There was no public comment. He requested that the current speed limit stay the same of that it be lowered. Public safety and c tourism was the majority of his concerns. j 06:10:18 PM Tom Kat,Public Comment Mr. Kat stated that he wanted to comment on the speed limit raise on frontage road. The city of Belgrade was referenced as well as. t 06:14:08 PM Cindy Oustralski,Pubic Comment Ms. Oustralski stated that the safety versus time needed to be considered before raising the speed limit. 06:15:49 PM Closed K Mayor Krauss closed public comment. r F. 06:15:53 PM Special Presentations 1. 06:16:12 PM Key Components and Issues of the 2015 Water Facility Plan Update Lyman Creek expansion and Municipal Groundwater Development Projects (Heaston) a 1= 06:16:12 PM Staff Presentation Brian Heaston, Staff Engineer gave a presentation on Key Components and Issues of the 2015 Water Facility Plan Update Lyman Creek expansion and Municipal Groundwater Development Projects. The mitigation plan in order to protect all existing water rights was discussed. Water storage was also discussed. 06:27:01 PM Commission Questions for Staff Cr. Andrus asked about the connection between the in stream flow and water mitigation. Cr. Pomeroy asked about the existing water supply and the ability to supply those needs in the future. Deputy Mayor Taylor asked for clarification for when water was predicted to go out. He also asked about Lyman Creek and its existing capacity and if we would be able to add more in the j future. E i= Cr. Mehl asked staff to clarify their definition of risk and what it was based on. Staff responded to all question in detail and also talked about the impact of wells as well as the water transmission main that were currently in town. He also asked for clarification between k; what was measured and what was actually used. Mayor Krauss asked about water pressure and surface water use. Page 3 of 12 r= I' October 19, 2015 Draft City Commission Minutes 06:37:23 PM Commission Questions for staff, continued Director of Public Works, Craig Woolard went into more detail about risk overall when it came to water as well as the lines in town and where those failure rates and risks were. Water rights and location was discussed at length as well. Brian Heaston continued to be more precise and detailed in his answers. The geologic investigation would help clear up and answer a lot of the questions about how much water would be available as well as the impact on the city as a whole. The mitigation bank was also discussed. G. 06:56:34 PM Action Items 1. A Second Phase of Development to Add 2 Two-household Dwellings to an already Developed Site, and a Cash-in-lieu of Parkland Approval Located at 3050 and 3056 York Street, Poplar Terrace, Phase 2 Site Plan Application 15368 (Quasi-Judicial) (Saunders) a 06:57:04 PM Staff presentation Chris Saunders from Community Development gave a presentation on a Second Phase of Development to Add 2 Two-household Dwellings to an already Developed Site, and a Cash-in- lieu of Parkland Approval Located at 3050 and 3056 York Street, Poplar Terrace, Phase 2 Site Plan Application 15368. Staff discussed the various phases and also presented information on Park Land Cash-in Lieu. 07:01:53 PM Commission Questions for staff Cr. Mehl asked about clarification on cash-in-lieu and the code provision. Cr. Andrus asked about parking issues and code requirements. 07:05:05 PM Applicant presentation Applicant Representative Chris Budeski clarified concerns that the commission had and reviewed all conditions. 07:06:18 PM Public Comment Mayor Krauss opened public comment. Public comment was closed. 07:06:25 PM Motion that having reviewed and considered the application materials, public comment, and all the information presented, I hereby adopt the findings presented in the staff report for application 15368 and move to approve the use of cash-in-lieu of parkland for this project and accept the submitted appraisal to establish the value. Mayor Krauss talked about the project and recognizing what is sacrificed by doing this. Andrus asked about the application point system via the matrix based on community affordable housing. Mayor Krauss asked about the community housing fund. 07:30:59 PM Applicant Presentation Applicant Representative Sam Long spoke about the affordable housing funding and went into detail about the application process to develop housing. The vacancy percentage was discussed as well as the need for the funding in the Montana Board of Housing. 07:33:38 PM Commission questions for Applicant Mayor Krauss asked the applicant to explain the Summit Housing request of$18,010.00 and what it meant. The applicant responded and stated that this is a very competitive market to provide housing to Bozeman. The process was discussed as well as the benefits to supporting this project. Cr. Andrus asked about heating in the proposed units. The applicant talked about the amenities compared to market rate units. Deputy Mayor Taylor asked about further clarification on the points and amenities for everyone. Commissioner- I-Ho Pomeroy: Motion I Commissioner- Cynthia Andrus: 2nd 07:44:23 PM Commission Discussion on the Motion Cr. Pomeroy and Cr. Andrus both supported this project. Deputy Carson Taylor talked about the importance of this project. Cr. Mehl also supported this project. It started at 60 mph, reduced to 50mph and after the speed study was completed, MDT waited to see what the recommendation of the speed limit would be. Currently the speed limit for that area was 45. Pomeroy asked about the impact on the drivers speed, and how we could make the roads as safe as possible. Speed limits, stop signs, and railroad tracks was discussed. Cr. Mehl wanted to clarify that MDT is the final say in adopting the speed limit. Deputy Mayor Carson Taylor asked about crashes that involved animals versus motor vehicles. Mayor Krauss asked about the speed limit on the interstate versus the main city streets. 08:04:47 PM Staff Response Police Chief Steve Crawford discussed reported accidents involving speed limits from the police department perspective. 08:06:50 PM Josh Waldo, Fire Chief Fire Chief Josh Waldo discussed reported accidents involving speeds limits from the fire department perspective. 08:07:53 PM Public Comment Mayor Krauss opened public comment 08:08:18 PM Ralph Zimmer,Public Comment Mr. Zimmer is completely against the speed limit being lowered. Mr. Zimmer stated that taking the interstate, that it was actually safer than a motorist taping frontage road. The interstate provides a safe place to pull over in a hurry as well. 08:12:30 PM Commission Questions Deputy Mayor Taylor asked for clarification on why a lower speed limit, 45 mph is less safe. Ralph Zimmer stated that people will drive what they feel they are comfortable with, despite the speed limit. 08:14:08 PM Melanie Brown,Public Comment Ms. Brown stated that drivers usually assume that the speed limit is safe, but most motorists also drive over the speed limit. She stated that there are 31 intersections between the Bozeman city limits and Cooley Rd. Traveling at 5mph, adding an extra 5mph gives you an extra 50% of getting injured. 08:19:32 PM Commission Discussion Mayor Krauss suggested that the commission submit a letter to the Montana Department of Transportation. Cr. Pomeroy wanted to know the safest speed limit. Andrus doesn't support the speed limit at 55mph and stated her reasons in detail. r i 08:22:36 PM Friendly amendment Deputy Mayor Taylor stated a friendly amendment to write a letter to support the speed limit at i 50 mph to Belgrade. Continued Commission Discussion Deputy Mayor Taylor spoke regarding the speed and the fact that it used to be the only road to is the airport. He supports 50 mph. Cr. Pomeroy stated that she was confused when she looked at the Study and will depend on the expert and supports the 50 mph. Cr. Mehl spoke regarding supporting the lower speed of 50 mph. Mayor Krauss spoke regarding traffic controls on the frontage road. He spoke of other areas of concern in regards to some traffic engineering. I 8:32:11 PM Vote on the Motion that having considered public testimony and staff background information, I move that the Bozeman City Commission concur with the MDT recommendations for Frontage Road Speed Limits with the friendly amendment to write a r letter to support the speed limit at SO mph for the length of the study area.
