVELAND STREET, EAST ARTHUR STREET, BtJTTONWOOD AVEtITJE, HIGHLAND AVENUE, CYPRESS AVENtJE SOUTH, McADOW AVENUE SOUTH, AND PROSPECT PLACE AND ALL ALLEYS AS ORIGINALLY PLATTED, ALL IN PRO- SPECT HILL ADDITION TO THE CITY OF BOZE~MN, PORTIONS OF BUTTONWOOD AVENUE, CYPRESS AVENUE SOUTH, McADOW AVENUE SOUTH, EAST LINCOLN STREET, EAST GARFIELD STREET, EAST I HAYES STREET, EAST GRANT STREET, JOHNSON PLACE AND ALL ALLEYS AS ORIGINALLY PLATTED, ALL IN VALLEY VIEW ADDITION TO THE CITY OF BOZEMAN, PORTIONS OF EAST GARFIELD STREET, EAST HAYES STREET, HIGHLAND AVENUE, AND ALL ALLEYS AS ORIGINALLY PLATTED, ALL IN HIGHLAND ADDITION TO THE CITY OF BOZEMAN, AND PORTIONS OF EAST HARRISON STREET, EAST CLEVELAND STREET, EAST ARTHUR STREET, EAST GARFIELD STREET, EAST HAYES STREET, EAST GRANT STREET, JOHNSON PLACE, EAST LINCOLN STREET, AYLSWORTH AVENUE, SWITZLER AVE1~E, ELECTRIC AVENUE, AND AL~ ALLEYS AS ORIGINALLY PLATTED, ALL IN CENTRAL ADDITION TO THE CITY OF BOZEMAN WHEREAS, a certain property owner owning more than 51% of the lands abutting streets, avenues and alleys in Prospect Hill Addition, Valley View Addition, Highland Addition and Central Addition to the City of Bozeman, has presented to the City Commission a petition asking the City Commission to institute the necessary proceedings to vacate portions of certain streets, avenues and alleys in said Additions to the City of Bozeman, Montana, herein- after more particularly described; and WHEREAS, on the 23rd day of September A. D. 1959, at its regular meet- ing, the said City Commission passed and adopted Commission Resolution No. 961 declaring it to be the intention of the said City of Bozeman to vacate portions of certain streets, avenues and alleys in Prospect Hill Addition, Valley View Addition, Highland Addition and Central Addition to the City of Bozeman, Montana, and directing the City Manager of the City of Bozeman to give notice thereof in the manner and for the time as provided by law; and WHEREAS, pursuant to said Resolution, notice of the adoption of said Res... I olution was given by personal service upon all persons who could be person- ally served in the State of Montana and upon all other persons by publication of a notice of the adoption of said Resolution in the Bozeman Daily Chronicle a t leas t once before said Resolu tion was acted upon, as appears by the affi'" davit of the publisher of said Bozeman Daily Chronicle on file with the Clerk of the City Commission, and which said notices describe the portions of streets, avenues and alleys to be vacated and give notice that the hearing on said Res... olution would be held at the regular meeting of the City Commission to be held on the 14th day of October A. D. 1959, at 1:00 o'clock p.m. at the Commission Room in the City Hall Building of the City of Bozeman; and WHEREAS, on the 14th day of October A.D. 1959, at its regular meeting, the said City Commission fully heard obJections to and evidence in support of said vacation; and WHEREAS, the City Manager having given notice of the adoption of said Res- olution of Intention for the time and in the manner as by law provided, and the time for objections as set forth in said notice having expired and the objections made being considered insufficient, and it appearing that all provisions of the law in such cases made and prOVided had been fully met and complied with; and WHEREAS, on December 9th, 1959, the City Commission in regular session assembled, did then and there determine tha t certain s tree ts',' 'a.v~nues and alleys in Prospect Hill Addi tion, Valley View Addi tion, Highland Add.ition-, and Central Addi tion to the Ci ty of Bozeman, Montana, should be vacated, and- 'such determ- ination was entered upon the minutes of said meeting, a-nd did then and there determine and decide that such vacation could be made-without detriment to the public interest and should be made in the public intere~y. - - . --- NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION:OF THE CITY OF BOZEMAN: Section 1 " -, w .. ~ '0' _ ~ _ I ~ - .... - ~ - That the following described portions of streets, avenu~8 and alleys in Prospect Hill Addition, Valley View Addition, Highland Addition and Central Addition to the Clty'of Bozeman, Montana, be, and the same are hereby, vacated and discontinued: .- .
