WARRANTY DEED
For value received, GUINNESS PARTNERS, INC., a Montana corporation with its
principal offices located at 101 E Front Street, Suite 304, Missoula, Montana 59807, the Grantor,
does, subject to the deed restrictions set forth below, hereby grant, bargain, sell, warrant and
convey unto the CITY OF BOZEMAN, a municipal corporation and political subdivision of the
State of Montana, the Grantee, the following-described real property located in Gallatin County,
Montana, to-wit:

Lot 1 of The Legends at Bridger Creels II Subdivision, Phase 1

— Plat number J-470, document number 2278586, a platted
subdivision of Gallatin County, Montana, according to the
official recorded plat thereof.
TOGETHER WITH all easements and rights of way appurtenant to and utilized in
conjunction with the above described real property.
SUBJECT, HOWEVER, TO THE FOLLOWING:
(1) All real property taxes and assessments for 2015 and all subsequent years;
(2) All easements, reservations, and rights of way of record, or visible or apparent
from an inspection of the property;
(3) All prior use restrictions and protective and or restrictive covenants of record;
and,
(4) The following perpetual deed restriction, to-wit:
a. the said property will be used only for park, recreation, and open space
purposes;

b. development or other rights in or appurtenant to the said property will not
be transferred to, or used for the benefit of, any other property except for
Public Park 1 of The Legends at Bridger Creek II Subdivision, Phase 1
(plat reference J-470);
C. the said property will be open and accessible for public use and enjoyment
for such park, recreation, and open space purposes and will not be further
divided or subdivided; and,
d. any use of the said property that will significantly impair or interfere with
the park, recreation and open space purposes of the property will be
prevented by Grantee.
e. The foregoing covenants associated with this deed restriction shall run
with the land and shall encumber the Property as provided hereunder, and
shall be binding upon the Grantee, and its successors and assigns. The
benefits of the covenants associated with this deed restriction shall run
with title to all the property and all platted lots within The Legends at
Bridger Creek 11 Subdivision, all Phases, Gallatin County, Montana. J
TO HAVE AND TO HOLD the said premises, with its appurtenances unto the said
Grantee, and to Grantee's successors and assigns. And the said Grantor does hereby covenant to
and with the said Grantee, it is the owner in fee simple of the property granted; that the Grantee
shall enjoy the same without any lawful disturbance; that the same is free from all encumbrances
except as noted above; that Grantor, and Grantor's successors, and all persons acquiring any
interest in the same through or for Grantor will, on demand, execute and deliver to Grantee at the
expense of the latter, any further assurance of the same that be reasonably required; and that
Grantor, and Grantor's successors, will warrant to Grantee all the said property against any
person lawfully claiming the same and will defend the same from all lawful claims whatsoever.
