Notice of Award CK May Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Richard Hixson, City Engineer SUBJECT: Notice of Award for LFG/SVE Treatment System at the Story Mill Landfill MEETING DATE: December 7, 2015 AGENDA ITEM TYPE: Consent RECOMMENDATION: Authorize the City Manager to sign the Notice of Award for the LFG/SVE Treatment System at the Story Mill Landfill to C K May Excavating, Inc.. BACKGROUND: On October 27, 2015, 7 bids were received for the Bozeman Landfill Gas/Soil Vapor Extraction Treatment System project. This project is the installation phase of the Montana Department of Environmental Quality (DEQ) approved alternative of the Bozeman Landfill Corrective Measures Assessment. The bid amounts ranged from a low of $1,025,233.00 to $1,738,505.00. The engineers estimate was $1,000,000.00. The low bid was submitted by C K May Excavating, Inc., of Belgrade Montana. The low bid was 2.5% above the engineers estimate, which is a competitive. The city's consultant on this project, Tetra Tech, has recommended that the since the bid is responsive and responsible, the city should award the contract to C K May, Inc. FISCAL EFFECTS: Because these tasks are related to the Landfill Remediation System the City intends to reimburse these costs from the SRF Landfill Project loan proceeds. We have been working closely with Mike Abrahamson at the MDEQ Technical & Financial Assistance Department to insure all of the loan requirements have been met. ALTERNATIVES: As suggested by the City Commission. Box 1426 Belgrade, MT 59714 PROJECT: Bozeman Landfill SVE/LFG System CONTRACT FOR: Construction of the SVE/LFG System You are notified that your Bid dated for the above Contract has been considered. You are the apparent Successful Bidder and have been awarded a Contract for: The Bozeman Landfill SVE/LFG System. The Contract Price of your Contract is: One million, twenty five thousand, two hundred and twenty three Dollars ($1,025,223.00). Six copies of each of the proposed Contract Documents (including Drawings) accompany this Notice of Award. You must comply with the following conditions precedent within fifteen (15) days of the date of this Notice of Award, that is, by November 21, 2015: 1. You must deliver to the OWNER six fully executed counterparts of the Agreement including all the Contract Documents and Drawings. 2. You must deliver with the executed Agreement the Contract Security (Bonds) and insurance as specified in the Instruction to Bidders (paragraph 20), General Conditions (article 5) and Supplementary Conditions (those paragraphs modifying article 5 of the General Condtions). 3. List other conditions precedent: None. Failure to comply with these conditions within the time specified will entitle OWNER to consider your Bid abandoned, to annul this Notice of Award, and to declare your Bid Security forfeited. Within ten (10) days after you comply with these conditions, OWNER will return to you two fully signed counterparts of the Agreement with the Contract Documents attached.
