Rouse Avenue Bozeman MT 59715 2529947 Page: 1 of 2 11/09/2015 11:28:58 AM Fee: $14.00 Charlotte Mills - Gallatin County, MT MISC I I III I I I I I I I I I II II I I I I I I I I I I I I I I I I I I I II I I I i l l l l I I I I I II I I I I I I I I I I I I I I I I I I!I!I II( RELEASE OF BUILDING PERMIT RESTRICTIONS WHEREAS, the CITY OF BOZEMAN, a Municipal Corporation of the State of Montana, hereinafter called the "City" entered into an Improvements Agreement for the Alder Creek Subdivision dated September 25,2007,Document No. 2281861; and WHEREAS, the City f led a Notice of Building Permit Restrictions on said subdivision, with said document being filed on December 17,2007, as Document No. 2281860; and WHEREAS, MARHAR HOMES LLC, hereinafter called "Subdivider" has installed street improvements, street signs, street barricades, municipal water and sanitary sewer and storm water facilities which under the terms and conditions of said Agreement necessitated a restriction on building permits; and WHEREAS, the CITY entered into new Improvements Agreements with the Subdivider for the Alder Creek Subdivision Phase 5 dated November 2, 2015 to provide security for not yet installed sidewalks,landscaping, irrigation and trail improvements; 4 TIIEREFORE, the City hereby certifies that the required improvements have been installed and accepted by the City in accord with all terms and conditions of said Improvements Agreement, Document No. 2281861 and those items necessitating the Notice of Building Permit Restrictions have d been fully satisfied; and that a new Improvements Agreement for not yet installed sidewalks, landscaping, irrigation, and trail improvements is prepared; and as such Subdivider is hereby fully released from the terms and conditions of Improvements Agreement for the Alder Creek Subdivision dated September 25, 2007, Document No. 2281861 and building permits may be issued in Alder Creek Subdivision Phase 5.
