At The Lakes At Valley West Subdivision,Phases 1 and 2
CITY OF BOZEMAN, GALLATIN COUNTY,MONTANA
The Lakes At Valley West,Bozeman, LLC , GRANTOR, in consideration of the receipt of One
Dollar($1.00) and for other valuable consideration,receipt of which is hereby acknowledged,
does hereby grant to the City of Bozeman, a municipal corporation of the State of Montana, with
offices at 121 North Rouse Avenue, P.O. Box 1230,Bozeman, Montana 59771-1230,
GRANTEE, a temporary street right-of-way for a temporary cul-de-sac (turnaround) easement
for the use by the public in,through, and across an area of land situated in the City of Bozeman,
on a 50 ft. radius, being no more than 100 ft. in diameter,in the following described
real property:
starting at the northwest corner of the 60-foot wide street right-of-way for Westmorland Drive
dedicated with Phase 2 of said Subdivision,thence southerly along the west boundary of Phase 2
on a bearini;of South 19 Degrees, 44' and 16"West a distance of 30.00 feet to a point on the
center line of said right-of-way and the west boundary of said Phase,thence North 1 Degree, 17',
10"West a distance of 40.01-feet past the west boundary of said Subdivision to the center of a
temporary cul-de-sac easement having a radius of 50.00-feet,
according to the official plat thereof on file and of record in the office of the County Clerk&
Recorder of Gallatin County,Montana, as shown and more particularly described on Exhibit"A"
attached hereto.
The GRANTOR states that he possesses the real property described above and that he has
a lawful right to grant an easement thereon.
The GRANTOR further agrees that the GRANTEE may peacefully hold and enjoy the
rights and privileges herein granted without any interruption by the GRANTOR.
The terms, covenants and provisions of this easement and agreement shall extend to and
be binding upon the heirs, executors, administrators,personal representatives, successors and
assigns of the parties hereto.
