HomeMy WebLinkAbout15- Full Consultant RFQ1 City of Bozeman, Montana Department of Economic Development Request for Qualifications Tax Increment, Targeted Economic and Urban Renewal District Consulting Services The City of Bozeman’s Department of Economic Development (the “City”) requests statements of qualifications from professional community and economic development organizations specializing in Montana Tax Increment Financing (TIF), urban renewal and Targeted Economic Development (TED) district activities. The City requests statements of qualifications from qualified individuals or firms for the purpose of assisting the City’s Economic Development Department with on-going activities within the City’s four Tax Increment Financing Districts including, but not limited to, the Northeast Urban Renewal District, the South Bozeman Technology District, the Bozeman Midtown Urban Renewal District and the North Park Industrial District. The individual or firm selected will be responsible for advising the City on maximizing the economic development potential of the City’s TIF, Urban Renewal and TED districts in the City of Bozeman including relevant aspects of creating, utilizing, sun-setting and/or modifying TIF, urban renewal and TED districts. To meet the deadline for consideration, proposals must be received via e-mail only no later than 5:00 P.M., MDT, Monday, November 30, 2015. Mailed or hand-delivered proposals will not be accepted. Purpose of the Request for Qualifications The City, through its Economic Development Department, invites the submission of Qualifications from professional service providers interested in providing TIF, urban renewal and TED district consulting services to the City in accordance with the statues governing TIF, urban renewal and TED districts in the State of Montana. Currently, the City manages four TIF Districts within the City limits; the Northeast Urban Renewal District, the South Bozeman Technology District, the Bozeman Midtown Urban Renewal District and the North Park Industrial District. These Districts are critical economic development tools for furthering the 2 City’s primary economic development goals of increasing mid- to high wage job growth and further diversifying the local economy. The Districts are created by the Bozeman City Commission and governed by the laws of the State of Montana. As Bozeman’s economy evolves, the City envisions leveraging the TIF, urban renewal and/or TED districts for the benefit of the local economy. In order for TIFs, urban renewal and TED districts to maintain relevance, these districts require engaged leadership, active management and occasionally, outside consultancy. The City seeks to contract with qualified service providers for general TIF, urban renewal and TED district creation, designation, dissolution, and other support as necessary in order to maximize the economic development potential of the City’s TIF, urban renewal and TED district programs. If you have demonstrated experience in these areas and have an interest in making your services available to the City, you are invited to respond to this RFQ. The selected Respondent (hereinafter “Consultant”) shall perform general consulting services in accordance with Section I of this RFQ. The City seeks to negotiate a (1) one-year contract with a vendor who is qualified to perform the services identified above. The work contemplated is professional in nature. It is understood that the Consultant acting as an individual, partnership, corporation or other legal entity, is of professional status, licensed to perform in the State of Montana and the City of Bozeman and licensed for all applicable professional discipline(s) requiring licensing and will be governed by the professional ethics in its relationship to the City. It is also understood that all reports, information, or data prepared or assembled by the Consultant under a contract awarded pursuant to this RFQ are confidential in nature and will not be made available to any individual or organization, except the City without the prior written approval for the City. Any contract resulting from this document will require the Consultant to execute a statement of confidentiality. The Consultant shall be financially solvent and each of its members if a joint venture, its employees, agents or subcontractors of any tier shall be competent to perform the services required under this RFQ document. II. Evaluation of RFQ Responses The City will evaluate qualifications based on an established ranking system. The City may conduct interviews with one or more respondents and then may select the highest ranked applicant. The award will be made to the agent whose qualifications are deemed most advantageous to the City, all factors considered. Final terms and conditions of the agency relationship will then be negotiated. Once selected, the individual or firm must provide proof of mutually agreeable insurance coverage which may include insurance for errors and omissions (E & O) in an amount of at least 2 million dollars, ($2,000,000) naming the City as additional insured on a primary non-contributory basis or other additional insurance requirements. 