Box 1230 Bozeman, Montana 59771-1230 i RE: Use of Cash-in-Lieu of Parkland Dedication—23rd Avenue Condominium; Application Z14125 Dear Planning Office: On behalf of our clients, Thunderbolt Properties, LLC, and Scott Johnson and John Rosa, developers of the 23`d Avenue Condominium Project, we respectfully request that the enclosed Cash-in-Lieu of Parkland Dedication in the amount of$25,092.00 [Check No. 1093, in the amount of$12,543.00, Rosa Construction, Inc. and a check in the amount of$12,546 from Scott and Wendy Johnson], be used for the Bozeman Sports Park Athletic Complex (`Bozeman Sports i Park"), south of Baxter Lane, north of Oak Street, and between Flanders Mill Road and Cottonwood Road. It is our understanding that the application for the Bozeman Sports Park has been approved and the project is pending master plan approval, which is anticipated to take place in March 2016. r x Bozeman's park dedication requirements and state law acknowledge that money dedicated may r be used to acquire, develop or maintain parks or recreational areas, given that Bozeman has formally adopted a park plan that establishes the need and procedures for use of those funds, and when the park and recreational area is located within a reasonably close proximity to the proposed development. See, § 76-3-621, MCA, Section 38.27.030 BMC. In this case, the Bozeman Sports Park is located within reasonably close proximity to the 23rd Avenue Condominium. We will submit a formal request on behalf of Thunderbolt Properties, LLC, and Scott Johnson and John Rosa to the City of Bozeman Parks, Recreation and Cemetery Department.