3 Respondents will be evaluated according to the following factors 1. Quality of the Proposal; 20% 2. Respondent’s qualifications, and experience in the creation, designation, management and dissolution of TIF, urban renewal and TED districts in Bozeman 3. Respondent’s qualifications, and experience in the creation, designation, management and dissolution of TIF, urban renewal and TED districts in the State of Montana 30% 50% Statements of Qualifications must include 1. Individual or firm’s legal name, address, telephone number, fax number, web site (if any), and e-mail address; 2. Statement of experience and qualifications of the individual, firm and firm’s staff; 3. Demonstrated familiarity with the City of Bozeman’s Municipal Code; 4. Demonstrated familiarity with the State statutes governing TIF/TED Districts in Montana; 5. Statement regarding any work, past or present, provided to the City of Bozeman on any of the active TIF/TED Districts, if any; 6. Examples of any work provided to the City of Bozeman on any of the active TIF/TED Districts, if any; 7. Three professional references and full contact information for the listed references; and 8. OPTIONAL: Up to 5 (five) pages of promotional material or company brochures that illustrate the individual or firm’s experience, expertise and philosophy. If a Respondent is selected a listing agreement will be provided at a later date. Reservation of Rights The issuance of this RFQ and the receipt of statements of qualifications by the City shall not constitute an agreement or representation by the City that a contract for the professional real estate services will actually be entered into by the City. Through this RFQ the City is only soliciting statements of qualifications to determine whether to retain a real estate professional to provide seller agent services. The City reserves the right to issue written notice of changes to this RFQ should the City determine, in its sole and absolute discretion, that such changes are necessary or desirable. In addition and notwithstanding any other provision of this RFQ, the City reserves the right to: 1. Waive any immaterial defect or informality in a submittal; 4 2. Extend or otherwise revise the submittal date; 3. Reject any or all submissions or portions thereof; 4. Select a consultant that is in the best interest of the City considering experience, references, and other factors as determined by the City; 5. Negotiate terms and conditions of eventual contract with a selected consultant; 6. Reissue a new, revise or cancel this RFQ and not retain the services of a consultant; and 7. Request additional information from one or more respondents. No Partnership/Business Organization Nothing in this RFQ or in any subsequent agreement, or any other contract entered into as a result of this RFQ, shall constitute, create, give rise to or otherwise be recognized as a partnership or formal business organization of any kind between or among the City or the respondent. Employment Restriction and Indemnity No person who is an owner, officer, employee, contractor or consultant of a respondent shall be an officer or employee of the City. No rights of the City’s retirement or personnel rules accrue to a respondent, its officers, employees, contractors, or consultants. Respondents shall have the responsibility of all salaries, wages, bonuses, retirement, withholdings, worker’s compensation and occupational disease compensation, insurance, unemployment compensation other benefits and taxes and premiums appurtenant thereto concerning its officers, employees, contractors, and consultants. Each respondent shall save and hold the City harmless with respect to any and all claims for payment, compensation, salary, wages, bonuses, retirement, withholdings, worker’s compensation and occupational disease compensation, insurance, unemployment compensation other benefits and taxes and premiums in any way related to each respondent’s officers, employees, contractors and consultants. Submittal Rejection/Right to Disqualify Submittal of terms, condition and/or agreements may result in rejection if such terms, conditions, or agreements are deemed unacceptable by the City in its sole discretion. The City reserves the right to disqualify any respondent who fails to provide information or data specifically requested herein or who provides materially inaccurate or misleading information or data or who attempts to influence the selection process outside the procedures established herein. The City reserves the right to disqualify any respondent on the basis of any real or apparent conflict of interest. This disqualification is at the sole discretion of the City. Discrimination Each entity submitting under this request for qualifications shall include a provision wherein the submitting entity, or entities, affirms in writing it will not discriminate on the basis of race, color, religion, creed, sex, age, marital status, national origin, or because of actual or 5 perceived sexual orientation, gender identity or disability and which also recognizes the eventual contract for services will contain a provision prohibiting discrimination as described above and that this prohibition on discrimination shall apply to the hiring and treatment of the submitting entity’s employees and to any subcontracts entered into in fulfillment of an eventual agency relationship. Failure to comply with the above shall be cause for the City to deem the submittal non- responsive. Governing Law This RFQ and any disputes arising hereunder or under any future agreement for the purchase of real property between the City and the agent selected under this RFQ shall be governed hereafter and construed and enforced in accordance with the laws of the State of Montana, without reference to principles of choice or conflicts of laws. Miscellaneous No conversations or agreements with any officer, employee, or agent of the City shall affect or modify any term of this RFQ. Oral communications or any written/email communication between any person and the designated contact City staff shall not be considered binding. All proposals must be submitted complete and contain the information required as stated in the Request for Qualifications. The City of Bozeman reserves the right to reject any and all responses deemed unqualified, unsatisfactory, or inappropriate.
